CITY COUNCIL MEETING
City of Plainview
JUNE 13, 1995
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, June 13, 1995 in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session
at 7:00 p.m. Mayor Pro Tern Mary Virginia Kirchhoff presided. Councilmembers present were:
Alton Jackson Sr.-Precinct 1, Rey Rosas-Precinct 3, Barbara Dorman-Precinct 5, Dwain
Dodson-Precinct 6, and Irene Favila-Precinct 7. Absent were Lloyd Woods-Mayor, and Mike
Hutcherson-Precinct 4.
Staff members present were: Wally Hatch-City Attorney, Ches Carthel-Director of Public
Works, Muff London-Director for Community Development, Roy L. Osborne-Police Chief,
Roland Asebedo-Assistant Fire Chief, Barbara Sullivan-Municipal Court Judge, Norman
Huggins-Director of Finance and Karen McBeth-City Secretary.
News media present: Cathy Frye-Lubbock Avalanche Journal, Richard Orr-Plainview Daily
Herald, and Wayland Baptist University television crew.
OPEN MEETING
1. Invocation - Rey Rosas
2. Recognitions Roland Asebedo, Assistant Fire Chief, presented Certificates of
Recognition to two young men, Manuel and Daniel Pena, for their assisting a gentlemen who
had fallen while running in the 600 block of West 1 lth St. They positioned the unconscious man
so as to open an airway and then called 9-1-1. They knew enough to take all the proper
precautions, the reason this is so commendable is the fact they are only nine years old.
3. Consent Calendar - Barbara Dorman made the motion to table Item e, and approve the
remainder of the Consent Calendar; Alton Jackson seconded the motion; the motion was
approved by the six Councilmembers present.

Examiners. No appointments were made.

Budget Amendment - Ordinance No. 95-3042. Wastewater Milwee Lift Station
Repair. An Ordinance amending Ordinance No. 94-3019 to appropriate funds in
the 1994-1995 Budget for wastewater plant repair of the Milwee wastewater lift

station. Second and Final Reading. This item was tabled.
Building Permit Fees - Ordinance No. 95-3047. Motivation, Education and
Training Inc. An Ordinance of the City of Plainview, Hale County, Texas,
waiving the permit fees established in Chapter 6, Article 1, of the Code of
Ordinances, No. 94-2995; Regarding building permit fees for the 1995 Farmers
Home Administration Housing Preservation Program administered by Motivation,
Education and Training, Inc.; Cumulativeness clause; Effective date. Second and
Final Reading. Ordinance was approved and passed.

Sanitation - Recycling. Consider approval of placement of additional Blue Boxes
for the recycling program. Proposed placements were approved.

Junked Motor Vehicles - Ordinance No. 95-3048. An Ordinance of the City of
Plainview, Texas which provides for the amendment of Article II, Chapter 16,
Junk Motor Vehicles, to allow for more complete conformance with state statutes;
Severability clause; Cumulativeness clause; Conflicts clause; and Effective date.
First Reading. Approved for First Reading.
REGULAR AGENDA ITEMS
4. Texas Department of Criminal Justice. Consider authorizing City administration to
enter an agreement with the Texas Department of Criminal Justice for use of prisoners to
perform labor on City properties. Director of Public Works, Ches Carthel, explained that by
having the prison facility close to Plainview, the City can take advantage of the free labor
provided by inmates for labor intensive chores such as picking up litter, landscaping public
lands, picking up blowing trash at the landfill, cleaning drainage ways, and numerous other
chores benefiting the City. Warden Young at the prison facility is in -agreement with this
practice, which is used by numerous other municipalities throughout the State. The City will
only provide transportation for the inmates to and from the prison and work sites. The Criminal
Justice system will provide everything else needed, including guards. The worker/inmates will
be chosen very carefully by prison personnel. Dwain Dodson moved to authorize City
Administration to enter into such an agreement; Irene Favila seconded the motion; the motion
passed unanimously among the six Councilmembers present.
5. Railroad Crossing - Protection. Hear a report on railroad crossing hazards and consider
prioritizing those crossings for signalization. (First of two public comment periods) Lt. Michael
Carroll, reported there are 48 railroad track crossing within the City of Plainview. At the
present time the railroad companies are doing a lot of repair work on many of the crossings
which disrupts a smooth traffic flow. Of the 48 crossings, only four of them have the cross-
buck signs, blinking red lights and the crossing arm which lowers and raises as trains come and
go. There have been many requests for such markings at other crossings, mainly by the bowling
alley on Quincy and at 14th & Joliet. Lt. Carroll stated that the railroad company probably will
not put lites and crossing arms at either of these locations. Primarily because there have been

no accidents involving trains at these intersections.
Mayor Pro Tem Mary Kirchhoff thanked Lt. Carroll for his report. Mrs. Kirchhoff asked for
Public Comment. No one spoke regarding this issue. Barbara Dorman moved to accept Lt.
Carroll's report as presented; Dwain Dodson seconded the motion; the motion carried
unanimously.
6. Fireworks. Consider a request by U.S. Fireworks for a waiver to Section 78.102(b) of
the Uniform Fire Code, as adopted under Section 11-51 of the Plainview Code of Ordinances,
to allow said company to sell fireworks within the city limits on a one time basis for the July
4, 1995 season. City Attorney Wally Hatch reported that representatives of the U.S. Fireworks
company had called and requested this item be pulled from the agenda. Since they asked that
it be placed on the agenda, Mr. Hatch said the City had no problem with their asking for its
removal. Dwain Dodson moved that item 6 be removed from the Agenda; Rey Rosas seconded
the motion; the motion passed unanimously.
7. Adjournment. Mayor Pro Tern Kirchhoff adjourned the meeting at 8:05 p.m.
