HomeMy WebLinkAbout02.13.1997 MINUTES PLANNING AND ZONING COMMISSION MINUTES FEBRUARY 13, 1997 The meeting was called to order by Chairman, Robert Carter. Commission Members Present: Chairman, Robert Carter, Brandon Brownlee, Peter Moll, Ingrid Graves and Frankie Carter. Staff Members Present: John Castro, Director of Community Development, Ches Carthel, Director of Public Works. Others Present: Maurice Hastey, Roland Asebedo, Ronnie Shackleford, and Lance Franklin. Brandon Brownlee made a motion to approve the corrected minutes, seconded by Frankie Carter. Motion passed 5 - 0. Ches Carthel presented the request of Maurice Hastey for the exemption of platting requirements at his homestead of 3200 N Columbia. Mr. Hastey plans to build a storage shed on the land, however it has not been platted and he is unable to get a building permit until he plats the land or receives an exemption from the Planning and Zoning Commission. Mr. Carthel showed the Commission a map of the area. Mr. Hastey said the size of the storage shed will be 14 x 24. Robert Carter said that the exemption should be conditional to the one building. Mr. Hastey said the 2 acres were part of a 63 acre farm that was incorporated into the City of Plainview about 15 years ago. He made a commitment to plat at that time. Mr. Hastey said at that meeting, the Mayor failed to say he could do whatever he wanted out there. There are no plans to build other buildings. There are currently three other buildings on that area. Brandon Brownlee made a motion to approve Maurice Hastey's request for the exemption of platting requirements for the property at 3107 N Columbia with the conditon, it be limited to the building, and the request be sent to the City Council for further approval. Ingrid Graves seconded the motion. Motion passed 5 - 0. Ches Carthel presented the request of Roland Asebedo for the exemption of platting requirements at his property of 707 & 709 South Date which is also his residence. Mr. Asebedo plans to construct a workshop type building. Mr. Carthel presented a drawing of the area to the Commission. Ingrid Graves made a motion to approve Mr. Asebedo's request for exemption of platting requirements at his property of 707 & 709 South Date on the condition it be limited to the building and taken before the City Coucil, seconded by Peter Moll. Motion passed 5 - 0. DISCUSSION OF ANNEXATION John Castro handed out a numbered map of the areas for annexation. Mr. Castro said in 1994, the Planning and Zoning Commission recommended Area #1 as the highest priority which has already been annexed. Area #2 which is East 70 has also been annexed. Area #3 on Dimmitt Highway has not been annexed. Area # 4 south of Westgate and Area #5 the Industrial Corner of North of Business 87 have not been annexed. The northeast portion of Area #6 has been annexed, but the rest of the area has not been annexed. Area #7, the Industrial Boulevard, Area #8 west of Westridge Road and Area #9 which are divided by Highway 70 have not been annexed. Area #10 has also not been annexed. John Castro explained Ches Carthel's memorandum regarding "the maximum number of land which can be annexed is approximately 1,754 ". Mr. Castro explained the Municipal Laws manual says you can annex up to 10% of the current acreage per year, not to exceed 30% for two years. Nothing was annexed in 1996, so the Commission can annex 10 %. In 1995, 295 acres were annexed on East 70. Approximately 854 acres could have been annexed. In 1995, 660 acres were not annexed. If you take 10% for 1997 and 10% for 1996 it gives you 1,754 acres, which is the amount Ches Carthel figured out. If the 660 acres are added to 1,754, then the total amount which can be annexed for 1997 is 2,400 acres. John Castro referring to the maps said Area #1 is where Zip Fertilizer is located, Area #2 is the area south of Dimmitt Highway which has 48.3 acres. On the tables it shows the amount of acreage in the areas. Area #3, on Highway 70, has 274.3 acres. Area #4, the Prairie House has 156.5 acres. Area #5, the corner plus 500 ft along Westridge Road equals out to 123.4 acres. Area #6, takes in another 500 feet which totals at 800.6 acres. Area #7 is 500 feet on each side of 127 with 161.2 acres. Area #8, the airport, has 530.3 acres. Area # 9, Farm to Market, has 184.4 acres. Area #10 on 127 has 586.4 acres. Ches Carthel pointed out Area #4 and Area #5 were incorrectly drawn because some of those areas have been annexed. The map is incorrect, however, the calculations are correct. John Castro said the figures may change a little because the right of way was not counted in the calculations. Once the Commission is ready to give their priorities to the City Council, then the correct calculations will be figured. Robert Carter would like to know if it would be in the best interest of the city to include ZIP Industries. Mr. Carter asked if there are any figures of acreage with ZIP Industries omitted? John Castro said one of the major priorities is the area near Westridge because there have been requests from people building in that area to tie into city water. Some people have indicated they do not mind being annexed. Brandon Brownlee said there is much development in that area including Westridge Road (South) and it would be good to get the area to conform to city code. John Castro explained ETJ means the Extra Territorial Jurisdiction of the City. The City of Plainview has 1 mile jurisdiction outside of the city limits. The City can control the type of building going on there by law. The City can also annex up to the one mile. John Castro said the areas were broken down into smaller units, so the Appraisal District can give the appraisal values of the units. The code enforcement people will take the smaller units and see what houses are there. Mr. Castro said in order to annex an area, it must be broken down by appraisal, number of people living there, buildings that are there, and racial make up. They also have to go to the federal government and get permission to annex if it affects the overall racial make up of the city. If the areas are divided into smaller units, it makes it easier to go through the process. Robert Carter, said in previous work sessions, the Commission talked about annexing south down to the intersection. Ches Carthel did not have time to make those calculations, however he will figure the calculations and the area will be numbered as Area #11. Robert Carter said on Area #7, there are 1000 ft (500 ft of each side). Brandon Brownlee said the City would like to control any building in that area. Robert Carter said to run the calculations on Areas #3, #4, #5, #6, #7, and #11. Mr. Carter said Area #7 should be extended to the intersection. The corridor will give the city control of this area. Mr. Hastey presented his concerns for his area considered for annexation, saying he will be unable to sell Tots if the area is annexed. John Castro said if Mr. Hastey has already started a mobile home manufactured park in the area, then it will most likely be zoned as what is already there. Mr. Hastey raised a concern on not being able to do work on the mobile homes if the area is annexed. Mr. Hastey said this will require him to hire licensed workers and contractors which will be expensive. Brandon Brownlee said the main concern with the Texas Natural Resources is just the leaching lines on the septic system. Larry Franklin of 1505 N Westridge Road came forward and said they have made a commitment to live there. John Castro and Ches Carthel agreed the main area of priority is the corner of Westridge, Area #5. Robert Carter said he likes the idea of breaking the area down into units, but would like to be able to recommend more than one unit at a time. Brandon Brownlee would like to annex Area #7 and Area #11 for protection of the city. The corridor does not look bad and he would like to keep it that way. John Castro said first priority is given to Area #5. Ches Carthel said Area #5 only has 500 feet and the area may be extended to get 1,000 feet. Robert Carter suggested adding Area #6 to Area #5 and do them as one. Mr.Carter would like to recommend the corridor on Area #7 and Area #11 be given second priority. Mr. Carter would like to have a discussion of annexation next month and have Wally Hatch, City Attorney present. With no further business to discuss, the meeting was adjourned.
