RESOLUTION NO. R17-384
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF THE ALZHEIMER'S
ASSOCIATION COMMITTEE TO HOST THE BLONDES VS. BRUNETTES
COLOR RUN; AUTHORIZING THE FILING OF THE AGREEMENT FOR
THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY WITH THE
TEXAS DEPARTMENT OF TRANSPORTATION FOR THIS EVENT;
DECLARING THAT THE EVENT SERVES A PUBLIC PURPOSE; AND
AGREEING TO COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates State
Highway 70 (5th Street) in the corporate limits of the City of Plainview; and
WHEREAS, the Alzheimer's Association Committee (Committee) desires to
sponsor in Plainview a Blondes vs. Brunettes Color Run to provide public awareness on
Alzheimer's disease; and
WHEREAS, the City of Plainview received a request on February 23, 2017 from
the Committee for police assistance in its event for Saturday, April 22, 2017 beginning at
8:00 a.m.; and
WHEREAS, the Committee's Blondes vs. Brunettes Color Run event will begin at
12th and Broadway (Santa Fe Depot) and then proceed until it crosses Highway 70 at
Ash and the return route will be crossing Highway 70 at Baltimore; and
WHEREAS, the City Council of the City of Plainview finds that such event serves
a public purpose in that it increases the public awareness in the importance of
Alzheimer's; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that the Alzheimer's Association Committee's
Blondes vs. Brunettes Color Run event be held this year on Saturday, April 22, 2017 and
use the above referenced routes; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of State Right -
of -Way for use of Highway 70 at the intersections of Broadway and Baltimore in such
public events as this Alzheimer's Association Committee run; and
WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or terminate such
Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainview that:

The request from the Alzheimer's Association Committee for their Blondes vs.
Brunettes Color Run is hereby approved.
The public purpose of this event is to increase the public awareness in the
importance of finding cures and assistance for those with Alzheimer's disease.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT-OF-WAY with the Texas Department of Transportation is hereby
approved.
IV.
The Mayor is hereby authorized and directed to execute, respectively, on behalf of
the City of Plainview, all necessary documents, including the AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY to complete the preparation
process for the Alzheimer's Association Committee's Blondes vs. Brunettes Color Run.
