CITY COUNCIL MEETING
City of Plainview
July 12, 1994
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, July 12, 1994, in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-
Session at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were:
Alton Jackson Sr. - Precinct 1, Mary Virginia Kirchhoff - Precinct 2, Rey Rosas - Precinct
3, Mike Hutcherson - Precinct 4, Barbara Dorman - Precinct 5, and Dwain Dodson -
Precinct 6. Irene Favila - Precinct 7 was absent.
Staff members present were: James P. Jeffers - City Manager, Muff London - Director of
Community Development, Roy L Osborne - Director of Public Safety, Wally Hatch - City
Attorney, Terry Powers - Director Human Resources, Norman Huggins -Director of
Finance and Karen McBeth - City Secretary.
News media present: Richard Orr - Plainview Daily Herald, Pete Strom - Plainview Cable
TV, Wayland Baptist University television.
OPEN MEETING
1. Invocation - Mike Hutcherson
2. Recognitions - Tony Smith and Carla Burress were presented with five year
employment pins with the City of Plainview and Larry Cornett and Detective Pat Serrano
were presented ten year pins.
Councilmember Rey Rosas recognized Leo Baxter, Hale County Veterans Agent,
for all the good work he has done in the community for the veterans and presented him
a Certificate of Appreciation.
Councilmember Dwain Dodson recognized Dr. Charles Teykl, local minister, who
is leaving Plainview and has done many things for civic Plainview during his 26 year
residency here. He was presented a Certificate of Appreciation and a key to the city.

appointed to the Minimum Housing Board.
e) Energy - The City will advertise for a Request for Proposal for the

development of a total energy program for the following city buildings: City
Hall - 901 Broadway, Police Station - 108 West 9th St., Unger Memorial
Library - 825 North Austin St.; Chamber of Commerce - 710 West 5th St.,
Water Treatment Plant - 3600 West 16th St., Water Reclamation Plant - SE
of City, Service Center - 410 West 18th St., and Building located at 304
West 6th St.
4. Zone Case No. 621. Ordinance No. 94-3003. An Ordinance amending the zoning
map of the city of Plainview, Texas to rezone property located at 302, 304 and 306 SE
4th Street from an R-2, Residential-2 Zoning District to an SF-A, Single-Family-Attached
Zoning District; Cumulativeness clause; Conflicts clause; Severability clause; and Effective
Date. Director for Community Development presented the zoning case which was tabled
from the previous meeting. Mrs. London said the Planning and Zoning Commission
approved the request unanimously. Caprock Community Action has requested a change
in the zoning ordinance so as to construct a tri-plex at 306 S.E. 4th Street. Alton Painter
spoke for Caprock Community Action stating they had received a housing grant from the
State to assist in alleviating the rental housing shortage in Plainview. These will be Iow
to moderate income rentals.
A. Public Hearing - Councilmember Barbara Dorman made a motion to hold
a Public Hearing; Dwain Dodson seconded the motion; the motion carried unanimously
among the six councilmembers present. Alton Painter spoke for the zoning change stating
Plainview needed good rental property and this would help that situation and be an
improvement for the area. No on spoke against it. Councilmember Alton Jackson Sr.
made the motion to close the public hearing; Mike Hutcherson seconded the motion; the
motion carried unanimously.
B. Council Action Barbara Dorman moved Ordinance No. 94-3003 be
approved as presented; Rey Rosas seconded the motion; the motion carried
unanimously.
5. Water Conservation - Ordinance No. 94-3002. An Ordinance adopting a City of
Plainview Water Conservation and Drought Contingency Plan; Penalties clause;
Cumulativeness clause; Severability clause; Conflicts clause; and Effective Date.
City Manager Jim Jeffers reviewed the ordinance, stating this would be first of two
public hearings regarding the water conservation ordinance. He said Freese & Nichols,
Inc., an engineering firm from Fort Worth did a water study for the City of Plainview. He
said the study was partly funded by a grant from the Texas Water Development Board
and there were certain requirements tied to the grant funds. The city will be required to
file annual reports on the progress of all the requirements. The TWDB requires the city
to inform and educate the community on the need to conserve water and the need to
have a plan in place should drought occur. In the event of water shortage the proposed
ordinance provides for water rationing should an emergency occur. The ordinance gives
the city the power to enforce such rationing. The ordinance also provides for a penalty.
In the future the city may go to a non-declining rate structure where the more water an
entity uses, the higher the water bill. The city will continue to meter all water usage and

determine where, if any, water used escapes metering. Dwain Dodson made a motion to
call a Public Hearing; Alton Jackson Sr. seconded the motion; the motion carried
unanimously among the six councilmembers present. No one spoke for or against the
ordinance. Alton Jackson Sr. moved to close the Public Hearing; Barbara Dorman
seconded the motion; the motion passed unanimously. The second Public Hearing will
be held on July 26, 1994.
6. Zoning,- Special Event Permits - Ordinance No. 94-2998. An Ordinance of the
City of Plainview, Texas amending Section 34 of the Plainview Zoning Ordinance to
provide for rules and regulations governing the issuance of Special Event Permits;
Severability clause; Cumulativeness clause; Conflicts clause; and Effective Date.
City Manager Jim Jeffers reviewed the proposed ordinance explaining it governed
permits for carnivals, circuseS and other temporary outdoor recreational events. The
ordinance restricts events to a five day period in the city; events must meet health and
safety standards; and are required to pay fees, permits and deposits. Events can be
fined for violations. The need for this type ordinance has been noted in years past as
problems seem to increase in direct proportion to the length of time such an event is
allowed to operate.
A. Public Hearing - Dwain Dodson moved to call a Public Hearing; Mike
Hutcherson seconded the motion; the motion carried unanimously. No one spoke for or
against the ordinance. Barbara Dorman made a motion to close the Public Hearing; Mike
Hutcherson seconded the motion; the motion carried unanimously. The second Public
Hearing will be held on July 26, 1994.
7. Housing - Announcing receipt of rehabilitation funds from the Texas Department
of Housing and Community Affairs. Director for Community Development reported the
City of Plainview has received $208,000 in funds to be used for rehabilitation of owner
occupied housing. There are certain requirements that must be met, by the homeowner
as well as the structure. Many of the homes that will be taken care of are the ones that
were not improved with the last housing rehab grant. Approximately $16,000 per home
will be used for heating, windows, doors, floors, plumbing, etc. The repairs will be done
on a bid basis and city inspection fees will be included in the contractors bids.
8. Texas Department of Transportation - Consider establishing priorities for city
wide highway department projects by the Texas Department of Transportation for Public
Hearing later this month. Mr. Jeffers reported the requests for projects needing attention
as soon as practicable were: Making SW 3rd a through street to FM 400; Continue
beautification efforts along Business 1-27; Implement landscaping along overpass areas
along 1-27;and to make final overlay on Quincy St. Mr. Jeffers stated the Public Hearing
by the State will be held on July 26, 1994, at the Chamber of Commerce office.
9. Adjournment - Barbara Dorman moved the meeting adjourn; Mike Hutcherson
seconded the motion; the motion carried unanimously among the six councilmembers
present. The meeting adjourned at 8:30 p.m.
