HomeMy WebLinkAbout04-3433 ord2 8.0 ORDINANCE AMENDMENT - ORDINANCE NO. 04-3433 AN ORDINANCE AMENDING CHAPTER 6, BUILDINGS, OF THE CITY OF PLAINVlEW CODE OF ORDINANCES TO DESIGNATE THE INTERNATIONAL BUILDING CODE, INTERNATIONAL RESIDENTIAL CODE, AND INTERNATIONAL ENERGY CONSERVATION CODE AS THE BUILDING CODES FOR THE CITY OF PLAINVIEW, HALE COUNTY, TEXAS; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE, AND EFFECTIVE DATE. WHEREAS, Chapter 6, Article VI, sets forth the minimum standards for building construction; and WHEREAS, from time to time it is advisable to review the ordinances that regulate construction of all buildings within the City of Plainview; and WHEREAS, the Building Trades Fire Code Board of Appeals has reviewed staff recommendations on adoption of the International Building Code, International Residential Code, and International Energy Conservation Code; and WHEREAS, the International Building Code, International Residential Code, and International Energy Conservation Code with proposed amendments as herein after made has been duly presented to the City Council; and WHEREAS, the City Council of the City of Plainview finds that it would not be detrimental or injurious to the public health, safety or general welfare of the citizens of the City of Plainview: NOW, THEREFORE, The City of Plainview Hereby Ordains That: SECTION I Chapter 6, Section 6-16 is amended as follows: Sec. 6-16. The same 1~ are incorporated herein by reference as if fully set forth at length. A copy of said , [,,~,,,,,_....v.... _~,,~,..~t~"a'~"" International Codes shall be filed with the city secretary and a copy maintained in the office of the building official of the City of Plainview, Texas, all such copies to be open to public inspection during business hours of the offices where they are maintained, with amendments thereto. No. 98-3196, 10-10-98) Ordinance No. 04-3433 Page 1 of 10 281 SECTION II Chapter 6, Section 6-17 Amendments to the Uniform Buildinq Code is deleted in its entirety and replaced by Section 6-17 as follows: Sec. 6-17 Amendments to the 2003 International BuildinR Code 101.1 Tile Add City of Plainview These provisions shall be known as the Building Code of (Name of Jurisdiction) the City of Plainview, and shall be cited as such and will be referred to herein as "this code." 101.2 Scope Amend exception (2) as follows: (2) Existing buildings undergoing repair, alteration or additions, and change of occupancy shall be permitted to comply with the International E.¥ic*.':.-.g B'..'i!d?,g Property Maintenance Code and Chapter 34 of this Code. 101.4.1 Electrical, Change ICC Electrical to currently adopted National Electrical Code 101.4.2 Gas. Change International Fuel Gas Code to currently adopted Uniform Plumbing Code 101.4.3 Mechanical. Change International Mechanical Code to currently adopted Uniform Mechanical Code 101.4.4 Plumbing. Change International Plumbing Code to currently adopted Uniform Plumbing Code. Change International Private Sewage Disposal Code to currently adopted Uniform Plumbing Code. 101.4.6 Fire prevention. Add and currently adopted Life Safety Co-de to end of International Fire Code 105.1 Required. Add sentence to the end of paragraph: It shall be unlawful for any person to re-roof any structure, other than their own property, within the City Limits of Plainview prior to registering with the City of Plainview Building Department. Registration procedures shall be approved by the City. No fee shall be assessed for such registration. 105.1.1 Annual permit. Delete in its entirety 105.1.2 Annual permit records. Delete in its entirety 105.2 Work exempt from permit. Currently adopted edition of the National Electrical Code. SECTION 109 Inspections Add new sections as follows: Ordinance No. 04-3433 Page 2 of 10 2 8 21 109.7 Inspection of moved buildings. (a) No person or persons shall hereafter move any building, house or structure within the limits of the City of Plainview, Texas, where the same shall be moved in, through or upon the streets, alleys, avenues, or public grounds unless said person shall, before moving said building house or structure, secure a permit to do So from the building Official of the City of Plainview, Texas. (b) No person or persons shall hereafter move any building or structure from within or from outside the City limits of the City of Plainview, Texas, to any place within the City limits of the City of Plainview, Texas, or cause the same to be done, without first obtaining a separate building permit for each building or structure from the Building Official of the City of Plainview, Texas. (c) Whenever any person or persons shall make an application for a building permit for a building or structure which is to be moved from outside the City limits of the City of Plainview, to a place inside the City limits, said person shall deposit with the Building Official, a sum of money equal to the IRS standard mileage rate per mile for each mile necessary to travel round trip from the City limits of Plainview to the building, plus a sum of money equal to the current hourly rate for Code Administration, plus 15% administrative fee, per hour based upon the Building Official's estimated time required to make the inspection and in traveling to said building and returning to the City limits of the City of Plainview with a minimum of one hour charged on each inspection. Said deposit shall become the property of the City of Plainview and is to pay for the expense for inspecting said building and shall not be returned to the person making application regardless of whether or not the Building Permit is issued. Such payment shall be in addition to the regular fees required for issuing a building permit as prescribed by ordinance. (d) The Building Official may designate a competent deputy to make such inspection for him/her. 109.8 Reinspection. There shall be no charge for the first re-inspection of a new building or addition or alterations of old buildings. When more than one re-inspection is required, a re-inspection fee of $25.00 for each additional re-inspection shall be charged. The re-inspection fee must be paid before further inspections will be made. SECTION 112 Board of Appeals Delete and add the following: See Section 6-41 of the City of Plainview Code of Ordinances for means of appeal. 113.4 Violation penalties, Add the following to end of paragraph: Any person, Firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and everyday or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than one thousand dollars ($1,000.00). Chapter 4 406.1.3 Garages and carports Add to first paragraph as follows: Carports shall be open on at least two sides. Carports that lie outside of building setback lines shall be open on three (3) sides. Carport floor surfaces shall be of approved noncombustible material. Carports not open on at least two sides shall be considered a garage and shall comply with the provisions of this section for garages. Chapter 14 Exterior Walls 1405.3.2 Masonry Delete this section Chapter 18- Soils and Foundations Table 1804.2 Allowable foundation and lateral pressure. Use 1,500 per City of Plainview Engineering Dept. 1805.3.4 Foundation elevation Add the following sentence to the end of paragraph: On graded sites, the top of any exterior foundation shall extend above the elevation of the street gutter at point of Ordinance No. 04-3433 Page 3 of 10 discharge or the inlet of an approved drainage device a m~nimum of 12 inches (305 mm) plus 2 percent. Alternate elevations are permitted subject to the approval of the building official, provided it can be demonstrated that required drainage to the point of discharge and away from the structure is provided at all locations on the site. Placing the top of the exterior foundation 12 inches above the street curb is an acceptable alternative. Chapter 21 Masonry 2112.2 Footings and foundations. Delete and replace with the following: Masonry chimneys shall be supported on footings of solid masonry or concrete at least 16 inches thick and at least 4 inches beyond each side of the exterior dimensions of the chimney. They shall be reinforced with two (2) 5/8" rebars in the footing. Chapter 23 Wood Table 2308.8(1) Floor joist spans for common lumber species. Delete table and use table 2308.8(2) for residential sleeping areas. Chapter 27 - Electrical Delete chapter and refer to Chapter 10 City of Plainview Code of Ordinances Chapter 28 - Mechanical Delete chapter and refer to Chapter 20 City of Plainview Code of Ordinances Chapter 29 - Plumbing Delete chapter and refer to Chapter 20 City of Plainview Code of Ordinances Chapter 32 - Encroachments into the public right-of-way Section 3202 Encroachments Delete section and replace with the following: Refer to the City of Plainview Zoning Ordinance and Chapter 21 City of Plainview Code of Ordinances for encroachments into the public right-of-way. SECTION III Section 6-18 is added to Chapter 6 as follows: Sec. 6-18 Amendments to the 2003 International Residential Code R101.1 Tile Add City of Plainview These provisions shall be known as the Residential Code for One- and Two-Family Dwellings of the City of Plainview, and shall be cited as such and will be referred to herein as "this code." R105.1 Required. Chapter 7 Wall Covering Ordinance No. 04-3433 Page 6 of 10 286 R703.7.5 Flashing Delete and replace with the following: Flashing shall be located above shelf angles, lintels that are not protected by eaves or patios when masonry veneers are designed in accordance with Section R703.7. See Section R703.8 for additional requirements. R703.7.6 Weepholes Delete section. Chapter 10 Chimneys and fireplaces R1001.1.1 Support Delete and replace with the following: Masonry chimneys shall be supported on footings of solid masonry or concrete at least 16 inches thick and at least 4 inches beyond each side of the exterior dimensions of the chimney. They shall be reinforced with 2 5/8" rebars in the footing. It is referred to herein as "this code." Ordinance No. 04-3433 Page 7 of 10 287 101.2 Scope. Change as follows: This code establishes minimum prescriptive and performance related regulations for the design of energy efficient buildings and structures or portions thereof that provide facilities or shelter for public assembly, educational, business, mercantile, institutional, storage and residential occupancies, as well as those portions of factory and industrial occupancies designed primarily for human occupancy. This code thereby addresses the design of energy-efficient building envelopes and the selection and installation of energy-efficient mechanical, service water-heating, electrical distribution and illumination systems and equipment for the effective use of energy in these buildings and structures. Exception's: 1) Energy conservation systems and components in existing buildings undergoing repair, alteration or additions, and change of occupancy, shall not be ~required to comply with the !ntern=t!cn=! Ex~.st~.ng B'..'~,!d!ng Codo this code, unless the repair, alteration or addition and change of occupancy, is to a building or structure constructed under this code. 2) New construction of detached accessory buildings and garages for residential occupancies. 101.2.2 Applicability. Add the following paragraph to the end of the text: All references to the International Mechanical Code or International Plumbing Code or International Fuel Gas Code shall be changed throughout this code to refer to Chapter 20, City of Plainview Code of Ordinances, for the currently adopted Mechanical and Plumbing Codes. All references to the International Electrical Code shall be changed throughout this code to refer to Chapter 10, City of Plainview Code of Ordinances, for the currently adopted Electrical Code. Dangerous Buildings is deleted in its entirety and the following amendment is made: Secs. 6-3026 - 6.40 Reserved SECTION VII Chapter 6, Article III Board of Appeals, Section 6-43 Composition is amended to add the following: Sec. 6-43. Composition. The Board shall consist of members with the following qualifications: (a) One (1) Building Contractor (b) One (1) Licensed Master Electrician (c) One (1) Representative of the local Electrical Service Provider (d) One (1) Licensed Master Plumber (e) One (1) Representative of the local Gas Service Provider (f) One (1) Licensed Heating and Air Conditioning Contractor (g) T .... .... ,-,~°~ One (1) persons who by experience have has working knowledge of the above trades. (h) Four (4) alternates who meet any of the above qualifications (i) The City Building Official, or his/her authorized representative shall be an ex-officio member and serve as secretary for the Board without voting privileges. (j) The City Engineer shall be an ex-officio member of the Board without voting privileges. (k) The City Fire Marshal or other representative of the Fire Department as determined by the Fire Chief, shall be an ex-officio member of the Board without voting privileges. SECTION VIII All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IX Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, subsection, sentence, Ordinance No. 04-3433 Page 9 of 10 2 8 9 provision., clause, phrase or word severable therefrom and the same shall be deemed severable for this purpose. SECTION X This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED on first reading this 12th day of October, 2004.
