Guests Present: T.D. McEachern, Rob Hamilton, J. W. Hamby, Jacob Masso, Larry Gould. First item on the agenda - Approval of November 10, 2016 Minutes. Gerardo Rodriguez made a motion to approve minutes as presented. Kevin Whisenant seconded the motion. Motion carried unanimously. Second item on the agenda — Case MH -17 -03 being a request to demolish structures located at 304 E Givens Street, Plainview, Texas, Hale County — review and take action. Jesse Lopez presented the case. The property is owned by the City of Plainview. This is a six multi- family structure located at 304 E Givens Street. The structures are vacant and are considered an attractive nuisance to the surrounding area. Of the six structures, one of the buildings has collapsed. The other five show signs of severe deterioration from neglect. The structures are dilapidated, have become so out of repair as to be dangerous, unsafe, insanitary and unfit for human habitation or occupancy. Staff is aware that three of the structures contain asbestos and would require minimal asbestos abatement. Because of the cost of the abatement and as the funds become available, the City will remove the structures in two phases. Staff makes the recommendation that the structures be demolished and all debris moved to the landfill. Motion was made by Kevin Whisenant and seconded by Gerardo Rodriguez. Motion carried unanimously. Third item on the agenda — Case MH -16 -09 being a request to demolish a structure located on Tax Parcel ID 28157, also known as the 1600 Block of Date Street, Plainview, Texas, Hale County — review and take action. Jesse Lopez presented the case. The property is privately owned. This property has been vacant for several years and was last used as a liquor store. The structure was struck by a vehicle and sustained moderate damage. The structure remains unsecured, missing doors and exterior siding. It is staff's opinion that continued deterioration could lead to structural failure and eventual collapse of the structure. A violation letter was mailed to property owner in October of 2016. To date, the property owner has not taken any action to remove, repair or demolish said structure. On March 16, 2017, staff was contacted by a representative of Capital One, who may have an interest in the property. The representative requested additional time for research and request that this case be tabled for a later date. A 45 day r,nrii,rJ is accnrsiatorI tniith ripmnlitinn nrrIem in which the violation can be Staff makes the recommendation that in an effort to not delay the case, staff would recommend a 60 -day period rather than a 45 day period should the Board approve the request. The Board's recommendation will be forwarded to City Council for final consideration. Atty. Rob Hamilton has agreed to the 60 day period if City Council approves the demolition of the structure. Staff has agreed to notify all parties of the next City Council meeting in April of 2017. Motion was made by Gerardo Rodriguez for a 60 day period rather than a 45 day period for demolition if City Council approves the demolition order. Seconded by Diane Bailey. Motion carried unanimously. Fourth item on the agenda — MH -16 -11 being a request to demolish a structure located at 107 E 6 Street, Plainview, Texas, Hale County — review and take action. Jesse Lopez presented this case. This is a commercial structure with a multi- tenant row building sharing a common wall with businesses on each side. This commercial structure was involved in a fire in December of 2015. The fire caused severe damage to the building, causing the roof to collapse and a portion of the south wall to collapse. A violation letter was mailed in March of 2016 to the owner to secure, remove or repair the structure. The City has had several conversations with the owner regarding the demolition of the structure. The owner stated several times that she would comply with the demolition of the structure. Because of the common walls, the City requested owner to have the demo contractor meet with the staff prior to demolition with a course of action. To date, owner have not complied with the requested actions. Atty Terry D. McEachern came forward before the board. He has his business next to 107 E 6 Street. Mr. McEachern is requesting that the City provide a week notice before demolition of 107 E 6 Cris Valverde has agreed to notify all parties prior to demolition of the structure. J. W. Hamby came forward before the board. He owns the property at 109 E 6 Street. He states the burnt structure has a common wall on both sides. Mr. Hamby would like reassurance from the City if they hire a contractor to tear down the burnt structure, the contractor is properly insured. Cris Valverde informed Mr. Hamby that the City does not require a contractor to be licensed and insured, but given the circumstances, the City would make the recommendation that the contractor provide insurance with the City prior to demolition. Mr. Hamby had concerns of the walls being exposed to the weather after the burnt structure is taken down. Will the contractor go in and weatherproof the walls or secure any holes in the walls. Cris Valverde stated that any holes or exposure to the walls after the demolition would be a private matter between the adjacent property owners. Jacob Masso came forward before the board. The common wall that he shares with 107 E 6 exceeds beyond his building. Is this going to be demolished or stay in tack with the building. Mr. Valverde stated that it would be part of the demolition. Motion was made by Kevin Whisenant that prior to demolition of 107 E 6 Street, the contractor provide a copy of a Surety document and Liability Insurance to the City. Seconded by Gerardo Rodriguez. Motion carried unanimously. No further business, meeting adjourned at 6:45 PM. �i I_
