HomeMy WebLinkAboutOrd 75-1797ORDINANCE NO. 75- /~f AN ORDINANCE CALLING Al~ ORDERING A RUN-OFF ELECTION IN AND FOR THE CITY OF PLAINV!EW TO BE HELD ON THE SECOND TUESDAY IN StAY OF 1975, THE SAME BEING THE 13TH DAY OF MAY, 1975, AS THE DATE FOR A RUN-OFF ELECTION BETWEEN THE TWO CANDIDATES WHO RECEIVED IN THE REGULAR MUNICIPAL ELECTION HELD ON THE FIRST TUESDAY IN APRIL, 1975, THE HIGHEST NUMBER OF VOTES FOR PLACE FOUR ON THE CITY COUNCIL, SAID OFFICE TO BE FILLED BEING ALDERMAN FOR PLACE FOUR ON THE CITY COUNCIL OF THE CITY OF PLAINVIEW; DESIGNATING THE PLACES WHERE SAID ELECTION IS TO BE HELD; AND APPOINTING PRESIDING OFFICIALS THEREOF. Whereas, at the regular election held in and for the City of Plainview for the election of officers, there were 1,714 votes cast for the election of Alderman for Place Four on the City Council of the City of Plainview; and WHEREAS, after a can~as~ of the ~oteg hast at.said~City election the Council has found that none of the candidates for said place received a majority of all of the votes cast for said office at said election, and that at such election the two candidates receiving the highest number of votes are Richard E. (Dick) Cross and Tom Almon, and that therefore it is necessary to call and conduct a run-off election between said candidates, Richard E. (Dick) Cross and Tom Almon for the purpose ob electing Alderman for Place Four on the City Council of the City of Plainview; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVI~4: SECTION 1: In accordance with the Statutes provided and the Charter of the City of Plainview, a run-off election shall be held in and for the City of Plainview on the second Tuesday in May, 1975, the same being the 13th day of said month, for the purpose of conducting a run-off election between Richard E. (Dick) Cross and Tom Almon, the two candidates receiving the highest number' of votes for Alderman for Place Four on the City Council of the City of Plainview at the regular election of said City for the election of officers held oni~the~lst Tuesda~ini~.Aprii,~ 1R~either of them having received a majority of the votes cast for said office at said election. SECTION 2: The City Council of the City of Plainview finds that said candidate Richard E. (Dick) Cross and that said candidate Tom Almon received the highest number of votes of all of the candidates for said office at said election, but that neither of them received a majority of the votes, and therefore it is necessary to call a run-off election to comply with the Charter of the City of Plainview and the Statutes of the State of Texas. SECTION 3: That said election shall be held in each of the election precincts within the City of Plainview and at the designated polling places within each precinct as provided in Ordinance No. 75-1759, of the City of Plainview. SECTION 4: That the Municip.~al Court Building, 902 North Austin Street, Plainview, Texas, is hereby designated as the polling place within Precinct No. 1 of the City of Plainview. That the City of Plainview, Texas, Chamber of Commerce and Board of City Development Building located at 710 West 5th Street, in.Plainview, Texas, is hereby designated as the polling place for Precinct 2~ SECTION 5: All qualified electors shall vote in the election precinct in which they reside. SECTION 6: Said election shall be conducted by the following who are hereby appointed to hold said election: 1. Mark Turnbough 2. Steve Hurt 3. Mrs~ Martha Barnes Mark ~Turnbough shall act as Presiding Judge of the election. PRECINCT 1 Mr. Steve Hurt, Mrs. Jack Ford, and Mrs. Guy Manges are hereby appointed as the election officials of Precinct 1. Mr. Steve Hurt shall act as Presiding Judge of Precinct 1; and Mrs. Jack Ford and Mrs. Guy Manges shall act as clerks of the election. Mrs. Jack Ford is hereby appointed first alternate judge to act as Presiding Judge for Precinct 1 in the event that Mr. Steve Hurt is for any reason unable to serve as such Presiding Judge; and Mrs. Guy Manges is hereby appointed second alternate judge to serve as Presiding Judge -2- of Precinct 1 in the event that both Mr. Steve Hurt and Mrs. Jack Ford are for any reason unable to serve as such Presiding Judge. The Presiding Judge of said precinct may appoint such additional clerks as ~he may deem necessary to hold the election. PRECINCT 2 Mrs. Martha Barnes, Mrs. Bob Wayland, and Mrs. Grafton McInnish are hereby appointed as the election officials of Precinct 2. Mrs. Martha Barnes shall act as Presiding Judge of Precinct 2; and Mrs. Bob Wayland and Mrs. Grafton Mclnnish shall act as clerks for the election. Mrs. Bob Wayland is hereby appointed first alternate judge to act as Presiding Judge of Precinct 2 in the event that Mrs. Martha Barnes is for any reason unable to serve as such Presiding Judge; and Mrs. Grafton McInnish is hereby appointed second alternate judge to act as Presiding Judge of Precinct 2 in the event that both Mrs. Martha Barnes and Mrs. Bob Wayland are for any reason unable to serve as such Presiding Judge. SECTION 7: This election is called pursuant to the Charter of the City of Plainview and the Statutes of the State of Texas as a run-off election between candidates Richard E. (Dick) Cross and Tom Almon, who are the candidates for Alderman, Place Four of the City of Plainview, they receiving the most votes for said office at the regular city election held in and for the City of Plainview on the 1st Tuesday in April, and neither of said candidates having received a majority of the votes cast for said office at said election. SECTION 8: Said election shall be held under and in accordance with the provisions of the Statutes of the State of Texas and the Charter of the City of Plainview and all persons qualified to vote in said City under the Election Laws of the State of Texas shall be allowed to vote therein. Said election shall be held and the polls shall be open from 8:00 A.M. to 7:00 P'~M., and all electors shall vote in the voting precinct in which said voter resides and at the place provided for voting in said voting precinct, as provided in Ordinance No. 75-1759 of the City of Plainview. -3- SECTION 9: Notice of said election shall be given by posting and by publication of a copy of this Ordinance, and at the top of which shall appear the words "Notice of Run-Off Election for the Purpose of Electing an Alderman for Place Four on the City Council of the City of Plainview". Thirty days' previous notice of said election shall be given by posting a copy of this Ordinance in three (3) public places in said City of Plainview in each of the voting precincts provided for in Ordinance No. 75-1759 of the City of Plainview, Texas, one of which notices shall be posted at the polling place designated for City Election Precinct 1 and one of which shall be posted at the polling place designated for City Election Precinct 2. Notice by publication shall also be made by publishing notice of said election in the Plainview Daily Herald (a newspaper of general circulation in Plainview, Texas), said publication to be not more than twenty-five (25) days nor less than ten (10) days prior to the election. SECTION 10: A copy of this Ordinance shall also be served upon each of the three election officials who have been designated to hold the election. SECTION 11: The fact that the Run-off election above mentioned must be called immediately in order that proper notice and posting may be given prior to election date, constitutes and creates an emergency and an urgent public necessity, requiring that any rule providing for ordinances to be read and voted upon at more than one meeting of the City Council be suspended, and requiring that this ordinance be passed and take effect as an emergency measure, and such rules and provisions are accordingly suspended, and this ordinance is passed as an emergency measure, and shall take effect and be in full force from and after its passage. THE STATE OF TEXAS COUNTY OF HALE CITY OF PLAINVIEW On this the 3rd day of April, 1975, the City Council of the City of Plainview, Texas, convened in special session at the regular meeting place thereof in the City Hall, the meeting being open to the public and notice of said meeting have been given as prescribed by Article 6252-17, Section 3A, V.A.T.C.S., there being present and in attendance the following members, to-wit: JOHN D. The ordinance was read in full. Alderman ARR!_ aml made a motion that any rule re- quiring ordinances to be read more than one time or at more than one meeting be suspended. The motion was seconded by Alderman C/9;~;~/~ and earried by the following vote: YEAS: Aldermen Garrison, Carpenter, ~, Cross and Williams. NAYS: None. Alderman ~/~/~ ~ then made a motion that the ordinance be passed finally. The Motion Was seconded.!'by Alrderman ~AP~z~_Mj--/~ and carried by the following vote: YEAS: Aldermen Garrison, Carpenter, ~, Cross and Williams. NAYS: None. The Mayor announced that the ordinance had been finally passed. The ORDINANCE is as follows: NOTICE OF RUN-OFF ELECTION FOR THE PURPOSE OF ELECTING AN ALDERMAN FOR PLACE 4 ON THE CITY COUNCIL OF THE CITY OF PLAINVIEW Notice is hereby given of a Run-.off election to be held in and for the City of Plainview on the 2nd Tuesday in May, 1975, the same being the 13th of May, 1975, for the election of an Alderman for Place 4 on the City Council of the City of Plainview.
