Board Members Absent: Jerry Rodriguez, Paul Drager, Rick Burke, and Janice Payne Staff Members Present: Cris Valverde, Community Development Director, Judy Rasher — Community Services Secretary Others Present: Brandy Luna. Chris LeFevre called the meeting to order at 6:00 p.m. First Item on Agenda: Approval of May 12, 2016 minutes. Mark Hardin made a motion for approval. Danny Murphree seconded and motion carried unanimously. Second Item on Agenda: Case No. 863/Z -16 -02 — Consider a request of Brandy Luna, for a Specific Use Permit, to operate a daycare in a Multi Family District 1 (MF -1), said parcel being Block 28, Lot 10 of the Highland Addition. Vicinity being W 11 Street and Denver Street, City of Plainview, Hale County, Texas. Cris Valverde presented a request to convert an existing building into a daycare center. The building is approximately 2,500 square feet. The current zoning of Multi- Family District 1 does not allow for a daycare, but the zoning does allow said use via a specific use permit (SUP). The building was used as an assistant living facility in the recent past. Ms. Luna has submitted development standards via the SUP site plan that include installing a fence from the rear of the building, along the side lot line to the alley and along the north property line. The purpose of the fence is separate the alley and to provide a visual barrier from the adjacent duplexes. The fence will also act as a noise and visual buffer. This will also sepearate traffic from the duplexes driving through the alley and the traffic created by the day care. . Per state law, Ms. Luna is required to have 80 square feet per child that is going to be outside at any one time. Ms. Luna stated that she will not have more than 10 children outside at one time. This area will be fenced in with a four foot fence. Ms. Luna will have more than enough square feet to maintain the minimum required by state law. 22 Letters were sent out to the property owners within 200 feet, received two responses in favor. Staff recommends approval of the request as presented. Danny Murphree made a motion to open the public hearing. Kevin Sweeney seconded and motion carried unanimously. No response was made. Chris LeFevre asked if anyone would like to speak in favor. Brandy Luna came before the board. Ms. Luna has been licensed for 6 years as home daycare provider. Ms. Luna currently operates a daycare out of her home and meets the requirement by the State. Ms. Luna is only allowed to have 12 children in her home. She has a waiting list of clients and is looking to expand her business. Mark Hardin made a motion to close the public hearing. Seconded by Danny Murphree • 7nrl mntinn nn rriorl r -' 11+1.1 Il... C .. -_ r_ '---- -- ._ Third Item on Agenda: Case No. 861 — Consider a request by Teressa King, for a propose Plat of Plainview Vision, Unit No. 1, a Suburban Subdivision and addition to the City of Plainview, being an unplatted tract of land in Section 37, Block JK -2, 20.61 acres, Hale County, Texas.
