Miranda, Doug Edwards, Mary. Zavala, Bertha Pequeno, Jessie Reyes, Don Burress, Jessy Hemandez, Bobby Pequeno First item on the agenda: Approval of May 2004 minutes. Fred Willis made motion to approve minutes as presented. Kenny Brown seconded. Motion carried 4-0. Second item on the agenda: BA Case # 1475 The request of Don Burress for a variance of nineteen (19) feet of the required twenty-five (25) foot rear setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X30' shop/storage/hobby building in a Single-Family Residential (R-l) Zoning District, and being Block 3, N15' - Lot 18 All of Lot' 19,-Babitzke Subdivision, Boswell Heights Addition, Plainview, Hale County, Texas the same being 1312 Travis Street. Don Burress is present to answer questions from the Board. John Castro showed the Board victures of the property where the proposed building is already being constructed. John Castro told the 53oard that Don Burress said if the.variance is not approved that he will enclose the back Wall and not have garage doors opening to the alley. John Castro also showed the Board a map of the neighboring properties and said there were two responses received, both in favor of the request. Ray Jameson asked what type of siding would be used and Don Burress said it would have white siding to match his house. Fred Willis made a motion to approve the variance based on positive responses from the neighborhood and this being the only logical place for the storage building. Kenny Brown seconded the motion. Motion carried 4-0. Third item on the agenda: BA Case # 1476 The request of Francis John Miranda for a variance of nineteen (19) feet of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 22'X23' carport in a Single-Family Residential (R-2) Zoning District, and being Block 17, Lot 7, Unit 4, Thunderbird Addition, Plainview, Hale County, Texas the same being 2807 Lexington Street. Francis J. Miranda is present to answer questions from the Board. John Castro, showed the Board pictures of the property and a site plan of where the proposed carport would be. There were 2 replies from the neighborhood in favor of the request and one received against the request. Ray Jameson asked what materials would be used in the construction of the carport and Mr. Miranda told the Board it would be made of metal and that he would like to enclose one side of the carport. Ray Jameson told him that the carport could not be enclosed and Francis J. Miranda said OK. Kenny Brown made'motion to approve the variance based on this being Board of Adjustment June 28, 2004 Minutes the only logical place for a carport. Fred Willis seconded the motion reiterating that the carport could not be enclosed. Motion carried 4-0. Fourth item on the agenda: BA Case # 1477 The request of Refino R. Pequeno for a variance of fifteen (15) feet of the required twenty-five (25) foot front setback and one foot (1) six (6) inches of the side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 21 'X24' carport in a Single-Family ReSidential (R-2) Zoning District, at'id being Block 20, Lot g;4, Lakeside Addition, Plainview, Hale County, Texas the same being 1910 Independence Street. BO~Dy Pequeno son of Refino Pequino and Bertha Pequeno (wife of Refino Pequeno)' are present with B~ Pequeno available to answer questions from the Board. John Castro showed :the Board a site plan~fI~ where the proposed carport would be as well as pictures of the property. There were three (3) reSponSes from the_ neighborhood, all in favor of the request. Ray Jameson asked what materials would bemused in the construction and Bobby Pequeno said it would be constructed from metal materials. Kenny Brown made motion to approve the variance based on this being the only logical place for the c~ft'and~ the positive responses from the neighborhood. Fred Willis seconded. Motion carried 4-0. Fifth item on the agenda: BA Case # 1478 The request of Douglas Edwards on.behalf of Charlotte Thurman for a variance of twenty-four (24) feet of required thirty (30) foot frOnt setbaCk-as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 20'X20' carport in a Single- Family Residential (R-l) Zoning District, and being Block 2, S75.25' of Lot 7, Akin~Webb Addition, Plainview, Hale County, Texas the same being 1603 Travis Street. Doug Edwards is present to answer any questions from the Board. John Castro showed the Board pictures of the property and a site plan of the proposed placement of the carport as well as a neighborhood map showing other properties in the area. There were seven (7) neighborhood responses received in favor of the variance and none received against the request. John Castro told the Board there is no side setback requested and Doug Edwards said he did want a side setback and there was a discrepancy in the request. John Castro said the only setback that could be considered in this meeting was the front setback since it was what was published in the legal notice. Fred Willis made motion to approve the variance request for the front setback based on the positive responses received from the neighborhood and this-being the only logical place for the carport and. Kenny Brown seconded. Motion carried 4-0. Sixth item on the agenda: BA Case # 1479 The request of Mary Zavala for a variance of twenty (20) feet of required twenty (20) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 12'X21' carport in a General Commercial (C-3) zoning District, and being Block 80, Lot 5, Alexander-Westmoreland Addition, Plainview, Hale County, Texas the same being 605 Fresno Street. Mary Zavala and Jessie Reyes are present and Jessie Reyes is available to answer questions from the Board. John Castro showed the Board pictures of the property and a site plan of the proposed carport. He told the Board this home is located in a Commercial Zone and there is no side setback required for .commercially zoned properties. Ray Jameson asked what the carport would be constructed of and Jessie Reyes said it would be prefabricated with a pitched roof. There was one response received from the neighborhood and it was in favor of the request. Kenny Brown made a motion to approve the variance based on this being the only logical place for the carport and the positive response from the neighborhood. BA Case # 1480 The request of Jessy Hernandez for a variance of twenty-five (25) feet of required twenty-five (25) foot front setback and four (4) feet of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct an 18'X20' carport in a Single-Family Residential (R-2) Zoning District, and being Block 70, El09' & N46' of the W46' of Lot 6, Highland Addition, Plainview, Hale County, Texas the same being 1403 Portland Street. Jessy Hernandez is present to answer questions from the~Board. John Castro showed the Board a site plan of the proposed carport and pictures of the prop.e~Y. Jessy Hernandez said the carport would be prefabricated. There were two (2) responses rece~ed from the neighborhood in favor of the request and no responses received opposed to the requeS[.~iiilFred Willis made motion to approve the variance ba~sed on this being the .only logical place for the c~ort and the positive responses received from the neighborhood.
