HomeMy WebLinkAbout09-13-2016 Council Minutes64 The Plainview City Council met on September 13, 2016 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:30 p.m. on September 9, 2016. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Norma Juarez -District 3, Susan Blackerby-District 5, and Oliver Aldape-District 7. Councilmembers Teressa King -District 4 and John Gatica-District 6 were absent. Staff members present were: Jeffrey Snyder -City Manager, Andrew Freeman -Assistant City Manager, Leslie Schmidt -City Attorney, Tim Crosswhite-Director of Public Works, Rusty Powers -Fire Chief, Ken Coughlin -Police Chief, lsauro Gutierrez -Information Technology Manager, Sarianne Beversdorf-Director of Finance and Belinda Hinojosa- City Secretary. News Media Present: Homer Marquez -Plainview Herald Guests Present: Mary E. Kindinger Councilmember Aldape delivered the invocation and led in the pledge of allegiance. Councilmember Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Items approved on the consent calendar included the granting of excused absences to Councilmembers Teressa King and John Gatica; approval of the minutes of August 18, 2016 and August 23, 2016; and approval of Resolution R16-369, a Resolution of the City Council of the City of Plainview, Texas, Approving the Request of The Hale On Wheels Event Director To Host The Hale On Wheels Cycling Event; Authorizing The Filing Of The Agreement For The Temporary Closure Of State Right -Of -Way With The Texas Department Of Transportation For This Event; Declaring That The Event Serves A Public Purpose; And Agreeing To Comply With Regulations. Jeffrey Snyder, City Manager presented information on the proposed tax increase. The adopted tax rate for 2015-2016 is $0.6288; the proposed tax rate for 2016-2017 included in the budget is $0.6288; the effective tax rate for 2016-2017 is $0.6009; the rollback rate for 2016-2017 is $0.6703; and the tax rate ceiling set by the Council is $0.6500. Mayor Pro Tem Starnes moved to open a public hearing on the proposed tax increase. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. There was no public comment. The public hearing was closed at 7:06 p.m. Mayor Dunlap announced that a vote on the first reading of the ordinance to adopt the proposed tax rate will be held on September 22, 2016 at 11:30 a.m. at the Plainview Convention Center, 2902 W. 4th Street; and a vote on the second and final reading of the ordinance to adopt the proposed tax rate will be held on September 27, 2016 at 7:00 p.m. In the City Council Chambers at City Hall, 901 Broadway. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. There was no public comment. Mayor Pro Tem Starnes moved to close the public hearing. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. The public hearing was closed at 7:23 p.m. Mayor Dunlap announced that a vote on the first reading of the ordinance to adopt the budget will be held on September 22, 2016 at 11:30 a.m. at the Plainview Convention Center, 2902 W. 4th Street; and a vote on the second and final reading of the ordinance to adopt the budget will be held on September 27, 2016 at 7:00 p.m. in the City Council Chambers at City Hall, 901 Broadway. Mayor Dunlap presented for consideration on second reading Ordinance No. 16-3636, an Ordinance of the City Council of the City of Plainview, Texas Authorizing the Amendment to an Adopted Community Development Program as Authorized by Texas Local Government Code, Section 373, Hereafter Referred to as the "City of Plainview Community Development Program No. 1", for the Proposed Preservation and Future Redevelopment of an Approximate 96.82 acre tract of Land Located Near Westbound Interstate 27 and North State Highway 194 (Dimmitt Highway), all of which is within the Corporate City Limits of Plainview, Texas; Providing for an Effective Date; Severability Clause; Cumulativeness Clause; and Conflicts Clause. Since this was the second of two readings the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 16- 3636 on second reading. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Andrew Freeman, Assistant City Manager presented for consideration to award bid for the Civic Center Renovation project. Three proposals were received from Tommy Klein Construction in the amount of $192,175; Talon/LPE in the amount of $399,000 and Plainview Construction Services in the amount of $159,780. Plainview Construction Services was ranked 1 with a score of 47.7; Tommy Klein Construction was ranked 2 with a score of 44.5; and Talon/LPE was ranked 3 with a score of 41.9. Staff recommends award to Plainview Construction Services. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to award bid for Civic Center renovation project to Plainview Construction Services in the amount of $159,780. The motion was duly seconded by Mayor Pro Tem Starnes and carried by unanimous vote. Mr. Freeman presented for consideration to authorize Mayor to sign Agreement between City of Plainview, Texas and KSA Engineers, Inc. for Professional Services for Travis Trussell Duck Pond Project. This is a Professional Services Agreement with KSA Engineers, Inc. to perform engineering related services for the Travis Trussell Duck Pond project. This will include design phase items such as field surveying, boundary surveying, establishing the scope of the project and preparing final drawings and specifications. KSA will also be responsible for preparing all bidding documents for the improvements. After a bid and contract is awarded for the work, KSA will handle general administration for the project's construction phase through to the project's completion. Mayor Pro Tem Starnes moved to authorize Mayor to sign Agreement between the City of Plainview, Texas and KSA Engineers. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Mr. Snyder presented for consideration to authorize Mayor to sign the Interlocal Agreement between the City of Plainview and South Plains Association of Govemments for the Business Park Project. South Plains Association of Governments (SPAG) will assist with the administrative, environmental and reporting requirements with the Economic Development Administration Public Works Construction Grant award the City received for the Business Park Project. Typically, the City has had our partners at SPAG handle the grant administration for projects since the City does not have a grant administrator on staff. The cost for SPAG to administer this project for the City is $50,000. Staff does recommend approval of the Interlocal Agreement with SPAG for Administrative Services. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to authorize Mayor to sign the Interlocal Agreement between the City of Plainview and South Plains Association of Governments for the Business Park Project for $50,000. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Mr. Snyder presented for consideration to authorize Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program between the City of Plainview and the Texas Department of Transportation TxDOT Project ID: MI 705PLNV. The Routine Airport Maintenance Program (RAMP) grant is designed to assist the airport sponsors in doing basic maintenance at its airport. This is a 50/50 State and local grant. This maintenance can include things such as routine maintenance/improvement of airport pavements, drainage, AWOS systems, approach aids, lighting systems, hangar maintenance, herbicide application, etc. The Plainview/Hale County Airport RAMP grant is for a total of $20,000 with the City and County's potential share being up to $10,000. Councilmember Williams moved to authorize Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program between the City of Plainview and the Texas Department of Transportation TxDOT Project ID: M1705PLNV. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Tim Crosswhite, Director of Public Works presented for consideration on first reading Ordinance No. 16-3637, an Ordinance of the City Council for the City of Plainview, Texas Amending the Plainview Code of Ordinances to Create Article 13.07 Sanitary Standards and Protection for Public Water Supplies of Chapter 13, Utilities, in Order to Establish the Rules and Regulations for Sanitation and Pollution Control; Providing for a Criminal Penalty, Class C Misdemeanor Not To Exceed Two Thousand Dollars ($2000.00) for Violation of the Code, Per State Law; Conflict of Laws; Effective Date; Severance Clause; Cumulativeness Clause; Conflicts Clause; and Providing Proper Notice of Open Meeting. City Council Minutes September 13, 2016 Page 3 of 4 On June 17, 2015, the City had an inspection from The Texas Commission on Environmental Quality (TCEQ) at the water treatment facility. The City failed to acquire sanitary control easements. This is to insure that none of the pollution hazards covered in the rules would be allowed to create a danger for the public water supply. The Ordinance would restrict the following within 50 ft.: • Septic tank or other tank used to hold or treat sewage • Livestock and feedlots • Sanitary or storm sewer The Ordinance would restrict the following within 150 ft.: • Improperly constructed or abandoned water well • Underground petroleum or chemical storage tank • Landfill or dump sites • Military and industrial facilities • Wastewater treatment plant or sewage wet well • Solid waste disposal sites • Any other potential hazards or contamination sources Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to accept Ordinance No. 16-3637 on first reading. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote.
