ON THIS the 16th day of October, 1944, the City Coun- cil of the City of Plainview, Texas, convened in regular session, at the regular meeting place thereof in the City Hall, with the following members thereof, to wit: J.N.Jordan, E.M.0sborne, W.C.Malone, C.H.Hancock, L.M.Frogge, MAYOR, ALDERi?~.N, ALDERMAN, ALDE~N, ALDE~A~N, present, and the following absent: Ben F.Smith, constituting a quorum, when, among other proceedings had, were the following: Alderman Osborne in~re~uee~ a resolution and order and moved its adoption, The motion was seconded by Alderman Hancock. The motion, carrying with it the adoption of the res- and order, prevailed by the following vote: AYES: Aldermen Osborne, Hancock, Malone and Frogge. NOES: None. The Mayor announced the resolution and order adopted. The RESOLUTION AND ORDER IS AS FOLLOWS:- ELECTION RESOLUTION AND ORDER -RESOLUTIONAND ORDER by the City Council of the City of Plainview, TeXas, calling an election on the question of the issuance of bgnds for the purpose of acquiring and improving an airport for said City, and for the purpose of construction a~d improvement of the streets of said City, and ~he leMying of taxes in payment thereof." WHEREAS it-is cOnsidered to be to the best interest of the City that the bonds of the said:.city be issued for the purpose herein- after stated, and'that there is a necessity for the issuance of sai~ bonds, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAIN~ VIEW, TE~S: That an election be held in said City on the 3rd day of November, 194~, which date is not le~s than fifteen (15) nor more than thirty (30) days, from the adoption of this resolution and order, and at which election the following propositions shall be submitted to the~ qualified ~2ectors who own taxable properDy in said City, and who have duly rendered the same for taxation- i "SHALL the City Cluncil of the City of Plainview, Texas, be authorized to issue the general obligation bonds of said City in the a- mount of Fifty Thousand Dollars ($50,000.00), for the purpose of acquir- ing and improving an airport for said City, under authority of the con- stitution and laws of the State of Texas, particularly the Charter of the City of Plainview and Chapter 83 of the General Laws passed by the . Forty-first Legislature at its First Called session in 1929, as amended, maturing serially over a period of years no~ to exceed fifteen years, bearing interest at a rate not ex'ceeding TWO AND ONE-FOURTH PER CENTU~ (2-1/4%) per annum, payable semi-annually, and levy a tax on all taxable property situated within the said City, sufficient to ~pay the annual interest and provide a sinking fund to pay the said bonds at maturity. PROPOSITION NU~BER 2 "SHALL the City Council of the City of Plainview, Texas~be authorized to issue the general obligation bonds of said City in the am~ount of Fifty Thousand Dollars ($50,000.00), for the purpose of construction and improvement of the streets of said City, under authority of the constitution and laws of the State of Texas, particularly the Charter of the City of Plainview, maturing serially over a period of years not to exceed fif~teen (15) years, bearing in- terest at a rate ~o.t exceeding TWO ANI) ONE-FOURTH (2-1/4%) per annum, payable semi,annually, and levy a bax on all taxable property situa- ted within the said C~ty,~ sufficient 1~o pay the annual interest and provide a sinking fund to pay the said bonds at maturity. II. THat said~ election shall be held at the City Hall in the City of P~a~inview, TeXas, and the following named persons are hereby appointed o~ficers of the election, to wit: A. B. CoX, G. H. Saigling, E. T. Coleman, Presiding Judge, Assistant Judge, Clerk, Clerk, III. That said election shall be held under the provis- ions of and in accordance with the l~s governing the issuance of municipal bonds in cities, ~s provided in the General Laws of the State of Texas, and only resident, qualified taxpay~ng voters, who own taxable property in the City and who have duly rendered the same for taxation, shall be qualified to vote. IV. All voters who favor the proposition to issue the $50,000.00 bonds, for the purpose of acquiring and improving an airport for said City, shall have written or printed upon their b~llot~, the words: "FOR THE ISSUANCE 0F AIRPORT BONDS AND THE LEVYING OF A TAX IN PAY~ENT THEREOF." And, those opposed to issui~ the $50',000.00 bonds, for the purpose of acquiring and improving an airport for said City, shall have written or printed upon their ballots, the words: ~"AGAINST THE ISSU~NCE OF AIRPORT BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF." All voters who favor the proposition to issue the $50,000.00 bonds, for the purpose of construction and im- prow~ment of the streets of said City:, shall have written or printed 'upon their ballots, the words: "FOR THE ISSUANCE 0F STREET IMPROVEMENT BONDS AND THE LEVYING OF A TAX IN PAYMENT THERE OF. And, those opposed to :~ssuing the $50,000.00 bonds, for the purpose of construction and improvement of the streets of said City, shall have written or printed upon their ballots, the words: "AGAINST THE ISSUANCE OF STREET IMPROVEI~IENT BONDS AI~D THE LEVYING OF A T~X IN PAY~ENT Tt~EREOF ." V$ That a copy ~his resolution and order, signed by the Mayor of said City and y the .O2ty Secretary, shall serve aa proper notice of said election. VI. That said notice of said election shall be given by posting and publication of a copy of this resolution and order, at the top of which shall appear' the ~words, "NOTICE OF ELECTION FOR THE ISSUANCE OF BONDS." Said notice Shall be Posted in three pUblic places in.the City of Plainvfew. one of which shall be at the City Hall, not less than fourteen (14I days prior to the date on which said election'is to be held, and be p~uhtished on the same day in each of two success- ~Ve weeks in the Pi Herald, a newspaper of general cir- ~ulation in the City Texas, the first of said publica- tions ~e be made not less than fourteen (l~) days prior to the date set for said election.
