CITY COUNCIL MEETING
City of Plainview
August 8, 1995
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, August 8, 1995, in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session
at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson-
Precinct 1, Mary Virginia Kirchhoff-Precinct 2, Rey Rosas-Precinct 3, Mike Hutcherson-
Precinct 4, Barbara Dorman-Precinct 5, Dwain Dodson-Precinct 6, and Irene Favila-Precinct 7.
Staff members present were: James P. Jeffers-City Manager, Wally Hatch-City Attorney, Muff
London-Director for Community Development, Ches Carthel-Director of Public Works, Roy
Osborne-Chief of Police, Barbara Sullivan-Municipal Court Judge, and Karen McBeth-City
Secretary.

OPEN MEETING
1. Invocation - Mike Hutcherson
2. Recognitions/Oath of Office - Mayor Woods presented Mr. Mitsuhiko Kubota, a young
man from Japan visiting Mr. and Mrs. David McDonald, a letter to take to the mayor of his city
and a packet of mementos from Plainview, Texas. Dwain Dodson presented a Proclamation,
to be signed by the entire Council and the Mayor, endorsing the Turn Around Plainview
program.
3. Consent Calendar - Irene Favila made a motion to approve the Consent Calendar as
presented; Mike Hutcherson seconded the motion; the motion carried unanimously.

d)
Boards, Commissions and Committees. West Texas Library System
representatives. Lucile Davis was appointed as representative to the West Texas
Library System, with Joy Denton as an alternate.
e)
TMRS · Military Service Credit. Ordinance No. 95-3051. An Ordinance of
the City of Plainview, Texas, allowing certain employees of the City, who
performed, or hereafter perform, active service in the Armed Forces (or their
Reserves or Auxiliaries) of the United States under honorable conditions, to apply
and make deposits for, and to receive special credit with the Texas Municipal

Retirement System for limited portions of such military service, and providing for
payment, by the City of Plainview, its share of the costs of allowing such credits.
First Reading. Approved for First Reading.
f) Plats:
1. Final Plat - La Mesa - From the northeast corner of Section 29, Block
JK-2, Plainview, Hale County, Texas. Approved, without exceptions.
2. Combination Plat - David Wilder - North part of Survey No. 34, Block
JK-2, Plainview, Hale County, Texas. Approved, without exceptions.
g) Police ® Travel. Seizure fund appropriation. Approved in the amount of $200.
REGULAR AGENDA ITEMS
4. Zoning. Ordinance No. 95-3052. An Ordinance of the City of Plainview, Hale County,
Texas, amending the use chart in Section 8.1 of the Plainview zoning ordinance to provide for
zoning of sexually oriented businesses; Severability clause; Cumulativeness clause; Conflicts
clause; Effective date. Director for Community Development Muff London reviewed the
proposed zoning change, explaining the ordinance restricted this type business to a C-3 and M-1
zoning district. It also stipulates how close it can be to a school, residence, hospital or
church. Dwain Dodson made a motion to approve the ordinance, with the amendment that they
can only be in an M-1 district. Barbara Dorman seconded the motion and also added the
amendment that such a business cannot be within 1,000 feet of a playground. Mike Hutcherson
seconded the amendment by Barbara Dorman. The Council voted 7 to 0 in favor of approving
the ordinance with the amendments that such a business can only be in an M-1 Zoning District
and add that it cannot be within 1,000 feet of a playground.
5. Zoning. Zone Case 625 C-3 to M-2. Ordinance No. 95-3053. An Ordinance amending
the zoning map of the City of Plainview, Texas, to rezone 30 acres out of Abstract 29, Block
JK-2, Section 35 at the intersection of Quincy Street and 1-27 Interstate east service road from
a Commercial-3 Zoning District to a Manufacturing-2 Zoning District; Cumulativeness clause;
Conflicts clause; Severability clause; And effective date. Grady Elder of the Industrial
Foundation asked to have this zoning change on behalf of any M-2 prospects which they might
have an opportunity to recruit for the City. Barbara Dorman moved to approve the zoning
ordinance; Rey Rosas seconded the motion; the motion carried unanimously.
6. Zoning. Zone Case 626 R-1 to C-2. Ordinance No. 95-3054. An Ordinance amending
the zoning map of the City of Plainview, Hale County, Texas, to rezone a .93 acre tract in the
north part of Section 24, Block JK-2, Abstract 1589 (2101 W. 24 Street), from a Residential-1
Single Family Zoning District to a Commercial-2 Zoning District; Cumulativeness clause;
Conflicts clause; Severability clause; And effective, date. David Wilder, owner of the property
at 2102 W. 24th, addressed the Council explaining that the property was C-2 when he purchased
it prior to the comprehensive master plan which inadvertently changed it to an R-1 zoning
district, which it was originally. Mr. Wilder asked for the zone change stating there were
remodeling repairs which needed to be done and since there were businesses on each side, this

did not interfere with the makeup of the area. The Planning and Zoning Commission
recommended approval of this change. Dwain Dodson made a motion to approve the zoning
ordinance. Rey Rosas seconded the motion. The motion carried with 7 voting for and 0 voting
against.
7. Municipal Court Week. Mayor Lloyd Woods read a Proclamation regarding Municipal
Court Week, which he presented to the Municipal Court Judge Barbara Sullivan. Judge Sullivan
in turn introduced Angie Asebedo and Rose Ann Chavez who work in her court. She thanked
the Mayor for the proclamation.
8. Buildings. Proposed use by community groups (Brandon Brownlee). Mr. Brownlee was
not present, so this item was not addressed. Mayor Woods stated this item will be placed on
the next available agenda, if Mr. Brownlee so desires.
9. Adjournment. Barbara Dorman moved the meeting adjourn; Mike Hutcherson seconded
the motion; the motion carried unanimously.
