AN ORDINANCE AMENDING SECTION 10 OF ARTICLE IV OF CHAPTER 4 OF
"THE CODE OF THE CITY OF PLAINVIEW, TEXAS, 1957", AND PROVIDING
THAT IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION TO
KEEP OR MAINTAIN FOR ANY LENGTH OF TIME WHATEVER, A COW, HORSE,
MULE, SHEEP OR GOAT, MEANING ONE OR MORE, WITHIN THE CITY LIMITS
OF THE CITY OF PLAINVIEW, WHERE SAID COW, HORSE OR HORSES, MULE
OR MULES, SHEEP, GOAT OR GOATS ARE KEPT AND _MAINTAINED WITHIN TWO
HUNDRED FEET OF ANY RESIDENCE OR OTHER BUILDING OCCUPIED AND USED
BY INDIVIDUALS OR CORPORATIONS; AND PROVIDING A NEW PENALTY FOR
THE VIOLATION OF SAID ORDINANCE AND ACTS PROHIBITED THEREBY AS
AMENDED; AND REPEALING SECTION 11 OF ARTICLE IV, CHAPTER 4 OF
"THE CODE OF THE CITY OF PLAINVIEW, TEXAS, 1957"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION 1. Section 10 of Article IV, Chapter 4, of "The Code
of the City of Plainview, Texas, 1957" is hereby amended to read
as follows:
"It shall be unlawful for any person, firm or corporation
to keep or maintain for any length of time whatever, a cow,
horse, mule, sheep or goat, meaning one or more, within the
city limits of the City of Plainview, where said cow, horse
or horses, mule or mules, sheep, goat or goats, are kept and
maintained within two hundred feet of any residence or other
building occupied and used by individuals or corporations."
SECTION 2. Any person who shall violate or fail to comply with
this ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine not exceeding $200.00, and any person
who shall aid, abet, or assist in the violation of any provision of this
ordinance shall be deemed guilty of a misdemeanor and upon conviction ~
thereof shall be punished by a fine not exceedihg $200.00.
SECTION 3. Section 11 of Article IV, Chapter 4 of "The Code of
the City of Plainview, ~Texas, 1957" is hereby repealed.
