ORDINANCE AMEN DMENT -
ORDINANCE NO. 05-3438
AN ORDINANCE AMENDING CHAPTER 14, LIBRARY, OF THE CITY
OF PLAINVIEW CODE OF ORDINANCES, CUMULATIVENESS
CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE, AND
EFFECTIVE DATE.
WHEREAS, Chapter 14, sets the fees and/or fines that are assessed for services
provided by the Unger Memorial; Library; and
WHEREAS, from time to time it is advisable to review the ordinances that set
fees and/or fines assessed for services within the City of Plainview; and
WHEREAS, the Unger Memorial Library Board has made recommendations on
adoption of new fees and/or fines for services provided; and
WHEREAS, the proposed fees and/or fines for services herein after made has
been duly presented to the City Council; and
WHEREAS, the City Council of the City of Plainview finds that it would not be
detrimental or injurious to the public health, safety or general welfare of the citizens of
the City of Plainview:
NOW, THEREFORE, The City of Plainview Hereby Ordains That:
SECTION I
Sec. 14-3. Fees is amended as follows:
The following fees and/or fines will be assessed for the services listed:
Overdue Materials:
10¢ per day (books or audio) maximum $5.00 $10.00 or half
the value of the item whichever is less.
10¢ per day (periodicals)
$1.00 per day (videos) maximum $10.00 or half the value of
the item whichever is less.
Lost materials will incur a charge of the listed retail price of the item plus a $5.00
processing fee. Patrons returning previously lost materials which were paid for,
along with the receipt, within 3 months of the original due date will be reimbursed
the original cost of the item less the processing fee. Lost materials remain the
property of the City of Plainview.

SECTION II
All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict
herewith, are hereby amended to conform with the provisions hereof.
SECTION III
Should any section, subsection, or any portion hereof be deemed invalid for any reason,
such holding shall not render or invalidate any other section, subsection, sentence,
provision., clause, phrase or word severable therefrom and the same shall be deemed
severable for this purpose.
SECTION IV
This ordinance shall be of full force and effect upon its passage and publication as
required by law.

PASSED AND APPROVED on second reading this 25th day of January, 2005.
