BOARD MEMBERS PRESENT: Mark Hardin, Nicole Ramirez, Albert Torres, Kevin Carter and
David Murphree.
STAFF MEMBERS PRESENT: Robert Zapata, City Inspector, Judy Rasher, Community Service
Secretary.
GUEST PRESENT: Ms. Eduardo Rodriguez, Jimmy Kelly, Debbie Miller
Mark Hardin called the meeting to order at 6:00 P. M.
FIRST ITEM ON THE AGENDA: Approval of July 25, 2016 minutes. Kevin Carter made a motion
to approve minutes as presented. Albert Torres seconded the motion. Motion carried
unanimously.
SECOND ITEM ON THE AGENDA:
BA Case # 1680: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions.
Property Owner: Eduardo Rodriguez
Address: 314 Juanita St
Legal Description: Block 5 Lot 36 of the Country Club Addition
Zoning: R1
Homeowner, Eduardo Rodriguez wanted to install a 20 x 22 carport in front of his home,
located at 314 Juanita Street. In surveying the surrounding area, staff observed several
carports in a 3 block radius, 11 carports on Juanita Street, 7 carports on Norma and 7 carports
on Aileen Street. As per code Section 37.2.2(h), there is no other practical location on the
property for him to install the carport. 24 Letters were sent out to the neighbors. Received 2
letters in favor of the carport. Homeowner has complied with the set back from the front and
side of his property lines. Nicole Ramirez made a motion to approve the variance based on the
request. Albert Torres seconded and the motion was carried unanimously.

THIRD ITEM ON THE AGENDA:
BA Case # 1681: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions.
Property Owner: Jimmy Kelly
Address: 2205 W 12th
Legal Description: Block 8 W37.5' — 3 Lot 4 of the Boss Smelser Addition
Zoning: R1
Homeowner, Jim Kelly is wanting to install a 24 x 24 carport in front of his home, located at
2205 W 12 Street. In surveying the surrounding area, staff observed no carports in the area.
Homeowner does have a 2 car garage. This information was presented to the board. Board
member, Mark Hardin asked homeowner if there were any deed restrictions. Mr. Kelly said
there was none. Mr. Kelly spoke with a couple of the neighbors and informed the board that
the neighbors were ok with the carport. 19 Letters were sent out to the neighbors. Did not
received any responses from the neighbors. Mr. Kelly has complied with the set back from the
front and side of his property lines. Albert Torres made a motion to approve the variance based
on the request. David Murphree seconded and the motion was carried unanimously.
FOURTH ITEM ON THE AGENDA:
BA Case # 1682: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning

Address: 206 S E 4th
Legal Description: Block 1 Lot 4 of the Parkside Addition
Zoning: R2
Homeowner, Debbie Miller is wanting to install a 11 x 24 carport. Homeowner does have a one
car garage. In surveying the surrounding area, staff observed 2 carports in the area. As per
code Section 37.2.2(h), there is no other practical location on the property to install the carport.
14 Letters were set out to the neighbors. Received one letter in favor of the carport.
Homeowner has complied with the set back from the front and side of her property lines. The
staff makes the recommendation that homeowner be allowed to install a carport in front of her
residence at 206 SE 4th. Kevin Carter made a motion to approve the variance based on the
request. David Murphree seconded and the motion was carried unanimously.
