CITY COUNCIL MEETING
City of Plainview
FEBRUARY 14, 1995
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, February 14, 1995 in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-
Session at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton
Jackson Sr.-Precinct 1, Mary Virginia Kirchhoff-Precinct 2, Rey Rosas-Precinct 3, Mike
Hutcherson-Precinct 4, Barbara Dorman-Precinct 5, Dwain Dodson-Precinct 6, and Irene Favila-
Precinct 7.
Staff members present were: James P. Jeffers-City Manager, Muff London-Director for
Community Development, Wally Hatch-City Attorney, Roy L. Osborne-Chief of Police, Bruce
Watson-Fire Chief, Barbara Sullivan-Municipal Court Judge, Dale Simpson-Civil Service
Director, John Castro-Health Department Director and Karen McBeth-City Secretary.
Media present was: Richard Orr-Plainview Daily Herald and Wayland Baptist University.
OPEN MEETING
1. Invocation - Mary Virginia Kirchhoff
2. Recognitions/Oath of Office - There were none.
3. Consent Calendar - Barbara Dorman made a motion to approve the Consent Calendar
as presented; Irene Favila seconded the motion; the motion carried unanimously.

Departmental Reports were accepted.
Expenditures were approved.
d) Board, Committee and Commission Appointments: Human Relations
Commission - Alicia Gallegos, Rosa Zuniga and Doris Washington were reappointed.
Building Code/Fire Code Board of Appeals - Alfred Alcala was appointed. Larry
Dickerson and Rafel Lopez Jr. were appointed to the Plainview Housing Authority. Jose
Angel Valenzuela was appointed to the Plumbing Board.
e) Surplus Property Sale. Ordinance No. 95-3032. First Reading. An Ordinance of
the City of Plainview, Texas, amending Section 2-151, entitled Advertisement for Bids
of the City of Plainview, Texas, Code of Ordinances.
f) Animal Control · Rabies Control. Ordinance No. 95-3034. First Reading. An
Ordinance of the City of Plainview, Texas, creating Section 5-137 of the Plainview Code

of Ordinances to adopt Chapter 826 of the Texas Health and Safety Code; Severability
Clause; Cumulativeness Clause; And Effective Date.
g) Recycling Grant - Resolution No. R95-106. A Resolution of the City of
Plainview, Hale County, Texas to affirm to the Texas Natural Resource Conservation
Commission its support of the programs identified in a proposal for funding of the
Recycle Grant, Resolution was approved and adopted.
REGULAR AGENDA ITEMS
4. Texas Department of Criminal Justice - Naming Unit. Resolution No. R95-105. A
Resolution of the City of Plainview, Texas approving the name of a prison unit facility within
Hale County, Texas the Marshall Formby Unit of the Texas Department of Criminal Justice.
Barbara Dorman made a motion to approve Resolution No. R95-105; Dwain Dodson seconded
the motion. The motion carried unanimously.
5. Animal Control. Consider a request from a citizen to place restrictions on cats running
at large. Mike Johnson, who resides at 703 E1 Paso, addressed the Council regarding the
unrestrained growth of the cat population in Plainview and the fact the cats are allowed to roam
indiscriminately. He stated all pet owners should be responsible for their animals and since dogs
are not allowed to run free according to the animal control ordinance which is enforced. He
stated he did not understand why dogs are not allowed to roam at will, but cats are allowed to
run free, disturb people and damage property. Mr. Johnson requested the Council consider
some type of containment law for cats and to make cat owners responsible for the damage and
aggravation they cause. He suggested the fines charged owners be raised when their cat was
picked up after the first time. He suggested raising the second offense to at least $50, and
maybe $100 for the third time the cat is picked up. He also suggested the boarding fee be raised
to $10 per day. He thanked the Mayor and Council for allowing him to speak.
The Council thanked Mr. Johnson for taking time to come and discuss his concern with them.
Mr. Dodson suggested Mr. Johnson sprinkle his flower beds with cayenne pepper, this is a
known deterrent to cats, but he realized there is no easy solution to this problem due to the
innate nature of cats. Mayor Woods said everyone could certainly sympathize with Mr. Johnson
and he asked John Castro, Animal Control Director, if he thought a containment ordinance was
enforceable. Mr. Castro stated that his animal control officers have repeatedly stated there is
no way to "catch" a cat, unless it wants to come to you voluntarily. Mr. Castro said there are
"cat traps" available to people who have a problem with cats on their property and advised
people to call and request the use of these to catch cats running loose. Mrs. Dorman said people
should be educated to having their animals spayed or neutered so as to cut down on the stray cat
population. Rey Rosas said the Council should consider raising fines on all animals that are
picked up, beginning with the second offense.
6. Zoning Ordinance Amendment - Area, Set Back, Height, Coverage and Density
Regulations. Ordinance No. 95-3033. An Ordinance amending the Zoning Ordinance No. 89-

2798, providing for an amendment to Section 32:1(1), area, set back, height, coverage and
density regulations; Cumulativeness clause; Conflicts clause; Severability clause; And effective
date. Muff London, Director for Community Development, reviewed the proposed ordinance
explaining it allowed less stringent rules for duplex housing. She said Planning and Zoning had
unanimously recommended approval of the ordinance.
A. Public Hearing - No one spoke for or against the ordinance.
B. Council Action - Mike Hutcherson moved to adopt Ordinance No. 95-3033; Rey
Rosas seconded the motion; the motion passed unanimously.
7. Adjournment - Mayor Woods adjourned the meeting at 7:50 p.m.
