MINUTES
SEPTEMBER 25, 1997
The meeting was called to order by Acting Chairman, Brandon Brownlee.
Commission Members Present: David Julian, Gene Hembree, Peter Moll, and Frankie
Carter.
Other present: David Hurt, Melody M. Rockwell, and Mr. Rockwell.
Staff Members present: John Castro, Director of Community Services.
Gene Hembree made a motion to approve the minutes of the last meeting, second by
Frankie Carter. Motion passed 5 -0.
First item on the agenda is Zone Case 645
The request of David Hurt to abandon and vacate a twenty (20) foot alley located
between Lot 93 and Lot 92, Westridge Park No. 3, Plainview, Hale County, Texas.
John Castro stepped forward to present PZ Case #645. Mr. and Mrs. Hurt would like to
vacate the alley between Lots 92 and 93. The city does not have a problem with the
request. There was one response from Bill LaFont and he felt it would improve the
neighborhood.
Frankie Carter makes a motion to open a public hearing. David Julian seconds the
motion. Motion passed 5 -0.
Rudd Owen, legal counsel for the property owners, David and Susan Hurt comes forward.
He explains that Mr. and Mrs. Hurt propose to close the alley between Lots 92 and 93.
The License to Encumber Public Right -of -Way was granted on June 12, 1997. This new
request will nullify the License to Encumber. Mr. Owen also presented letters from the
utility companies, Southwestern Public Service, Southwestern Bell Telephone, Energas
stating that these companies do not have a problem with the proposed alley
abandonment. Also, Melodie M. Rockwell of 319 Mesa Circle presented a letter that
consents to the alley abandonment. It was also discussed that Mr. and Mrs. Hurt had
discussed the alley closure with their neighbors and they had agreed to maintain or be
responsible for the upkeep of the alley and no utility easements were necessary.
Peter Moll made a motion to close public meeting. David Julian second the motion.
Gene Hembree made a motion to grant the request for alley abandonment between Lots
92 and 93.
Frankie Carter seconds the motion.
The motion passed unamiously 5 -0.
With no further business, the meeting adjourned.
