The Plainview City Council met on October 12, 2004 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 3:20 p.m. on October 8, 2004. Mayor John C. Anderson
presided. Councilmembers present were: Kelvin Tipton-District 1, Belinda Pena-Distdct
3, John N. Bertsch-District 4, Ron Trusler-District 5, Wendell Dunlap-District 6 and
Roland Nash-District 7. Councilmember Mary Jane Shanes-District 2 was absent.
Staff members present were: Greg Ingham-City Manager, John Castro-Director of
Community Services, John Berry-Director of Public Works, Dale Simpson-Director of
Civil Service, Will Mull-Police Chief, Gary Glass-Fire Chief, Greg Zielinski-Code
Enforcement Officer, Del Essary,Superintendent, Solid Waste Management, Jack
Keller-Budget Manager, Larry Gould-Building Official and Belinda Hinojosa-City
Secretary.

Pastor Mark Weiss, Calvary Baptist Church delivered the invocation.
Travis Heinen, Pack 223 led in the Pledge of Allegiance.
Councilmember Bertsch moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Trusler and carried by unanimous vote. Items approved
on the Consent Calendar included: approval of minutes of September 28, 2004 and
October 7, 2004 and the granting of an excused absence to Councilmember Mary
Jane Shanes. In order to adopt the most recent codes, the Council adopted the
following ordinances upon first reading:
a) Ordinance No. 04-3431, an Ordinance amending the table of contents and
Chapter 20, Plumbing, of the City of Plainview Code of Ordinances to adopt the
Uniform Plumbing Code (2003 Edition) and the Uniform Mechanical Code
(2003 Edition); cumulativeness clause; conflicts clause; severability clause; and
effective date.
b) Ordinance No. 04-3432, an Ordinance amending Chapter 13, Housing, of the
City of Plainview Code of Ordinances to adopt the International Property
Maintenance Code, cumulativeness clause; conflicts clause; severability clause;
and effective date.
c) Ordinance No. 04-3433, an Ordinance amending Chapter 6, Buildings, of the. City
of Plainview Code of Ordinances to designate the International Building Code,
International Residential Code, and International Energy Conservation Code as
the Building Codes for the City of Plainview, Hale County, Texas;
cumulativeness clause; conflicts clause; severability clause; and effective date.
d) Ordinance No. 04-3434, an Ordinance amending Chapter 10, Electricity, Article
VI, Installation Regulations of the City of Plainview Code of Ordinances, to adopt
the National Electrical Code (2002 Edition); cumulativeness clause; conflicts
clause; severability clause, and effective date.
e) Ordinance 04-3435, an Ordinance amending Chapter 11, Fire Protection and
Prevention of the City of Plainview Code of Ordinances; cumulativeness clause,
conflicts clause; severability clause, and effective date.

Greg Ingham, Ck'7 Manager presented for consideration the Mutual Aid Agreement for
Regional Councils of Government and the Amendment to Mutual Aid Agreement
for Regional Councils of Government. He stated that as part of the State of Texas
emergency management program, they have put out a requirement that cities and
counties and local governmental entities and all council of governments in the state
adopt a mutual aid agreement. The Agreement will protect our City and also establish
the guidelines under which we will assist each other. The Mutual Aid Agreement
outlines who is liable and who is responsible for what costs when cities assist each
other. The Agreement sets forth that the party who has been requested to send aid
would decide how many vehicles they could send. The Agreement establishes the City
sending the assistance would incur the costs, however the parties could work out some
reimbursement later. The City retains its immunities. If we want to be eligible for grant
funding and reimbursement through the Federal Emergency Management
Administration we will have to be a member and a participant in an agreement of this
nature. Our council of governments is the South Plains Association of Government
based out of Lubbock and serves a 15 county region. The cities and counties in our
region are in the process of signing this Agreement and Amendment.
The Amendment to the Mutual Aid Agreement for Regional Councils of
Government specifically addresses the Homeland Security Act and it states that the
agency sending the assistance is not responsible for any civil liability that arises from
the entity furnishing the service.
Mr. Ingham stated this is an important thing for our region and Lubbock has signed on
the Agreement. This is something that is good and necessary for our area in
connection with emergency management.
There was no public comment on either the Mutual Aid Agreement or the Amendment to
the Mutual Aid Agreement.
Councilmember Tipton moved to approve the signing of the Mutual Aid Agreement for
Regional Councils of Government. The motion was duly seconded by Councilmember
Trusler and carried by unanimous vote,
Councilmember Dunlap moved to approve the signing of the Amendment to Mutual Aid
Agreement for Regional Councils of Government. The motion was duly seconded by
Councilmember Pena and carried by unanimous vote.
Jack Keller, Budget Manager presented for consideration the Panhandle Revenue
Recovery Association Interlocal Cooperation Contract. This gives the group of
local cities a way to collect delinquent utility bills. At the present time, there are 34 cities
that are members of the group. There is a $500 initial set up fee and the collecting city
retains 25% of the delinquent amount.
There was no public comment.
Councilmember Trusler moved to authorize the City Manager to sign the Panhandle
Revenue Recovery Association Interlocal Cooperation Contract. The motion was duly
seconded by Councilmember Nash and carried by unanimous vote.

Del Essary, Superintendent of Solid Waste Management presented for consideration
Resolution R04-141, a Resolution of the City Council of the City of Plainview, Texas,
authorizing the filing of a grant application with the South Plains Association of
Governments for a regional solid waste grants program grant; authorizing Del Essary
to act on behalf of the City of Plainview in all matters related to the application; and
pledging that if a grant is received the City of Plainview will comply with the grant
requirements of the South Plains Association :of Governments, the Texas Commission
on Environmental Quality and the State of Texas. This Resolution authorizes an
application for a $51,499 grant for the purchase and installation of an industrial size
paper shredder. This will shred officer paper to make a better bail. These monies come
from the state for waste reduction and recycling projects throughout the state and the
grant is being overseen through SPAG.
There was no public comment.
Councilmember Bertsch thanked Del Essary for staying on top of the grants.
Councilmember Tipton moved to approve Resolution R04-141. The motion was duly
seconded by Councilmember Pena and carried by unanimous vote.
Mayor Anderson moved to adjourn the meeting. The motion was duly seconded by
Councilmember Trusler and carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 7:26 p.m.
