CITY COUNCIL MEETING
City of Plainview
June 27, 1995
The Plainview City Council will held a meeting at 7:30 p.m., Tuesday, June 27, 1995, in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session
at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson
Sr.-Precinct 1, Mary Virginia Kirchhoff-Precinct 2, Rey Rosas-Precinct 3, Mike Hutcherson-
Precinct 4, Barbara Dorman-Precinct 5, Dwain Dodson-Precinct 6, and Irene Favila-Precinct 7.
Staff members present were: James P. Jeffers-City Manager, Dale Simpson-Civil Service
Director, Roy L. Osborne-Chief of Police, Barbara Sullivan-Municipal Court Judge, Norman
Huggins-Director of Finance, Roland Asebedo-Asst. Fire Chief, Muff London-Director of
Community Development, Wally Hatch-City Attorney, and Karen McBeth-City Secretary.
News media present: Richard Orr-Plainview Daily Herald, and Wayland Baptist~ University
television crew.
OPEN MEETING
1. Invocation - The Reverend Leonard Chatham - Following the invocation Rev. Chatham
spoke about concerns he has for families living in the Austin Heights area of Plainview. He said
his concerns should be the concerns of the entire City and especially of the City Council. He
stated he fears the likelihood of a stray bullet entering his home and injuring someone; he fears
for the safety of his wife outside their house; he stated people are afraid to come to church
because of illegal activity being conducted in close proximity to the church; and he said he
believe that when an offering is taken at his church often times individuals who are not
members, and with no intention of becoming members, and are chemically dependent, come in
so as to ascertain the amount of the offering. He stated he will be meeting with Councilmember
Alton Jackson Sr. and give him specifics to bring back to the Council and Police Chief. The
Council and Mayor Woods thanked Rev. Chatham for his information and for coming to the
Council with his concerns.
2. Recognitions - Mayor Woods presented Bobby Masters with a Certificate of Appreciation
for his service during the Viet Nam conflict and R.C. Hyde with a Certificate of Appreciation
for his service in World War II.
Mayor Woods also presented a plaque with words of appreciation to Barbara Dorman, Alton
Jackson Sr. and Dwain Dodson for their services as Mayor Pro Tem to the City of Plainview.
Municipal Court Judge Barbara Sullivan made an announcement regarding a ceremony scheduled
to honor all the veterans that have served in the Armed Forces to take place on July 4, 1995,
at 6:00 p.m. at the big flag in Regional Park. She said there will be a reception at the Rotary

Building at 5:00 p.m. honoring these veterans and at 10:00 p.m. on the 4th there will be a giant
fireworks display to celebrate the 4th of July. She invited everyone to come to Regional Park
and participate in these activities.
3. Consent Calendar - Barbara Dorman moved the Consent Calendar be approved as
presented; Mike Hutcherson seconded the motion and being put to a vote, carried unanimously.

Board, Committee and Commission Appointments. Board of Electrical
Examiners. No appointments were made.

Southwestern Public Service Company - Interruptible Service. Resolution No.
95-113. A Resolution of the City of Plainview, Texas, sitting in its regulatory
authority pursuant to the Public Utility Regulatory Act of 1995, S.B. 319, 74th
Legislature, R.S. 1995 CPURA 1995"), with regard to the electric tariffs for an
experimental industrial interruptible rate rider and experimental off-peak scheduled
interruptible service filed by Southwestern Public Service Company(Southwestern)
with the City of Plainview, Texas. The Resolution was approved.
Junked Motor Vehicles - Ordinance No. 95-3048. An Ordinance of the City of
Plainview, Texas which provides for the amendment of Article II, Chapter 16,
Junked Motor Vehicles, to allow for more complete conformance with state
statutes; Severability clause; Conflicts clause; and Effective date. Second and
Final Reading. Approved and adopted.
REGULAR AGENDA ITEMS
4. Plat - Plainview Capital, L.P. Consider the combination plat of Plainview Capital,
L.P., Plainview, Hale County, Texas. Director of Community Development Muff London
reviewed the plat as submitted for the Council stating, the plat is recommended for approval with
the following requirements: Approval of constructions plans; Acceptance of the delay in payment
of escrow funds for water, sewer, and paving improvements until the project is funded, and;
Acceptance of the delay in payment of connection charges until the project is funded.
Unanimous approval of the plat with the stipulations as presented by Ms. London, followed a
motion by Barbara Dorman and seconded by Dwain Dodson.
5. Plat - Plainview Manor. Consider the final plat of Plainview Manor, Plainview, Hale
County, Texas. Ms. London, Director of Community Development, presented the details of the
plat request stating the plat is recommended for approval with the following conditions:
Approval of constructions plans, and; Acceptance of the delay in payment of escrow funds for

water, sewer, and paving improvements until the project is funded.
Dwain Dodson moved the final plat of Plainview Manor be approved with the stipulations
detailed by staff; Mike Hutcherson seconded the motion; The motion was unanimously passed.
6. Plat - Exemption 2311 Quincy. Consider request for the property located at 2311
Quincy, which is located at 24th & Quincy and is over an acre, to be exempt from the City of
Plainview platting procedures. Ms. London explained that the property owners at 2311 Quincy
want to build a garage and since the property is over an acre in size any building at the site
would normally require the area to be platted. The property owners are not developing the area
in the normal sense of the word and simply want to build a garage for their personal use, and
the property is fully developed, therefore they request to be exempted from the platting
requirements. Planning and Zoning Commission approved their request, but did recommend the
property be surveyed prior to any building. After a short discussion, Dwain Dodson made a
motion to grant the homeowners request without a survey being required. Barbara Dorman
seconded the motion which was subsequently approved by unanimous consent.
7. Railroad Crossing - Protection. Second of two public comment periods regarding
railroad crossing hazards and consider prioritizing those crossing for signalization. Chief of
Police Roy Osborne gave a quick summary of the railroad crossings inside the City of Plainview
and the hazards presented at certain crossing due to the lack of signalization. No one made any
public comment. Dwain Dodson made a motion the report be accepted and sent to the railroad
companies so as to facilitate signalization at the crossings deemed most hazardous, even though
it may not be in the near future; Barbara Dorman seconded the motion which passed
unanimously.
8. Speed Zone - S.W. 3rd St. Ordinance No. 95-3049. An Ordinance of the City of
Plainview, Texas, amending Section 23-168 of the Code of Ordinances to establish a maximum
rate of speed for vehicles traveling eastbound and westbound on FM 3466 (S.W. 3rd Street);
Providing for a penalty; Cumulativeness clause; Conflicts clause; Severability clause; 'And
effective date. First Reading. Chief of Police Roy Osborne told the Council that the speed
zones along S.W. 3rd Street are set by the Texas Highway Department and not the City of
Plainview, and the City is adopting the ordinance so as to comply with State regulations. In
answer to questions by the Council, Chief Osborne stated the Highway Department has said,
"No" to the request for a signal light at S.W. 3rd and Ennis as a means of controlling traffic.
Barbara D0rman made a motion to approve this First Reading of Ordinance No. 95-3049; Mike
Hutcherson seconded the motion; the motion carried unanimously.
9. Consideration of City Council Policy Guidelines: City Manager Jim Jeffers related
the Council's numerous discussions about whether to formally adopt specific guidelines, and the
fact that such a policy is still being discussed.
A. Agenda Action Procedures - The proposed guideliness outline the specific
sequence of actions in passing an item on the Regular Agenda at Council meetings. Following
a discussion by the Council, Dwain Dodson moved that Item A - Agenda Actions Procedures

not be adopted; Barbara Dorman seconded the motion; the motion carried unanimously. B. Agenda Repeat Items - This item was not considered by the Council.
C. Council Relations Policy - This policy addresses the relations between the
mayor and council; council and staff; and council and media. The policy is only a guideline to
promote efficient and effective governing and effect favorable relations with the community.
Dwain Dodson moved to adopt the Council Relations Policy; Barbara Dorman seconded the
motion. The motion passed with Councilmembers Jackson, Kirchhoff, Hutcherson, Dorman and
Dodson voting for it and Councilmembers Rosas and Favila voting against it.
Mayor Woods appointed a Council Relations Committe comprised of Barbara Dorman, Irene
Favila and Alton Jackson.
At this time, Rey Rosas said he wished to recognize Manuel Botilla and other members of a
newly organized soccer team for Plainview. He said they will be playing area teams and invited
the public to attend the games. He said the name of the team is "Atlas."
10. Executive Session. Discussion of evaluation of a public officer or employee; Specifically
Municipal Court Judge. This meeting is authorized by [TEX. REV. CIV. STAT. Ann. art
6252-17, Section 2(e) (Vernon Supp. 1994)]. Dwain Dodson moved to convene in Executive
Session; Rey Rosas seconded the motion; the motion carded unanimously. The Council recessed
at 8:05 p.m.
11. Municipal Court Judge. Consider action per Executive Session. The Council reconvened
in regular session at 8:40 p.m. No action was taken.
12. Adjournment. Mary Virginia Kirchhoff moved the meeting adjourn; Mike Hutcherson
seconded the motion; the motion carried unanimously and Mayor Woods declared the meeting
adjourned 8:43 p.m.
