HomeMy WebLinkAbout95 0926 min MINUTES CITY COUNCIL MEETING City of Plainview September 26, 1995 The Plainview City Council held a meeting at 7:30 p.m., Tuesday, September 26, 1995, in the Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson Sr.-Precinct 1, Mary Virginia Kirchhoff-Precinct 2, Rey Rosas-Precinct 3, Barbara Dorman- Precinct 5, and Dwain Dodson-Precinct 6. Absent Councilmembers were Mike Hutcherson- Precinct 4, and Irene Favila-Precinct 7. Staff members present were: James P. Jeffers~City Manager, Wally Hatch-City Attorney, John Castro-Health Department Director, Muff London-Director of Community Development, Roy L. Osborne-Police Chief, Cindy Gasaway-Main Street Coordinator, Carl Holland-Support Services Superintendent, Norman Huggins-Finance Director, Roland Asebedo-Asst. Fire Chief and Karen McBeth, city secretary. News media present: Richard Orr-Plainview Daily Herald, Steve Barrett-Lubbock Avalanche Journal, Mike Fox-KKYN, and Wayland Baptist University TV. OPEN MEETING 1. Invocation was delivered by Mayor Lloyd Woods. 2. Recognitions - There were no recognitions. 3. Consent Calendar - Dwain Dodson moved to adopt the Consent Calendar as presented. Rey Rosas duly seconded the motion which passed unanimously among the five Councilmembers present. a) Minutes were approved. b) Departmental Reports were accepted. c) Expenditures were approved. d) Plainview Feed Yard. Consider authorizing intervention on suspension of the permit for Plainview Feed Yard. Such intervention was authorized. e) Personnel ® Mileage Reimbursement. Consider increasing mileage reimbursement for use of personal vehicles from $.22 per mile to $.27 per mile, effective October 1, 1995. The increase was approved as presented. Personnel · Unused Sick Leave Pay. Consider increasing the "buyback" from $25.00 per day to $30.00 per day. The increase was approved as presented. 1 of 5 g) Plat · Brock Addition. Consider final plat of Brock Addition, Unit No. 12, Plainview, Hale County, Texas. The final plat was approved. h) Vehicle. Consider accepting a bus from Laidlaw Transit for use by the State Prison System. REGULAR AGENDA ITEMS 4. Deputy City Secretary. Consider appointment of a Deputy City Secretary and administer Oath of Office. City Manager Jim Jeffers explained that historically the secretary/legal assistant for the City Attorney served as the deputy city secretary. Mr. Wally Hatch, City Attorney, introduced Mrs. Mary A. Bublis, his legal assistant, stating she was a certified legal assistant and was proud to introduce her to the Council. Karen McBeth, city secretary, administered the oath of office to Mrs. Bublis as the deputy city secretary. Budget Adoption - Ordinance No. 95-3056. An ordinance adopting and approving the Budget for fiscal year October 1, 1995 and terminating September 30, 1996, and making appropriations for each department, project and account. Second and Final Reading. City Manager, Jim Jeffers, gave a short overview of the proposed Budget. Mayor Woods read aloud the caption for Ordinance No. 95-3056, adopting a new budget for the fiscal year 1995- 1996, for the City of Plainview. Barbara Dorman made a motion to open the meeting for public hearing; Rey Rosas seconded the motion; the motion carried unanimously. Mrs. Euniel Horne, 1604-D Yonkers, spoke stating she disapproved of the travel expense allowed for council travel. She stated it seemed to always start out Iow, as in the $3,125 amount for last years budget, and then increase, as in the $5,000 in the proposed new budget. She stated the Council was accountable to the public and this would be remembered at election time. Lucile Davis, 1109 Yonkers, asked who governs how much is spent? Mayor Woods stated he approved where the council went and he reviews the trips expenses when they returned, and asked what benefit the trip was to the City. Bobby James, 401 Lometa, spoke to the Council suggesting the amount of expected sales tax increase for the next year might be higher than the amount which will actually be paid, and would this not make a difference? Mayor Woods answered, explaining there is no way to accurately predict the amount of sales tax which the City could expect in the next twelve months, but that using the past years increases this was a safe, conservative estimate and the Council and he felt comfortable with it. City Manager Jim Jeffers added this was probably an under estimate rather than an over estimate and there had never been a shortfall. Bennie Estes, 1317 Xenia, said he was very interested in the travel expense and felt it was much too high. He suggested that rather than all the Council attending every conference, could one Councilmember go and report to the Council? Rey Rosas, Councilmember-Precinct 3, explained that this did happen quite often when possible, but that many conferences had meetings on different topics happening Simultaneously and thus required different members to attend different meetings. Barbara Dorman made a motion to close the public hearing, Alton Jackson Sr. seconded the motion; the motion carried unanimously among the five Councilmembers present. 2 of 5 Rey Rosas thanked everyone for their input. He stated he was aware that in the past there has been too much money spent on travel by past Councils, but sometimes it takes more money than you originally believe. He stated travel arrangements are always made as economically as possible, but ail the meetings that are attended are beneficiai to the City and to the Councilmembers who are trying to make the right decisions on many issues facing Plainview. Alton Jackson Sr. said that often times there are many meetings, on different topics, going on at the same time and there is no way one person could cover it all. He stated he always tried to spend as little as possible and still learn all he can to do a good job for the community and his precinct. Barbara Dorman said the National League of Cities meetings she has attended out of the state have been paid for out of her own pocket. She said she has no spent any of the City's money out of state. She said that next month she will be the President-elect of the Texas Municipal League for next year. She chaired the Budget and Audit Committee for TML and served on a the Steering Committee for NLC. She stated these were important to the future of Plainview. She said she believed the trips to Washington had directly benefitted the City, and indeed ail of West Texas, such as getting this area approved by Farmers Home Administration to participate in funding for building low to moderate income housing. Mary Virginia Kirchhoff said she believed the point was well taken that the City should be very frugal with tax payers money. She said she believed the Council had done very well in paring down the City budget and thereby coming up with another decrease in the tax rate. She said that every Councilmember comes from a different area with different experiences and it is important for them to learn as much about their jobs as possible and attending different meetings on subjects the City is working on and planning for the future. She said she did not reaiize until she went to some of the meetings how important they were, and especiaily for new members of the Council. She stated the Council tries to be good stewards of the City's money. Mayor Woods said he also believed there are times when it is necessary to attend certain meetings, and he was certainly for learning as much as possible to help govern the City, but he did not approve of the increase in the travel budget. Barbara Dorman moved to approve Ordinance No. 95-3056, establishing a Budget for the 1995- 96 fiscal year; Rey Rosas seconded the motion. Mayor Woods called the names of each Councilmember for their vote to be recorded: Alton Jackson Sr.-Yes; Mary Virginia Kirchhoff- Yes, Rey Rosas-Yes, Barbara Dorman,Yes, Dwain Dodson-No. The motion carried with four votes for and one against. Ordinance No. 95-3056 was adopted. Tax Rate - Ordinance No. 95-3057. An ordinance levying Municipal ad valorem taxes for the City of Plainview, Texas, for the year 1995, and direCting the assessment and col~E..~tion thereof; Severability clause; Cumdlativeness clause; Conflicts clause; Effective Date. Second and Final Reading. '%~ '~ 3 of 5 Mayor Woods said he was proud of the City Manager, and Norman Huggins, Director of Finance for working so hard on the budget to make it as lean as possible and still give the same good service the citizens of Plainview. He said the Council had also put many, many hours studying and reviewing and paring down the b~udget. He said he was proud that they had all there was none. Barbara Dorman moved to approve Ordinance No. 95-3057, establishing the tax rate for 1995 as $.4206; Mary Virginia Kirchhoff seconded the motion. The motion carried with five votes for and none against. Ordinance No. 95-3057 was adopted. Zone Case - 900 North Elm Street. Specific Use Permit in an M-1 Zone. Zone' Case No. 627-900 N. Elm Street. Ordinance No. 95-3058...An Ordinance authorizing the issuance of a specific Use Permit ,,to allow construction of a single family resident, in a manufacturing -1 zoning district; Cumulativeness clause; Conflicts clause; Severability clause; Effective Reading. One Reading. Muff London, Director for Community Development, reviewed the proposed Specific Use Permit, explaining that although this was predominantly a business/industrial district there were some residences within the zone. The permit requested is to allow a residence to be build in this area. She said the Planning and Zoning Commission had unanimously approved the permit and that Staff recommended it also. She stated she had received several letters from property owners in the area approving the request also. Mayor Woods asked for public comment; there was none. Dwain Dodson moved to grant the Specific Use Permit; Rey Rosas seconded the motion; the motion carried unanimously. Order of Election. Establishing the dates, times and place for Early Voting by personal appearance and; naming early voting clerk and address for sending applications for ballot by mail for the November 7, 1995, General Election. Karen McBeth, city secretary, explained the Order of Election was the official public posting for the General Election to be held on November 7, 1997. The election order outlines the dates, times and place of Early Voting, and listing the polling places for the day of election. Barbara Dorman moved to approve the posting of the Order of Election; Rey Rosas seconded the motion; the motion carried unanimously. 9. Adjournment. Barbara Dorman-made a motion to the"~hdjourn the meeting. Dwain Dodson seconded the motion. The motion passed five for and none against.
