HomeMy WebLinkAboutR16-364370 RESOLUTION R16-364 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, APPROVING BILL WELLS CHEVROLET FOR A REFUND OF A PRO RATA SHARE DUE TO A FUTURE CONNECTION OF BRADLEY TEXAS REALTY, L.L.L.P. TO A WATER MAIN PREVIOUSLY COLLECTED ON THEIR BEHALF IN ACCORDANCE WITH THE CITY OF PLAINVIEW CODE OF ORDINANCES, CHAPTER 13, ARTICLE 13.03, WATER AND SEWER EXTENSIONS AND CONNECTIONS; AND THE PUBLIC PURPOSE SERVED IS TO ENCOURAGE AND PROMOTE ECONOMIC DEVELOPMENT WITHIN THE CITY OF PLAINVIEW, TEXAS. WHEREAS, when Bill Wells Chevrolet ("Bill Wells") developed the 1-27 Frontage Road water main extension for the La Mesa Addition, he paid the full cost for an eight inch (8") water line at a cost of Seventy -Six Thousand and No/100 Dollars ($76,000.00) for 1,075 feet of water line pipe; and WHEREAS, Bill Wells constructed an extension of a water main associated with the 1-27 Frontage Road from Southwest 3rd Street to the end of the Bill Wells property that is contiguous to the Bradley Texas Realty, L.L.L.P. property; and WHEREAS, Bradley Texas Realty, L.L.L.P. now desires to develop and connect to the water main that Bill Wells constructed; and WHEREAS, Bill Wells is entitled to a refund for his prorata share of the cost of the water main to whroh connection will be made in accordance with the City of Plainview Code of Ordinances, Chapter 13, Article 13.03, for the above -stated 1-27 Frontage Road improvements from the City of Plainview; and WHEREAS, the City Council of the City of Plainview, Texas finds it in the best interest for the citizens of Plainview that such pro rata costs be refunded to Bill Wells for the purpose of encouraging and promoting economic development. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Plainview, Texas that: In accordance with the City of Plainview Code of Ordinances, Chapter 13, Article 13.03, the City of Plainview collects extension costs for a water main from the current owner or developer, and upon future development, a proportionate amount is refunded to the owner or developer who initially defrayed the cost of developing such infrastructure when developed. Resolution R16-364 Pro Rata Refunds Page 1 of 3 In calculating such proportionate share of costs to be refunded to the initial owner or developer who paid the development costs for infrastructure when the 1-27 Frontage Road from Southwest 3rd Street to the end of the Bill Well's property was completed, the eight inch (8") water line is measured from Southwest 3rd Street to the end of Bradley Texas Realty, L.L.L.P.'s property, being three hundred fifty-five (355) feet. Using this footage and the amount per linear foot, which is Sixty -Four and 18/100 Dollars ($64.18) per linear foot, Bradley Texas Realty, L.L.L.P.'s proportionate share owed to the Bill Wells is Twenty-two Thousand Seven Hundred Eighty -Four and No/100 Dollars ($22,784.00). The intent of City of Plainview Code of Ordinances, Chapter 13, Article 13.03 is to provide an equitable charge for water and sanitary sewer connections. IV. The public purpose for such Resolution is to encourage and promote economic development within the City of Plainview, Texas. PASSED AND APPROVED this 14th day of June, 2016.
