PLANNING AND ZONING COMMISSION
MINUTES
SEPTEMBER 8, 1994
Meeting was called to order by Chairman, Robert Carter.
Commission members present were: Chairman, Robert Carter, Lynn Davis, Jim Graham,
Gary Stone, Frankie Carter, and Gene Hembree.
Staff member present was Muff London, Director of Community Development.
The minutes of the August 25, 1994, meeting were corrected to reflect that the vote on
the Final Plat of the Brock Addition, Unit No. 12, Plainview, Hale County Texas was: 4
in favor, 2 (Jim Graham and Lynn Davis) against and 1 (Frankie Carter) abstaining.
Zone Case 622: The request of Joe Bob McCart on behalf of Fields and Scott to rezone
approximately 2 acres out of the 63.649 acres West of 1 -27 on the east part of the west
half of Section 27, JK -2, Abstract 25 owned by Rex Ramsower and Section 27, JK -2,
Abstract 1437 owned by Higginbotham Bartlett Co. from a Commercial - 2 Zoning district
to a Commercial - 3 Zoning District with a Specific Use Permit for mini - storage units. The
case was presented by Muff London, Director of Community Development, with the use
of a video of the property and transparencies. Gene Hembree made a motion to open
a public hearing, seconded by Frankie Carter. Motion passed 6 - 0.
Chairman, Robert Carter asked for anyone in favor of the requested zone change to
come forward. Mr. John Jenkins of Amarillo came forward on behalf of Paul Fields and
Joe Bob McCart the developers requesting the change. Mr. Jenkins show pictures of a
Mini - Storage facility built by these developers in Amarillo. Gene Hembree asked the
location of the mini- storage units in Amarillo. Mr. Jenkins said they were at 34th and
Colter. Mr. Jenkins also explained that the facility was accessible 24 hours a day through
a key pad entrance system. Chairman, Robert Carter asked for anyone against the
requested zone change to come forward. There was no one. Frankie Carter made a
motion to close the public hearing, seconded by Gary Stone. Motion passed 6 - 0.
Jim Graham asked if there would be truck rental from the facility. Mr. Jenkins said yes.
Lynn Davis expressed concern for the multi - family development to the west and asked
it the buiiding would be solid and how many units there would be. Mr. Jenkins said 230
units would be built. Robert Carter stated something about a vote on Zoning Ordinance
7 years ago. Something about no value within the developed area and that non -
conforming uses makes this document worthless. He also stated that most of the time
the commission gives variances to land already developed. The only place the ordinance
has use is vacant areas, now we are trying to use the ordinance to develop. Mr. Carter
said he \" "as concerned about keeping continuity in the use along Interstate 27. He stated

that multi- family development may not occur in the area because of this use because of
noise from traffic in and out of the facility.
Robert Carter questioned how the facility would be maintained. Paul Field stated that the
area would be lit up like a football field. Mr. Jenkins pictures showed the lighting at the
other facility. The lights will be directed away from the R -1 and MF -1 areas. He also
stated that native trees and grass would be used in landscaping with controlled access
from 11:00 p.m. till 6:00 a.m. Rental trucks will be stored in front for no more than 24
hours, meeting current regulations. Gene Hembree body made a motion to approve the
request of Joe Bob McCart on behalf of Fields and Scott to rezone approximately 2 acres
out of the 63.649 acres West of 1 -27 on the east part of the west half of section 27, JK -2,
Abstract 25 owned by Rex Ramsower and Section 27, JK -2, Abstract 1437 owned by
Higginbotham Bartlett Co. from a Commercial -2 Zoning district to a Commercial -3 Zoning
District with a specific Use Permit for mini - storage units with the stipulations that the west
side of the property have native trees and grass; rental trucks not be stored more that 24
hours as a time in front of property area; lights be directed away from MF or R zones
and; and limited access to control area from 11 p.m. till 6 a.m. Frankie Carter seconded,
motion passed 4 - 2 with Gary Stone and Robert Carter opposing.
The meeting was adjourned.
