CITY COUNCIL MEETING
City of Plainview
May 23, 1995
The Plainview City Council met at 7:30 p.m., Tuesday, May 23, 1995, in the Council
Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00
p.m. Mayor Lloyd Woods presided. Councilmembers present were: Alton Jackson-Precinct 1,
Mary Virginia Kirchhof-Precinct 2, Rey Rosas-Precinct 3, Mike Hutcherson-Precinct 4, Barbara
Dorman-Precinct 5, Dwain Dodson-Precinct 6, and Irene Favila-Precinct 7.
Staff members present were: James P. Jeffers-City Manager, Muff London-Director of
Community Development, Ches Carthel-Director of Public Works, Wally Hatch-City Attorney,
Carl Holland-Support Services Superintendent, Roland Asebedo-Asst. Fire Chief, Norman
Huggins-Director of Finance and Karen McBeth-City Secretary.

OPEN MEETING
1. Invocation - Mary Virginia Kirchhoff
2. Recognitions/Oath of Office - Ches Carthel presented Carl Holland with a plaque from
the National Youth Sports Coaches Association for his contribution to the youth of Plainview
and the baseball program. The Plainview Optimist Club was awarded a plaque for their club
and their coaches as the Most Productive New Chapter in the State of Texas.
The City Secretary administered the Oath of Office to the members of the Parks Advisory
Commission. Those members were: Lucile Davis, Ruby Ann Riggins, Wanda Tyler, David
Wilder, Pat Smith, Barbara Kiser, and Minerva Salas.
3. Consent Calendar - Barbara Dorman made the motion to approve the Consent Calendar
as presented, with the exception of item (f) which is to be tabled; Mike Hutcherson seconded
the motion; the motion carried unanimously.

Plumbing - Chapter 20. Ordinance No. 95-3045. Second and Final Reading.
An Ordinance of the City of Plainview, Hale County, Texas, amending the Code
of Ordinances, Chapter 20, Sections 20 and 22.5; Providing uses for T&P valve
drain, schedule 40 (cellular core), unvented heaters, and single wall metal vent
connectors; Cumulativeness clause; Conflicts clause; Severability clause; And
effective date. The ordinance was approved.
Budget Amendment - Wastewater - Milwee Lift Station. Ordinance No. 95-
3042. An Ordinance amending Ordinance No. 34-3019, to appropriate funds in
the 1994-1995 Budget for wastewater plant repair of the Milwee wastewater lift
station. Second and Final Reading. This item was tabled.
Building Permit Fees - Motivation, Education and Training, Inc. - Ordinance
No. 95-3047. An Ordinance of the City of Plainview, Hale County, Texas,
waiving the permit fees established in Chapter 6, Article 1, of the Code of
Ordinances, No. 94-2995; Regarding Building permit fees for the 1995 Farmers
Home Housing Preservation Program administered by Motivation, Education and
Training; Cumulativeness clause; Conflicts clause; Effective date. First Reading.
Approved for first reading.
REGULAR AGENDA ITEMS
4. Plat. Consider approval of Watergate Subdivision, Unit No. 3, Combination Plat. Ches
Carthel, Director of Public Works, displayed an overhead of the subdivision and reviewed it for
the Council. He explained this is where the Bethel Baptist Church plans to build. The plat was
reviewed and approved by the Planning and Zoning Commission with the following conditions:
1. Requirement of an alley width of 25 feet from 16th St. to 18th St.
2. Acceptance of the following variances: a) Alley paving requirements with the
provision that the alley will be paved if the property is used for any other commercial
purpose other than a church; and (b) nonconforming lot size.
3. Payment of connection charges.
4. Payment of filing fees, and
5. Installation of a fire hydrant at the intersection of W. 18th,St. and 1-27 access
road.
Mr. Carthel said City staff agreed with these stipulations and his recommendation was that the
plat be approved subject to the same conditions. Dwain Dodson made a motion that Watergate
Subdivision Unit No. 3, Combination Plat be approved subject to the stated conditions; Irene
Favila seconded the motion. The motion passed unanimously.

5. Sanitation - Household Hazardous Waste. Resolution No. R95-112. A Resolution of
the City of Plainview, Hale County, Texas, to affirm to the Texas Natural Resource
Conservation Commission our support of the programs identified in this proposal for the funding
of the Household Hazardous Waste grant. Ches Carthel, Director of Public Works, told the
Council that the proposed resolution was part of an application to TNRCC for money to develop
and implement a program to collect, recycle and document certain hazardous household waste
products. This is another step in the ongoing process of keeping some things out of the landfill
that might prove to be a problem as other cells of the landfill are opened. The grant application
is for $98,000. The resolution states that the City is willing to abide by the conditions of the
grant. Barbara Dorman moved to approve the resolution. Dwain Dodson seconded the motion.
The Council approved the resolution unanimously.
6. Hotel/Motel Tax. Consider Professional Services Management Agreement for
Hotel/Motel Tax Revenue with Chamber of Commerce. Mayor Woods gave a brief history of
the Chamber of Commerce and Industrial Foundation and its funding with hotel/motel tax. He
reported that at the Council's annual Retreat some discussion was given to reviewing the contract
with the Chamber and possibly keeping a larger portion of the hotel/motel tax with the city.
Mike Fox, 808 Itasca, the current President of the-Plainview Chamber of Commerce, thanked
the Council for their support of the Chamber. He said they presently had 550 members, which
formed 28 committees. He said that while most people are asking for more money, the
Chamber is asking for a renewal of the agreement with less going to the Chamber and more
remaining with the City. The Chamber has proposed to accept 70% of the hotel/motel tax
revenue and leave 30 % for the City to use. He stated the Chamber would appreciate a term to
the agreement of seven years. This would give them a time frame in which to secure events
which would bring more people into Plainview, and possibly get some meetings and events to
repeat engagements.
Bill Hardage, 7206 Olton Road, Chairman of the Tourism & Convention Committee of the
Chamber of Commerce, addressed the Council stating his committee has studied how to best
utilize the motel/motel tax money. He said it was decided that existing events which the
Chamber had funded over and over, would now get one half the amount they did before. This
would encourage them to become self sufficient and leave more money to acquire new events.
So far none of the events have gone elsewhere because of this decision. He said once events
have been funded and they can monetarily support themselves, the Chamber no longer funds
them, such as the Queens Classic Basketball Tournament. The Chamber has also employed a
part time recruiter who has been to area cities recruiting events, conventions and meetings. He
reported that approximately 65,000 visitors came to Plainview this past year. He said the
Chamber is eager to add new interests to go along with the established events that take place
year after year. He explained that events that request funding go through an application process.
He said the Chamber has an application form which must be filled out, then the requesting party
makes a presentation, and then a group from the Chamber decides who is funded and in what
amount.

Mayor Woods thanked the Chamber of Commerce for the good job they do. He assured the
Chamber of the City's support. He asked the Council for comment.
Irene Favila said she supported the Chamber and agreed they do a good job. She said that about
twenty years ago there was a Mexican-American Chamber of Commerce with which she was
affiliated and when they had requested funds from the Chamber, they sometimes were turned
down without adequate explanation. She stated this troubles her because she wants to be sure the
Chamber is not unfair to Mexican-American groups. She said her primary concern was, she has
found the Chamber is not "user friendly."
Dwain Dodson said he has lived in Plainview since 1963 and has served on the Board of
Directors od the Chamber, been a Red Coat member, and he appreciates the Chamber very
much. He said the Chamber of Commerce is a non-political entity. He stated the Chamber does
a very good job and because of the Chamber and the Industrial Foundation, Plainview gets
things done better than most cities. He said it was very generous of the Chamber to offer the
30/70 percent agreement. He stated Plainview should continue to grow with this type of
volunteerism.
Barbara Dorman said she was a member of the Chamber of Commerce 23 years ago, and that
she has sat on the Hotel/Motel Tax Committee and she could not remember any legitimate group
being turned down. She said the Chamber looks very thoroughly into all groups requesting
money. She stated the Chamber and the Industrial Foundation have been good partners to the
City. She said she is proud of what the City has accomplished with this partnership and she
believes the Chamber spends the money wisely.
Mike Hutcherson said he believed the Chamber is doing a good job of bringing tourists and
conventions to the City and possibly some groups were turned away due to lack of funds. He
stated he felt the 30/70 split was good for both the Chamber and the City, and a seven year
contract gave the Chamber security in being able to make long range plans and commitments.
Rey Rosas stated he felt the split would be better at 50/50, and that would give the City more
money to build more facilities, such as a Community Center or Civic Center. He said he sees
a lot of people going to events in Lubbock and Amarillo. He said he felt like these events could
be brought to Plainview if there were a large enough place to accomodate the crowds. He said
he did not think the City had a good relationship with the Chamber. He said in 1989 the
Chamber turned down a request from him. He said he has brought concerts into Plainview and
he has never gotten the help he requested from the Chamber.
Mary Virginia Kirchhoff stated that she was the first woman ever to sit on the Executive Board
of the Chamber of Commerce in Plainview. She said the By-laws had to be changed so she
could do this, because the By-laws did not accomodate women. Mrs. Kirchhoff stated it took
many entities in a community to make it a success. She said the Chamber renders a great
service and she commended them on offering a good proposal.

Alton Jackson said he has studied all the different things the Chamber does. He said the
Chamber not only promotes Plainview and brings in interesting events, conventions and meetings
it also gives scholarships. He said he liked the idea of the City keeping a little more of the
hotel/motel tax money so it could do some things. The convention center at the Plainview
Country Club was a good investment. The Fa.ir Iheater renovation that is just getting off the
ground ....... ~§~a, ood~ idea, and it wilt need some money~,~, . He said that if someone has a problem
with the Chamber which cannot be resolved, they~Snight come to the City for funding.
The Mayor asked for public comment:
Irene Morales, 1011 W. llth St., said she wanted to know more abOut the scholarships the
Chamber offers.
Jim Ferrell, Executive Vice President of the Chamber of Commerce, said it gave a Raymond
Akin Scholarship each year to a graduating senior of a farm family. He said the other
scholarship they give is through the Plainview Education Partnership. He said Junior students
can sign up for this scholarship. They must have 95 % attendance recorded, an 80 grade average
and then go to Wayland Baptist University here in the City.
Bill Hardage spoke again, saying that he invites anyone to go through the application process
if they want funding for an event. He said he cannot speak for what happened in the past, but
he said everyone who goes through the application process for funds is treated fairly.
David Wilder, 300 Lometa, stated he has served on the Chamber of Commerce Board since
1973, and co-chaired the Tourism Committee in 1980. He said the Chamber has studied many
convention facilities, and in the 1980's a convention center did not get voted for. He said it was
possible for the funds to be saved for a multi-purpose center, but the price to build one was
astronomical, and the cost of maintaining and operating one was prohibitive. He said he did not
know of anyone who was ever turned down for funding simply because of who they were.
Dwain Dodson moved to enter a professional services agreement with the Chamber of
Commerce for a period of seven years, with the Chamber received 70 % of the hotel/motel tax
revenues received by the City, and the City retaining 30%; the effective date of the contract
being todays date, and the new contract term going into effect January 1, 1996; Barbara Dorman
seconded the motion. The Mayor asked the City Secretary to conduct a roll call vote. Alton
Jackson voted for the motion; Mary Virginia Kirchhoff voted for the motion; Rey Rosas voted
against the motion; Mike Hutcherson voted for the motion; Barbara Dorman voted for the
motion; Dwain Dodson voted for the motion; and Irene Favila voted against it. The motion
carried with five votes for and two against.
Mayor Woods reminded everyone that next Monday is Memorial Day and he invited all the
citizens of Plainview to attend the Memorial Day Ceremony at the big flag in Regional Park to
honor those who died in military service of the United States.

7. Adjournment. Mayor Woods adjourned the meeting at 8:30 p.m.
