'488 , which deals with the collec- tion and disposition of garbage and-~sh within the city limit¢ of the City of Ptainview and also'fixed a charge for such service, as fully appears in said ordinance, ~o which reference is here made;and ~RE'AS, said ordinance has been in'full force and effect since its passage and the City of Piainview has been collecting and disposing of said garbage and trash mud collecting assessments for such service; and ¥~HEREAS, it is de~med proper and advisable to submit to the qualified voters of the City o~ Plainview the question of whether the City should assume'the responsibility of collecting garbage and trash ~vi2hin the city limits and to make a charge there- for. NO~?, TP~REFORE, T~ CITY COIT~JCIL OF T~ CiTY OF TEXAS, IN REGL~LAR SESSION, this wlst 'day of February, 1944, does hereby order an election be held on the question of whether the City should continue the collection of garbage and~ trash in said City and make a charge therefor, and that said election shall be held conDemporaneous!y with the election of officers for said City on the Sth day of April, 1944, and t_bat a separate ballot shall be prepared and said ballot shall contain the following questions: "FOR: The City of Plair~view collecting garbage and trash, and making a charge therefor?~, "AGAINST: The City of Piainview collecting garbage and trash and making a charge therefor?'' That the election judges and officers heretofore appointed to handle the election of officers also are to handle the election on the garbage question herein submitted. V~'IIEREAS, the Public convenience, safety and nec- essity of the City, and the people of the City require that the partion of U.S. 87 be adequately maintained. Since the existing street constitutes a danger and serious inconvenience to the pub- lie which is urgently required to be remedied; and V,E~rEREAS, the City has reauested that the State of Texas, enter upon and contribute finan6ii!y to the maintenance of said project; and V~HE?~AS, the State of Texas has made it known to the City that it will, with its own forces and equipment and at its sole cost and expense, enter upon and maintain said project. That since the public convenience, safety and necessity of the City and the people of the City require said project be adequately maintained. SECT'I0~ 2. That the State of Texas be and is hereby authorized to enter upon and maintain s~aid maintenance project. SECTION 3. That the DLmyor, or proper City Official, of the City, be and is hereby authorized to execute for and on behalf of the City an. agreement with the State o~ Texas, in accordance with and for the purpose of carrying out the terms and provisions of this order, in the form attached hereto and marked 'I~fb~ICI~AL PL%INTENANCE AGREEI~Ff." The City Secretary is hereby directed to attest the agreement and to affix the proper seal of the ~' . emty hereto SECTION ~. The l~,layor of the City, having requested in writing that this ordinance take effect forthwith and there being in fact an emergency and imperative nedessity that the work herein provided for be begun and carried out promptly and with expedition and that the agreement aforesaid shall be i~ediateiy made, executed and delivered to the end .that such ¥©rk herein provided for may be begun and carried out proraptly and with expedition. The reading of the ordinance on three several days is hereby diseensed edth and the same shall be in full force and effect from and after its passage.
