HomeMy WebLinkAboutOrd 75-1852ORDINANCE NO. 75-1852 AN ORDINANCE PRESCRIBING THE SPEED LIMIT ON SH 194, DIMMITT ROAD NORTHWEST AND qUINCY STREET, IN THE CITY OF PLAINVIEW, TEXAS, AT LOCATIONS HEREINAFTER DESIGNATED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRESCRIBING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; AND CREATING AN EMERGENCY. WHEREAS, after an engineering and traffic investigation, the City Council of the City of Plainview finds that circumstances are such that the maximum reasonable and safe speed for operation of vehicles under conditions found to exist on SH 194, Dimmitt Road Northwest and Quincy Street, within the City Limits of Plainview is as described by City Ordinance hereinafter enacted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1: The speed limit on SH 194, Dimmitt Road Northwest and Quincy Street, at iocations hereinafter designated shall be as follows: (a) The maximum legal speed limit on SH 194, Dimmitt Road Northwest and Quincy Street, for traffic bound southerly only shall be S5 MPH from the point of intersection with the Northwest City Limit, a point 0.007 mile northwesterly from the intersection with the centerline of Eanyon Street, to a point 0.169 mile southeasterly from the point of intersection with the centerline of Yonkers Street, a distance of 0.437 mile; thence 50 MPH for a distance of 0.250 mile to the point of intersection with the centerline of West 24th Street; thence 45 MPH for a distance of 0.220 mile; thence 40 MPH for a distance of 0.296 mile to the ~oint of ~ntersection with the centerline of West 17th Street; thence 35 MPH for a distance of 0.386 mile to the point of intersection with the centerline of West 12th Street; thence 30 MPH for a distance of 0~610 mile to the point of intersection with the centerline of US 70, West 5th Street. (b) The maximum legal speed limit on SH 194, Quincy Street and Dimmitt Road Northwest, for traffic bound northerly only shall be 30 MPH from the point of intersection with the centerline of US 70, West 5th Street, to the point of intersection with the centerline of West 12th Street, a distance of 0.610 mile; thence 35 MPH for a distance of 0.452 mile to the point of intersection with the centertine of West 18th Street; thence 40 MPH for a distance of 0.250 mile; thence 45 MPH for a distance of 0.250 mile to a point 0.050 mile northwesterly from the point of inter- section with the centerline of West 24th Street; thence 55 MPH for a distance of 0.437 mile to the point of intersection with the Northwest City Limit, a point 0.007 mile northwesterly from the point of inter- section with the centerline of Canyon Street° SECTION 2: The symbol "MPH" as used in this ordinance is a symbol .for and means "Miles Per Hour~" SECTION 3: Notwithstanding that portion of Quincy Street between 15th' Street and 14th Street is hereby declared to be a school zone, and the maximum legal speed on said portions of Quincy Street shall be 20 MPH effective only during the houms that the school children are going to and from the school, those hours marked by flashing beacon mounted above the speed limit sign. At all other times the set speed limit on said portions of Quincy Street between 15th Street and 14th Street as herein designated to be a school zone shall be as provided in Section 1 (a) and (b) of this ordinance. SECTION 4: It shall be unlawful for any person to operate a motor vehicle which is self-propelled, automobile or motorcycle on the above designated por- tion of Quincy Street and Dimmitt Road Northwest in the City of Plainview, at a speed greater than that'~hich is hereina~ove designated in Section 1 (a) and (b) and Section 3 of this ordinance as the maximum speed limit. SECTION 5: Ordinance No. 68-1006 is hereby repealed. SECTION 6: Any person who shall violate or fail to comply with the pro- visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than $1.00 and not more than $200.00.
