HomeMy WebLinkAbout09-22-2016 Council Minutes68 The City Council met on September 22, 2016 at 11:40 a.m., at the Plainview Convention Center, 2902 W. 4th Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:28 a.m. on September 19, 2016. Mayor Pro Tem Charles Starnes presided. Councilmembers present were: Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5 and Oliver Aldape-District 7. Mayor Wendell Dunlap and Councilmember John Gatica-District 6 were absent. Staff members present were: Jeffrey Snyder -City Manager, Leslie Schmidt -City Attorney, Andrew Freeman -Assistant City Manager, Ken Coughlin -Police Chief, Rusty Powers -Fire Chief, lsauro Gutierrez -Information Technology Manager, Sarianne Beversdorf-Director of Finance, Tim Crosswhite-Director of Public Works, and Belinda Hinojosa-City Secretary. News Media Present: Doug McDonough -Plainview Herald Mayor Pro Tem Starnes led in the Invocation. The Council granted an excused absence to Mayor Wendell Dunlap and Councilmember John Gatica. Jeffrey Snyder, City Manager presented for consideration on first reading Ordinance No. 16-3638, an Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2016 and Terminating September 30, 2017, and Making Such Appropriations for Each Department, Project and Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Mayor Pro Tem Starnes asked for public comment. There was no public comment. Councilmember Williams moved to adopt Ordinance No. 16-3638 on first reading. The motion was duly seconded by Councilmember Blackerby. Belinda Hinojosa, City Secretary asked for a record vote of the Council on the motion, with the Council voting as follows: Mayor Dunlap — Absent Mayor Pro Tem Starnes — Yes Councilmember Williams — Yes Councilmember Juarez — Yes Councilmember King — Yes Councilmember Blackerby- Yes Councilmember Gatica — Absent Councilmember Aldape — Yes The motion carried. Mr. Snyder presented for consideration an action to ratify the Property Tax Increase Reflected in the FY 2016-2017 Budget. Under Texas Local Government. Code 102.007, a City adopting a budget that raises more revenue from property taxes than the previous year is required to take a separate vote to ratify the property tax increase. City Council Minutes September 22, 2016 Page 1 of 3 The Proposed General Fund Budget for Fiscal Year 2017 includes a proposed property tax rate of $0.6288 per $100 valuation. The City's Effective Tax Rate was determined to be $0.6009 for FY2017 and the current Property Tax Rate for FY2017 is $62.88. Councilmember King moved to ratify the property tax increase reflected in the budget for Fiscal Year 2016-2017 Budget. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Mr. Snyder presented for consideration on first reading Ordinance No. 16-3639, an Ordinance For The City Of Plainview, Texas Setting The Tax Rate And Levying Municipal Ad Valorem Taxes For The Year 2016; Directing The Assessment And Collection Thereof; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; And Effective Date. This is the first reading of the Ordinance levying the property tax rate of $0.6288 per $100.00 valuation that is included in the budget. The City of Plainview property tax rate goes towards Maintenance and Operations only. There is no debt service for the General Fund. The Property Tax Rate included in the Budget for the Fiscal Year 2016-2017 is $0.6288. The Effective Tax Rate is $0.6009. The City Council set the maximum property tax rate that could be considered by the City at $.6500 per $100 valuation. This is the highest tax rate that could be adopted by the City Council. Mayor Pro Tem Starnes asked for public comment. There was no public comment. Councilmember Williams moved that the property tax rate be increased by the adoption of a tax rate of sixty-two and eighty-eight hundredths cents ($.6288), which is effectively a 4.64 percent increase in the tax rate. The motion was duly seconded by Councilmember King. Belinda Hinojosa, City Secretary asked for a record vote of the Council on the motion, with the Council voting as follows: Mayor Dunlap — Absent Mayor Pro Tem Starnes — Yes Councilmember Williams — Yes Councilmember Juarez — Yes Councilmember King — Yes Councilmember Blackerby- Yes Councilmember Gatica — Absent Councilmember Aldape — Yes The motion carried. Mr. Snyder presented for consideration on first reading Ordinance No. 16-3640, an Ordinance of the City of Plainview Amending Ordinance No. 15-3623 and Ordinance No. 16-3633 To Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (A) And (D) of the Plainview City Charter Allowing For Supplemental Appropriations in the 2015-2016 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. These are the budget amendments for the fiscal year. Mayor Pro Tem Starnes asked for public comment. There was no public comment. Councilmember Williams moved to adopt Ordinance No. 16-3640 on first reading. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. City Council Minutes September 22, 2016 Page 2 of 3 69 70 Mr. Snyder presented for consideration on first reading Ordinance No 16-3641, an Ordinance of the City of Plainview, Texas, Amending Chapter 13, "Utilities" of the Code of Ordinances of the City of Plainview, Texas; Cumulativeness Clause; Repealer; Severability Clause; And Effective Date. Staff is proposing a 5% increase in the conservation rate structure. This will generate approximately $85,000 in new revenue if water consumption patterns stay the same. In addition to some of the educational and information brochures, pricing is one of the other tools utilized by cities to encourage water conservation. Mayor Pro Tem Starnes asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No.16-3641 on first reading. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. The Council and staff reviewed the agenda for the City Council meeting of September 27, 2016. There being no further business, Mayor Pro Tem Starnes adjourned the meeting at 12:43 P.m.
