HomeMy WebLinkAboutCouncil Minutes 01-19-201798 The City Council met on January 19, 2017 at 11:50 a.m., at the Plainview Convention Center, 2902 W. 4th Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:00 a.m. on January 16, 2017. Mayor Wendell Dunlap presided. Councilmembers present were: Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, and Oliver Aldape-District 7. Mayor Pro Tem Charles Starnes and Councilmembers Susan Blackerby-District 5 and John Gatica-District 6 were absent. Staff members present were: Jeffrey Snyder -City Manager, Leslie Schmidt -City Attorney, Andrew Freeman -Assistant City Manager, Rusty Powers -Fire Chief, lsauro Gutierrez - Information Technology Manager, Cris Valverde -Community Development Manager, Paul Kite -Assistant Director of Utilities, Jimmy Collins -Streets Superintendent, Tim Crosswhite-Director of Public Works and Belinda Hinojosa-City Secretary. News Media Present: Doug McDonough -Plainview Herald Guests Present: Mike Fox, James Odom, Jason Wheeler, and Jake Owens Mayor Wendell Dunlap led in the invocation. The Council granted excused absences to Mayor Pro Tem Charles Starnes and Councilmember Susan Blackerby. Leslie Spear Schmidt, City Attorney presented for consideration Resolution R17-381, a Resolution of the City Council of the City of Plainview, Texas: Memorializing and Ratifying Prior Resolution No. R97-126 of December 9, 1997 Providing a Drug Free Zone for Givens Park; Providing Severability Clause; Providing a Savings Clause; and Providing an Effective Date. On December 9, 1997 the Council passed a Resolution declaring Givens Park a drug free zone. According to the Health and Safety Code we can designate those zones. At the time of the passing of this Resolution, the Council passed several resolutions. The Resolution has not been located and it is presenting a problem for drug enforcement. The boundaries have not changed, nor has there been any repeal of the 1,000 foot drug free zone. By creating this Resolution we are ratifying and memorializing what the City Council did back in 1997. The zone was created and still exists. Mayor asked for public comment. Mr. James Odom asked why all of Plainview was not a drug free zone. He was advised that statutes only allow certain areas. Councilmember Williams moved to adopt Resolution R17-381. The motion was seconded by Councilmember Juarez and carried by unanimous vote. Jeffrey Snyder, City Manager presented information on the Lower Running Water Draw Dam No. 4 Project Date. The Council and staff reviewed the agenda for the City Council meeting of January 24, 2017.
