CITY COUNCIL MEETING
City of Plainview
July 26, 1994
The City Council of the City of Plainview met in a regularly schedule meeting on
July 26, 1994, in the Council Chambers of the Plainview City Hall at 901
Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor Lloyd C. Woods
presided. Councilmembers present were: Alton Jackson Sr. - Precinct 1, Mary
Virginia Kirchhoff - Precinct 2, Rey Rosas - Precinct 3, Barbara Dorman - Precinct
5, Dwain Dodson - Precinct 6, and Irene Favila - Precinct 7. Absent was Mike
Hutcherson - Precinct 4.
Staff members present were: James P. Jeffers - City Manager, Wally Hatch - City
Attorney, Terry Powers- Director of Human Resources, Bruce Watson - Fire Chief,
Roland Asebedo - Assistant Fire Chief, Norman Huggins - Director of Finance, Roy
L. Osborne - Director of Public Safety, John Berry - Assistant Director of Public
Works, and Karen McBeth - City Secretary.
News media present: Danny Andrews - Plainview Daily Herald, Pete Strom - Cable
TV, and Randy Ballinger - KKYN.
OPEN MEETING
1. Invocation - Barbara Dorman
2. Recognitions/Oath of Office - Jerry Allen was sworn to the Minimum
Housing Standards Board. Mayor Lloyd Woods presented Mr. Mays Osborne with
a Certificate of Appreciation and a key to the city for his many years of public
service to the city.
3. Consent Calendar - Dwain Dodson made the motion to approve the items
on the Consent Calendar; Barbara Dorman seconded the motion; the motion
carried unanimously among the six councilmembers present.

Board, Committee and Commission Appointments: Glenn Bickel
was appointed to the Canadian River Municipal Water Authority Board;

Bernard Vering was appointed to the Building Code/Fire Code Board

Bids - Water Department - Consider award of bid for backhoe for
water department. A bid was received from West Texas Cat in the
amount of $51,807.00; No other bids were received. The bid was
awarded to West Texas Cat.

Bids - Sanitation Department - Consider award of bid for sideload
refuse packer body. Bids were received from Davis Truck & Equipment
for a Pak Mor packer body in the amount of $32,740.00 and
Southwestern Equipment Company for an Impact packer body in the
amount of $33,653.00. The bid was awarded to Davis Truck &
Equipment Company for $32,740.00.
REGULAR AGENDA ITEMS
4. Water Conservation - Ordinance No. 94-3002. An Ordinance adopting a
City of Plainview Water Conservation and Drought Contingency Plan; Penalties
clause; Cumulativeness clause; Severability clause; Conflicts clause; and Effective
Date. Mr. Jeffers reviewed the ordinance stating the recent water study was
partially funded by the Texas Water Development Board, and one of the
requirements of their partial funding of the project was the City adopt a water
conservation plan. At the present time there is no immediate need but the
ordinances legally puts into place the mechanism to implement certain plans to
conserve water. The TWDB requires the City to report annually on the
implementation and effectiveness of its efforts to conserve water. One suggestion
being studied is an ascending rate scale for water consumption; another is limiting
the size of water meters. The passing of this ordinance will be the City's first step
in meeting the requirements of the Water Development Board.
A. Public Hearing - Alton Jackson Sr. made a motion to call a Public
Hearing; Rey Rosas seconded the motion; the motion carried unanimously. Mayor
Woods asked those wishing to speak to do so at this time. B. R. McGehee, 1309
Zephyr, asked what the present per capita rate water consumption was annually
within the city. Mr. Jeffers stated this information, along with much more, was in
the Water Study and Mr. McGehee could come to his office and he would be
happy to supply any information he could. Mayor Woods asked those wishing to
speak against the ordinance to come forward. No one spoke against the
ordinance. Keith Billington, Grandview St., asked if the ordinance gave away the
City's control over its water and water usage, also. what would happen to city water
rates. Mr. Jeffers explained the city has control over its water now and the

ordinance does nothing to change that; in fact the ordinance gives the city specific
ways to control water usage. Mr. Jeffers stated however the Texas Natural
Resource Conservation Commission, a state agency run amuck, along with federal
agencies are creating mandates which are costly and limiting to municipalities. Mr.
Jeffers suggested every citizen contact his/her representatives on a state and
national level and let them know that cities do not need any more mandates. Alton
Jackson made a motion to close the Public Hearing; Rey Rosas seconded the
motion; the motion passed unanimously. Mayor Woods declared the Public Hearing
closed.
B. Council Action The Council discussed the need for adopting a
conservation measure that gives the city the power to control water usage during
time of drought. Dwain Dodson stated he hopes the city can keep the state and
federal government out of its business as long, and as much, as possible. Barbara
Dorman made the motion to adopt Ordinance No. 94-3002; Dwain Dodson
seconded the motion; the motion carried unanimously.
5. Zoning - Special Event Permits - Ordinance No. 94-2998. An Ordinance
of the City of Plainview, Texas, amending Section 34 of the Plainview Zoning
Ordinance to provide for rules and regulations governing the issuance of Special
Event Permits; Severability clause; Cumulativeness clause; Conflicts clause; and
Effective Date. Mr. Jeffers reviewed the ordinance, stating it was the second
reading of the ordinance, and was proposed to restrict the amount of time certain
outdoor amusements could operate within the city. Such amusements commonly
known as carnivals have in the passed used Plainview as a "training ground." The
ordinance restricts the time spent in town to five days, including set up time and
take down time. The application fee in the ordinance is the only new fee imposed
and the $500 water deposit is to cover the cost of the water meter, should the
amusement company damage it or take it with them.
A. Public Hearing - Dwain Dodson made a motion to call a public hearing;
Alton Jackson Sr. seconded the motion; the motion carried unanimously. Mayor
Woods declared the Public Hearing open for public comment and asked those
speaking for the ordinance to speak at this time; no one spoke. Mayor Woods
asked those speaking against the ordinance to speak. Cliff Hartley stated he was
not speaking against it, only asking if this applied to permanent outdoor
amusement parks, such as the one he owned. Mayor Woods answered no, this
ordinance was aimed at temporary outdoor amusements which traveled the
country, such as circuses and carnivals. Alton Jackson made a motion to close
the public hearing; Barbara Dorman seconded the motion; the motion carried
unanimously. Mayor Woods declared the Public Hearing closed.
B. Council Action - Barbara Dorman moved Ordinance No. 94-2998 be
approved as presented; Dwain Dodson seconded the motion; the motion carried

6. Budget Amendment - Graffiti/Crime Stoppers - Ordinance No. 94-2999.
An Ordinance of the City of Plainview amending Ordinance No. 93-2975, to amend
the budget to provide vandalism reward funds in the 1993-94 Budget. City
Manager Jim Jeffem explained this ordinance allowed the city to fUnd a reward, up
to $1,000, to person or persons who divulge information leading to: the arrest and
conviction of individuals defacing property by graffiti. This money is in addition to,
and secondary to, any reward offered by Crime Stoppers.
A. Public Hearing - Dwain Dodson moved to call a Public Hearing; Rey
Rosas seconded the~ motion; the motion passed unanimously. Mayor Woods
declared the hearing open to the public and asked those speaking for the
ordinance to come forward at this time. Judy Hartley, representing Crime
Stoppers, spoke stating-the organization appreciated the Council's help and
cooperation. No one spoke against the ordinance. Alton Jackson Sr. moved to
close the public hearing; Barbara Dorman seconded the motion; the motion passed
unanimously.
B. Council Action - Dwain Dodson made the motion the ordinance be
approved; Rey Rosas seconded the motion; the motion carried unanimously.
7. Plainview/Hale County Health DePartment - South Plains *Health
Provider. Consider authorizing the City of Plainview to request a committee be
formed to study the merging of Plainview/Hale County Health Department and. the
South Plains Health Provider Organization. City Manager Jim Jeffers stated the
Plainview/Hale County Health Department was one of the most excellent
departments in the State. He stated that South Plains Health Provider
Organization also does a very good job. He stated that it has been proposed, and
the Council has the opportunity to consider, asking the Health Department to do
· a feasibility study as to whether or not these two entities might be merged. The
purpose of the study would be to ascertain if a more efficient and more effective
union would be the result. The study would be conducted by a committee
consisting of two persons from the City; two persons, from the County; two persons
from the Health Department; two persons from South Plains Health Provider; and
two persons from the Texas Department of Health, possibly Dr. Steven Morgan.
Mr. Jeffers emphasized this was not a mandate from the Council. There is no
timetable for this study. The only action the Council will be taking at this time is
to request the committee be formed to study the feasibility of such a merger.
Barbara Dorman made a motion the Council request such a committee be formed;
Alton Jackson Sr. seconded the motion; the motion carried unanimously.
8. Retirement - Consider request from the Plainview Firemen's Relief and

Retirement Fund for increased funding. City Manager Jeffers explained that at the
present time there is a two point discrepancy between what the City pays into the
Texas Municipal Retirement System and Social Security for all other city
employees, and what it pays into the Plainview Firemen's Relief and Retirement
Fund. He reported that the firemen do not participate in the Social Security
system, but rather they have their own retirement fund and it is self administered.
He stated that the firemen were asking the City to participate in their retirement at
the same rate they participate in all the other employees. He stated this would
amount to approximately $18,000 annually. Dwain Dodson made a motion the City
increase its amount given to the Firemen's Relief and Retirement Fund by two
percent; Rey Rosas seconded the motion; the motion passed by unanimous vote.
9. Surplus Property - Consider setting a minimum bid price for property
located at 600 E. 6th, currently occupied by Regional Youth Associates and for
property located at 304 W. 6th Street, currently occupied by Bank of America. Mr.
Jeffers stated these two properties have been declared surplus by the Council, and
these properties have been appraised. He said the property could not be sold for
less than their appraised value, and the cost of the appraisals could be added to
their selling price. He asked the Council to determine the minimum amount the
City would accept as a bid. Dwain Dodson made a motion to set the minimum bid
price on the property at 304 West 6th Street at $285,000; Alton Jackson Sr.
seconded the motion. Alton Jackson Sr., Rey Rosas, Dwain Dodson and Irene
Favila voted in favor of the motion. Barbara Dorman and Mary Virginia Kirchhoff
voted against it. Mike Hutcherson was absent. The motion carried. Dwain Dodson
moved that $10,000 be the minimum bid price on the property located at 300 East
6th Street; Barbara Dorman seconded the motion; the motion carried unanimously
among the six councilmembers present.
10. Adjournment - Barbara Dorman moved the meeting adjourn; Rey Rosas
seconded the motion; the motion carried unanimously. Mayor Woods declared the
meeting adjourned at 8:45 p.m.
