HomeMy WebLinkAbout01-3283ZONING ORDINANCE - Zone Case 699 (Alley Closure) ORDINANCE NO. 01-3283 AN ORDINANCE AMENDING THE ZON1NG MAP OF THE CITY OF PLAINVIEW, TEXAS, FOR CLOSING OF THE ALLEY LOCATED BETWEEN LOT 14 AND LOTS 1, 2, AND 3, BLOCK 47, COLLEGE HILL ADDITION TO THE TOWN OF PLAINVIEW, HALE COUNTY, TEXAS; CUMULATIVENESS CLAUSE; CONFLICT CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth in Section 5 the requirements for amending the zoning map of the City of Plainview, Texas; and WHEREAS, Wayland Baptist University has petitioned the City of Plainview to close the alley located between Lot 14 and Lots 1, 2, and 3, Block 47, College Hill Addition to the Town of Plainview, Hale County, Texas; and WHEREAS, said hearing was held in the Council Chambers of City Hall, Plainview, Texas, at which time persons appeared in support of or against said proposal; and WHEREAS, the proposed alley closure, as hereinafter made, has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council; and WHEREAS, it was determined by the City Council that this alley closure would not be detrimental or injurious to the public health, safety or general welfare, or otherwise offensive to the neighborhood, said closure shall be in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, the City of Plainview hereby ordains: Section I The request of Wayland Baptist University for the closing of the alley located between Lot 14 and Lots 1, 2, and 3, Block 47, College Hill Addition to the Town of Plainview, Hale County, Texas, is approved. Ordinance No. 01-3283 WBU Alley Closure between Smythe & Travis Streets Page 1 of 2 19 Section II Provisions of this Ordinance are cumulative and nothing herein shall prevent, alter or diminish the applicability or enforcement of other Ordinances restricting, regulating or governing the subject matter herein. Section III All Ordinances or portions of any Ordinance of the City of Plainview, Texas, in conflict herewith, are hereby amended to conform with the provision hereof. Section IV If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section V This Ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 22nd day of February, 2001.
