HomeMy WebLinkAbout94 0927 min MINUTES CITY COUNCIL MEETING City of Plainview September 27, 1994 The Plainview City Council held a meeting at 7:30 p.m., Tuesday, September 27, 1994, in the Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson Sr. - Precinct 1, Mary Virginia Kirchhof- Precinct 2, Rey Rosas - Precinct 3, Mike Hutcherson - Precinct 4, Barbara Dorman - Precinct 5, Dwain Dodson - Precinct 6, and Irene Favila - Precinct 7. Staff members present were: James P. Jeffers - City Manager, Wally Hatch - City Attorney, Norman Huggins - Director of Finance, Muff London - Director for Community Development, Barbara Sullivan - Municipal Court Judge, John Berry - Assistant Director of Public Work's, and Karen McBeth - City Secretary. News media present were: Richard Orr - Plainview Daily Herald, Randy Ballinger - KKYN, and Cathy Frye - Lubbock Avalanche Journal. OPEN MEETING 1. Invocation - Alton Jackson Sr. 2. Recognitions/Oath of Office - Fire Chief Bruce Watson presented Brad Herrington with his 10 year employment pin. 3. Consent Calendar - Barbara Dorman made a motion to approved Consent Calendar as presented; Dwain Dodson seconded the motion; the motion carried unanimously. a) b) c) Minutes were approved. Departmental Reports were approved. Expenditures were approved. d) Board, Committee and Commission Appointments. Consider appointments to the Board of Electrical Examiners. No appointments were made. e) Energas - Conflict of Interest. Declaration of Conflict of Interest with the anticipated Energas Rate Case by Councilmember Irene Favila. Document signed and accepted. f) Insurance - Life. Resolution R94-119. A Resolution of the City Council 1 of 4q of the City of Plainview, establishing the City of Plainview Employee Life Self Insured Fund. Resolution was approved. g) Landfill Farm. Consider authorizing the City Manager to enter an agreement for operation of the farm property associated with the City of Plainview sanitary landfill. City Manager was authorized to enter such agreement. h) Property Acquisition. 1402 Walter Griffin St. Consider authorizing the City to acquire full title from the County and Plainview Independent School District to the property located at 1402 Walter Griffin St. and use it as a community center in conjunction with the Givens Park. Tabled. Emergency Medical Services - Medical Control. Consider selecting "Medical Control" for the City of Plainview Emergency Medical Services. South Plains Emergency Medical Services was selected. J) Reciprocal Governmental Agreement between Hale County and the City of Plainview. Consider authorizing the Mayor to execute agreement. Mayor was so authorized. k) Delinquent Tax Property. Consider declaring certain properties as surplus and offer for sale. Properties were declared surplus and staff will proceed with offer for sale. I) Hotel/Motel Tax. Consider sending reminders to all Hotels and Motels, making them aware of their responsibilities under State law and reminding them audits may be requested. Staff authorized to proceed with reminders. m) Director of Public Safety. Ordinance No. 94-3018. An Ordinance of the City of Plainview, Texas, repealing Section 10-6 of the City of Plainview, Texas, Code of Ordinances entitled Office of Director of Public Safety; Assigning Director of Public Safety duties and responsibilities to the Police Chief; And establishing an effective date. Ordinance passed and approved. n) Recycling - Blue Box. Consider discontinuing one of the "Pilot" routes. Staff authorized to discontinue one "pilot" route. REGULAR AGENDA Audit 1992-1993. 1. Presentation by McMillan, McMillan, Moseley and Riddle. 2 of 4 Kevin Moseley of McMillan, McMillan, Moseley and Riddle, CPA firm, briefly reviewed the 1992-1993 audit of the City of Plainview. A copy of the audit has been given to the Mayor, City Council, and is on file with the City Manager. 2. Public Comment -Mayor Woods asked for public comment; there was no public comment regarding the audit. 3. Council Action - Dwain Dodson made a motion to accept the audit as presented; Mike Hutcherson seconded the motion; the motion passed unanimously. 5. Budget - 1994-1995. Mayor Woods briefly reviewed the budget stating it is $467,083.00 less than last years budget. He stated the staff and council had worked many hours preparing it he believed the citizens of Plainview will be well served with this budget. He said he was proud of the council's decision to lower the tax rate by five cents. A. Public Comment Danny Andrews, Presidenl of the Chamber of Commerce spoke stating that the Chamber was very appreciative of the Hotel/Motel tax it receives from the city which enables it to work. He thanked the council for its its cooperation and support. Bill Hardage, Chairman of the Visitor and Tourism Committee of the Chamber of Commerce stated his committee promotes Plainview and does so with the help of the Hotel/Motel tax, which brought 65,000 people to Plainview last year as a visitor or tourist. He thank the council for its help and cooperation and encouraged the council to continue its interest and support. B. Budget Adoption. Ordinance No. 94-3019. An Ordinance of the City of Plainview, Texas, adopting and approving the Budget for the fiscal year beginning October 1, 1994 and ending September 30, 1995, and making appropriations for each department, project and account. Dwain Dodson made a motion to adopt Ordinance No. 94-3019; Rey Rosas seconded the motion; the motion passed by unanimous vote. C. Tax Rate - Ordinance No. 94-3020. An Ordinance of the City of Plainview, Texas, levying municipal ad valorem taxes for the City of Plainview, Texas, for the year 1994 and directing the assessment and collection thereof; Severability clause; Cumulativeness clause; Conflicts clause; And effective date. Irene Favila moved to adopt Ordinance No. 94-3020; Dwain Dodson seconded the motion; the motion carried unanimously. Councilmember Alton Jackson Sr. left the meeting at 7:50 p.m. 6. Building Fee Collection and Permit Process Changes - Ordinance No. 94-3015. Second Reading. An Ordinance of the City of Plainview, Texas, amending the City of Plainview Electrical Code, Ordinance No. 84-2550, Section 5.2, 5.3, and 5.4 and the City of Plainview Plumbing Code, Ordinance No. 85-2587, Section 9.2; Changing the process of application of permits for electrical, plumbing and general construction; Cumulativeness 3 of 4 clause; Conflicts clause; Severability clause; Conflicts clause; Effective date. After a brief review of this ordinance Barbara Dorman moved Ordinance No. 94-3015 be approved; Mike Hutchemon seconded the motion; the motion passed by unanimous vote. 7. Building Code Amendment - Windows - Ordinance No. 94-3013. Second Reading. An Ordinance of the City of Plainview, Texas, amending Section 6-17, of the Plainview Code of Ordinances, to provide for an amendment to Chapter 12 of the Uniform Building Code; Severability clause; Cumulativeness clause; Conflict clause; Effective Date. Following a brief review of this ordinance, Dwain Dodson moved that Ordinance 94- 3013 be approved; Irene Favila seconded the motion; the motion carried unanimously. 8. Plainview/Hale County Industrial Foundation - Consideration of a contract for services. Rollie Hyde, President of the Plainview/Hale County Industrial Foundation, addressed the council stating the foundation has had a most productive year. He said Plainview has grown by 852 jobs and feels certain the job market will continue to grow. He said the foundation has 325 members and with the planned membership drive scheduled for November 16-17, 1994, he feels sure it will grow also. He reported that over 2,000 people commute to Plainview to work and hopes more housing can be built so these people can move into Plainview. He thanked the council for the $30,000 it provided the foundation last year and hopes they will be able to provide the $25,000 they have requested this year. Barbara Dorman made a motion that the City of Plainview enter into a contractual agreement for services with the Plainview/Hale County Industrial Foundation in the amount of $25,000 for those services; Dwain Dodson seconded the motion; the motion carried unanimously.
