R17-383 A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF PLAINVIEW, TEXAS, TO EXERCISE ITS OPTION AUTHORIZED BY SECTION 34.05 OF THE TEXAS TAX CODE TO RESELL PROPERTY WHICH HAS PREVIOUSLY BEEN STRUCK OFF TO THE CITY OF PLAINVIEW. WHEREAS, the City of Plainview, Texas is a taxing unit to which properties were "struck off" for nonpayment of ad valorem taxes and took title to such properties with all other taxing entities; and WHEREAS, because these properties are owned jointly with the other taxing entities and are not considered surplus real property for the City, the City is allowed to resell this "struck off' property in accordance with the Texas Tax Code at Section 34.05; and WHEREAS, the City Council desires to exercise their option to resell such properties and return them to the active tax roll; and WHEREAS, to comply with Section 34.05 of the Texas Tax Code, the City will notify each of the taxing entities requesting their approval of the sale; and WHEREAS, the City will receive bids in the bid process to sell the attached properties hereto designated as Exhibit "A" and incorporated herein for all purposes; and WHEREAS, the City Council further finds that it is in the best interests of the City of Plainview to authorize the resell of the attached list of taxing entity properties and return them to the active tax roll. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview that: The findings and declarations contained in the preambles of this Resolution are incorporated herein as part of this Resolution. The City of Plainview hereby elects to sell the attached list of taxing entity properties designated as Exhibit "A," incorporated herein for all purposes, and receive bids for such property in compliance with Section 34.05 of the Texas Tax Code. R17-383 Sale of Tax Sale Properties Page 1 463 464 In compliance with Section 34.05 of the Texas Tax Code, the City will notify each of the taxing entities and request their approval of the sale of such attached list of properties. Once the City receives approval from all taxing entities, then the City will receive bids for such property. IV. This Resolution's public purpose is for the City to exercise its option to resell the attached properties, request the approval of other taxing entities to do the same, and return these properties to an active tax roll. V. This resolution shall take effect immediately from and after its adoption. Passed and approved this 14th day of February, 2017.
