HomeMy WebLinkAbout94 0524 min MINUTES CITY COUNCIL MEETING City of Plainview MAY 24, 1994 The Plainview City Council held a regularly scheduled meeting at 7:30 p.m., Tuesday, May 24, 1994, in the Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson Sr; - Precinct 1, Mary Virginia Kirchhoff - Precinct 2, Rey Rosas - Precinct 3, Mike Hutcherson - Precinct 4, Barbara Dorman - Precinct 5, Dwain Dodson - Precinct 6, and Irene Favila, Precinct 7. Staff members present were: James P: Jeffers - City Manager, Wally Hatch - City Attorney, Muff London - Director for Community Development, Norman Huggins - Director of Finance, Roy L. Osborne - Director of Public Safety, John Berry - Assistant Director of Public Works and Karen McBeth - City Secretary. News media present: Randy Ballinger - KKYN, KVOP, KATX OPEN MEETING 1. Invocation - Alton Jackson 2. Recognitions - Mayor Woods recognized Lee Soucy, J.D. Hahn, Tom Warren, and Dr. James Cox. Mr. Soucy was in Hawaii on December 6, 1941, and Mr. Hahn, Mr. Warren and Dr. Cox were all involved in the D-Day invasion of Normandy. They were given Certificates of Recognition and a key to the City of Plainview for their contribution to the freedom of our country. 3~ . Aqnexation - Ordinance N0~9~2994 - An Ordinance providing for the extension of~'~d~'~"~Undary limits of the CitY:~)f '~inview, Texas, and the annexation of certain tracts of land adjacent to Frisco Addition, Hale County, Texas; Severability clause; Cumulativeness clause; And effective date. Muff London, Director of Community Development, reviewed the proposed ordinanCe by displaying a map of the area to be annexed and explaining the area by description. Public Hearings were held on April 21 and 26, 1994. The Planning and Zoning Commission approved the annexation. Ms. London encouraged the council to approve the annexation as a step toward controlling growth and protection of the adjacent neighborhoods. Councilmember Dwain Dodson moved to annex the area up to and including just North of Spann Road; Barbara Dorman seconded the motion; the motion carried unanimously among the seven councilmembers present. 4. Wastewater Treatment Plant - Report from John Kelley, Parkhill Smith & Cooper Engineering. Mr. Kelley was unable to make the meeting and Mr. Butch Davis of Parkhill, 1 of 3 Smith & Cooper introduced Randy West, an Environmental Engineer presented the findings of the Texas Natural Resource Conservation Commission regarding Plainview's wastewater treatment plant. Mr. West explained that the city was renewing it's permit to operate the wastewater treatment plant. This permit is renewed every five years. The preliminary preparation for renewing the permit has been done. The state tests the waste water regularly and it is evaluated for pollutants. In this evaluation, there is a limit to the toxicity in the wastewater. If the wastewater is overly high in ammonia, steps will have to be taken to remove the ammonia so as to support certain life forms; i.e. the water flea and minnows. Mr. West stated that the current facilities does not remove the ammonia to a satisfactory level. Mr. West recommended the city make the maximum improvements to the wastewater treatment plant as soon as possible so as to handle the expected growth of the city's plant usage as well as meet the requirements of TNRCC's permitting. Mr. West did not have an estimated cost of the improvements. Mr. West stated the cost will depend on the usability of the present plant. Mayor Woods thanked him for his report. 5. Roofing Ordinance - Ordinance No. 94-2995 - An Ordinance of the City of Plainview, Texas amending ss 6-1 (r), Building Permit Fees of Chapter 6, Buildings, of the Plainview Code of Ordinances to delete the roofing permit fee; repealing ss 6-21 of the Plainview Code of Ordinances; Severability clause; Cumulativeness clause; Conflicts clause; And effective date. Director of Community Development stated this ordinance will remove the $25 fee for a permit to re-roof houses. Dwain Dodson stated that the ordinance charging a $25 permit fee was enacted to protect citizens from "fly-by-night" roofers. Councilmember Mike Hutcherson made a motion that Ordinance No. 94-2995 be approved; Dwain Dodson seconded the motion; the motion passed unanimously. 6. Texas Department of Transportation - Consider approving projects for submission to the Texas Department of Transportation for funding. City Manager Jim Jeffers reviewed several projects to be submitted to the Texas Department of Transportation for funding. Among them were: Making SW 3rd a truck route; That beautification efforts continue, such as additional landscaping for Business 1-27, advising the city of programs concerning wildflowers for the highway right-of-way and landscaping on overpass areas along 1-27; maintenance to major intersections along Quincy which have been milled; and the final overlay on Quincy Street. Barbara Dorman moved these projects be approved and TDOT be informed;Alton Jackson Sr. seconded the motion; the motion was passed unanimously. 7. Utility Rate Survey - Review a su~ey of area utility rates for water, sewer and sa~itation.~.;~ DireCtor of Finance Noirn'~'~uggins presented a survey his department co~~hg twenty other cities: ..M~i~i~uggins reported that there are three areas in which the city raises funds with which to run the city. One is the general fund, which is financed by taxes; the seconed is the water and sewer department which is financed by service fees; and the sanitation department which is financed by services fees. The survey revealed that Plainview rated favorably when compared with the other twenty cities ..... 2 of 3 in its charges for water, sewer and sanitation rates. Mr. Huggins stated that copies of this survey would be available in the water department if citizens wished to get a copy. Mayor WOods thanked Mr. Huggins for his report. 8. Consent Calendar - Barbara Dorman moved to approve the Consent Calendar as-presented; Mike Hutcherson seconded the motion; the motion passed unanimously. a) b) c) Minutes were approved. Departmental Reports were approved. Expenditures were approved. d) Board, committee and commisSiOn Appointments. Consider apPointments to the Board of Adjustment; and the Museum of the Llano Estacado Museum Transition Committee. No appointments were made to the Board of Adjustment. Barbara Dorman and Mary Virginia Kirchhoff and Norman Huggins Director of Finance, were appointed to the Transition Committee of the Llano Estacado Museum. e) South Plains Association of Governments Consider appointing a representative from the City of Plainview to the SPAG Board of Directors. Mike Hutcherson - Councilmember Precinct 4, was appointed 0 the South Plains Association of Governments Board of Directors. f) Water - City of Kress - Reaffirmed intent to sell water to the City of Kress, Texas. g) Charter Commission - Consider appointment of Ex-officio members. The following were appointed as Ex-Officio members of the Charter Commission: Rafel Lopez Jr., Rocky Favila, Rosa F. Zuniga, Lupe Rodriguez Jr., Ida Rodriguez, Fred Douglas Johnson, and Lou Balenton.' 9. Adjournment - Dwain Dodson made the motion to adjourn the meeting; Rey Rosas seconded the motion; the motion carried unanimously among the seven councilmembers present.
