HomeMy WebLinkAbout08.23.2004 BA MinutesBOARD OF ADJUSTMENTS MINUTES 8/23/04 BOARD MEMBERS PR£SENT: John Bickel, Kenny Brown, Fred Willis, Max Browning STAFF MEMBERS PRESENT: John Castro - Community Services Director, Katy Seals - Community Development Secretary OTHER GUESTS PRESENT: Weldon & Mary (Scarbrough) Moody, Jose Lara, Raul Perez, Mr. & Mrs. Stanley Williams, Manuel & Lupe Lomeli, Rodlofo Blanco, Kelvin Tipton, Robert Pequeno First item on the agenda: Approval of June 2004 minutes (no July meeting due to no quorum). Kenny Brown made motion to approve minutes as presented. Fred Willis seconded. Motion carded 4-0. Second item on the agenda: BA Case # 1481 The request of Stanley Williams on behalf of Alimentery Williams for a variance of twenty-four (24) feet of required twenty-five (25) foot front setback and one foot (1) six (6) inches of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X24' carport in a Single- Family Residential (R-2) Zoning District, and being Block 6, Lot t8, Montrose Addition, Plainview, Hale County, Texas the same being 608 W. 2Ist Street. Stanley Williams is present to answer questions from the Board. John Castro showed the Board pictures of the property where the proposed carport will be constructed. John Castro also showed the Board a map of the neighboring properties and said there were two (2) responses received, both in favor of the request. Kenny Brown asked what type of materials would be used for the construction of the carport and Stanley Williams said it would be constructed of steel. Kenny Brown made a motion to approve the variance based on positive responses from the neighborhood and this being the only logical place for the carport. Max Browning seconded the motion. Motion carried 4-0. Third item on the agenda: BA Case # 1482 The request of Jose Carmen Lara for a variance of twenty-five (25) feet of required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 19'X19' carport in a Single-Family Residential (R-2) Zoning District, and being Block I, Lot 12, Titus-Pillow Addition, Plainview, Hale County, Texas the same being 2408 Houston Street. Jose Carmen Lam is present to answer questions from the Boar& John Castro showed the Board pictures of the property and a site plan of where the proposed carport would be. There were six (6) replies from the neighborhood, all in favor of the request. John BickeI asked what materials would be used in the construction of the carport and Jose Carmen Lara told the Board it would be made of steel. He added that the carport would be placed as close to the house as possible and that he would concrete any area under the carport that is not currently in concrete. Jose Carmen Lam asked if he could build the Board of Adjustment August 23, 2004 Minutes carport out to the curb and John Castro said he could only build to his property line. Kenny Brown made motion to approve the variance based on this being the only logical place for a carport and the positive responses from the neighborhood. Fred Willis seconded the motion. Motion carded 4-0. Fourth item on the agenda: BA Case # 1483 The request of Kelvin Tipton for a variance of four (4) feet of required ten (10) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20'3225' carport in a Single-Family Residential (R-2) Zoning District, and being Block 5, Lot N140'-9&10, Highland Addition, Plainview, Hale County, Texas the same being 811 W. 11th Street. Kelvin Tipton is present to answer questions from the Board. John Castro showed the Board a site plan of where the proposed carport would be as well as pictures of the property. There were six (6) responses from the neighborhood, all in favor of the request. Fred Willis asked who would be building the carport and Kelvin Tipton said he would be building it himself using metal and matching the architecture of the house and existing garage. 1Virex Browning made motion to approve the variance based on this being the only logical place for the carport and the positive responses from the neighborhood. Kenny Brown seconded. Motion carded 4-0. Fifth item on the agenda: BA Case # 1484 The request of Mary Ann Scarbrough for a variance of twenty five (25) feet of the required twenty five (25) foot front setback and four (4) feet of required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct an 18'X21' carport in a Single-Family Residential (R-2) Zoning District, and being Block 2, Lot 19, Northside Addition, Plainview, Hale County, Texas the same being 2216 Joliet Street. Weldon Moody, 1Mary Ann (Scarbrough) Moody's husband, is present to answer any questions from the Board. John Castro showed the Board pictures of the property and a site plan of the proposed placement of the carport as well as a neighborhood map showing other properties in the area~ There were two (2) neighborhood responses received in favor of the variance and none received against the request. Weldon Moody said this carport is one of prefabricated materials. Fred Willis made motion to approve the variance request based on the positive responses received from the neighborhood and this being the only logical place for the carport. Max Browning seconded. Motion carded 4-0. Sixth item on the agenda: BA Case # 1485 The request of Refmo R. Pequeno for a variance of nine feet (9) of the required ten (10) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 21'X24' carp~ in a Single-Family Residential (R-2) Zoning District, and beJmg Block 20, Lot 24, Lakeside Addition, Plainview, Hale County, Texas the same being 1910 Independence Street. Robert Pequeno, son of Refino Pequeno is present to answer questions from the Board. John Castro told the Board that this case was heard in June but due to a mm'communication between staff and the applicants, the case is being heard again this month, asking for this setback request. John Castro showed the Board pictures of the property and a site plan of the proposed carport. John Castro told the Board there would be no vision blockage for traffic by the placement of the proposed carport. There was one (1) response received from the neighborhood and it was in favor of the request. Fred Willis made a motion to approve the variance based on there being no vision blockage to traffic by the placement of the carport and the positive response from the neighborhood. BA Case # 1486 The request of Rodolfo Blanco for a variance of ten feet (10) of the required twenty (20) foot rear setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 22'X30' accessory building in a Single-Family Residential (R-l) Zoning District, and being Block 1, Lot 4, Boswell Heights Addition, Plainview, Hale County, Texas the same being 1007 Wayland Street. Rodolfo Blanco is present to answer questions from the Board. John Castro showed the Board a site plan of the proposed accessory building and pictures of the property. John Castro said three (3) responses were received from the neighborhood, all in favor the request. John Castro told the Board that according to the ordinance, buildings cannot cover more than 50% of a total lot and this property is within this guideline. He said the ordinance also states that accessory buildings cannot cover more than 30% of a rear lot. He said with existing building and the proposed building, this property is still within that guideline. John Castro also told the Board that the ordinance says there must be a minimum of 15' between the main building and accessory buildings and this property has 24'. There were three (3) responses received from the neighborhood in favor of the request and no responses received opposed to the request. Rodolfo Blanco said he will have to move his gas line in order to put the building where is planning to put it. Max Browning asked would this accessory building's construction materials match that of the existing building and Rodolfo Blanco said it would. Max Browning made motion to approve the variance based on the pro~perty being within the guidelines stated above and the positive responses from the neighborhood. Fred Willis seconded the motion. Motion carded 4-0. Eighth item on the agenda: BA Case # 1487 The request of Manual and Guadalupe Lomeli for a variance of fourteen feet (14) of the required twenty-five (25) foot front setback and four (4) feet of the req~aired five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Or 'alu-mace to construct a 20'X32' carport in a Single-Family Residential (R-2) Zoning District, and being Block 1, Lot 7, Bel Air Addition, Plainview, Hale County, Texas the same being 2208 Houston Street. Manual Lomeli is present to answer questions from the Board. John Castro st~owed the Board pictures of the property and a site plan of the proposed placement of the carport as well as a neighborhood map showing other properties in the area. There were four (4) neighborhood responses received in favor of the variance and none received against the request. Fred Willis asked what materials would be used to construct the carport and Guadalupe Lomeli said ~ would be made of steel. John Bickel asked if the carport would match the architecture of the house -~4~th the peaks and Guadalupe ~Lomeli said the roof of the carport would not be pitched like that of the house - it would be flat and it would be painted to match the colors of the house. Fred Willis made a motion to approve the variance based on positive responses from the neighborhood and this bering the only logical place for the carport. Max Browning seconded. Motion carded 4-0. Ninth item on the agenda: BA Case # 1488' The request ofRaul Perez for a variance of sixteen feet (16) of the required twenty (20) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X24' carport in a Central Business District (CBD) Zoning District, and being Block 14, Lot E/2 9&10, OT, Plainview, Hale County, Texas the same being 303 E. 8th Street. Raul Perez is present to answer questions from the Board. John Castro showed the Board pictures of the property and a site plan of the proposed placement of the carport as well as a neighborhood map showing other properties in the area. There were no Board of Adjustment August 23, 2004 Minutes neighborhood responses received. John Bickel asked if the house faced 8th Street and John Castro said it does. John Bickel asked what would materia~ would be used in the construction of the carport and Raul Perez said it would be made of steel. Raul Perez also said the carport would not have a peaked roof- it would be flat and sloped toward the street. Fred Willis made a motion based on this being the only logical place for the carport and no negative responses from the neighborhood. Max Browning seconded the motion. Motion carded 4-0.
