HomeMy WebLinkAboutOrd 75-1833 FIRE CODE ORDINANCE NO. 75-1833 AN ORDINANCE OF THE CITY OF PLAINVIEW REGULATING AND CONTROLL- ING THE MAINTENANCE OF BUILDINGS AND PREMISES; TO SAFEGUARD LIFE, HEALTH, PROPERTY AND PUBLIC WELFARE BY REGULATING THE STORAGE, USE AND HANDLING OF DANGEROUS AND HAZARDOUg MATERIALS, SUBSTANCES AND PROCESSES, AND BY REGULAT- ING THE MAINTENANCES O~ ADEQUATE EGRESS FACILITIES, PROVIDING FOR THE RE- PEALING OF ORDINANCE NO. 71-1161 OF CITY OF PLAINVIEW, ~P~0VIDING FOR ADOPTION OF THE UNIFORM FIRE CODE, 1973 EDITION, AS COPYRIGHTED IN 1973; THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS OF WHITTIER, CALIFORNIA, PROVIDING FOR CERTAIN AMENDMENTS THERETO; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; PROVIDING A SEVERABILITY CLAUSE; DIRECTING PUBLICATION OF THE DESCRIPTIVE CAPTION OF THIS ORDINANCE TOGETHER WITH THE PENALTY PROVISIONS, AND PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Plainview finds that the present Fire Code of the City of Plainview is inadequate to properly pro- tect the public health, safety., and welfare of the citizens of the City of Plainview and their property, from loss due to fire, and WHEREAS, the City Council of the City of Plainview finds that Uniform Fire Code, 1973 Edition, as copyrighted in 1973 by the International Conference of Building Offices of Whittier, California, with certain amend- ments thereto, should be adopted for the protection of the citizens of the City of Plainview, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1. That the 1970 Edition of the Fire Prevention Code as recommended by the American Insurance Association (being Ordinance No. 71-1161 of the City of Plainview) be and the same is hereby repealed. SECTION 2. That the 1973 Edition of the Uniform Fire Code, 1973 Edition, as copyrighted in 1973 by the International Conference of Building Officials of Whittier, California, as hereinafter amended is specifically adopted as the Fire Code of the City of Plainview, Texas, and a copy is attached here- to and incorporated herein by reference as though set out completely in detail. A copy of said Uniform Fire Code shall be filed with the City Secretary and a copy maintained in the office of the Fire Marshal of the City of Plainvie~, Texas. Ail such copies to be open to public inspection during business hours of the office where they are maintained, with the following amendments thereto: SECTION 3. That article 1, Division 11, Section 1.216 of the Uniform Fire Code, 1973 Edition, shall be and the same is hereby amended by adding to the list of reconized Standards as part of the list. "Life Safety Code, N.F.P.A. 101 as copyrighted by National Fire Prevention Association. SECTION 4. That Article 1, Division 111, Section 1.301 of the Uniform Fire Code, 1973 Edition, shall be and the same is hereby amended by deleting requirements for permits. No permit shall be required, when referred to in the Code. SECTION 5. That Article 1, Division IV, Section 1.403 of the Uniform Fire Code, 1973 Edition, shall be and the same is hereby amended to read as follows: When reference to the Uniform Plumbing Code is made, it shall mean the City of Plainview Plumbing Code, as adopted by Ordinance No. 73-1366. When reference is made to the Uniform Mechanical Code, it shall be deleted. SECTION 6. That Article 1, Division 11, of the Uniform Fire Code, 1973 Edition, is hereby amended by adding thereto a section to be known as Section 1.218 which said ection shall read as follows: That th is here~ distric~ as Fire such te~ fol 1 ows: ZONE Chapter ZONE 2 metes entire incorporated area of the City of Plainview y declared to be and is hereby established as a fire , and said fire district shall be known and designated Zone 1, 2, and 3, and each such zone shall include ritory and portions of the City of Plainview as shall include the territory as set out and described and bounds as Zone 1 under Section 1, Article 1, of 16 of "The Code of the City of Plainview, Texas, 1957". shall incl.ude the territory as set out and described by d bounds as Zone 2 under Section 1, Article 1, of Chapter 16 of the "Code of the City of Plainview, Texas, 1957". It shall also include all commercial property and buildings now existing, and all property that may be zoned for commercial use. Zone 3 shall include all the area not set out in Zone 1 and Zone 2. SECTION 7. That ~rtiCle 15, Division 11, Section 15.201, of the Uni"form Fire Code, 1973 EditiOn, shall be and the same is hereby amended to read as follows: The limits in which storage of flammable liquids in outside above ground tanks is prohibited, are hereby established as follows: A. Bo The limits in which new bulk plants for flammable or com- bustible liquids are prohibited are those zones in the City of Plainview where such bulk plants are not permitted by Ordinance No. 794 same being the Zoning Ordinance of the. City of Plainview as amended. SECTION 8. PENALTIES: Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, combined, or permitted, and upon the conviction of any such violation such person shall be punishable by a fine of not more than $200.00. SECTION 9. SEVERABILITY CLAUSE: If any provisions of this Ordinance or of the Code hereby adopted or the application thereof to any person or circumstance is held invalid, the remainder of the code and the application of such provisions to other persons or circumstances, shall not be affected hereby. SECTION 10. The City Secretary is hereby authorized and directed to cause the publication of the descriptive Caption of this 0rdiance to- gether with the penalty provisions as provided herein. This Ordinance shall become effectige after its passage and publication as required by law.
