The Plainview City Council met on May 9, 2017 at 7:00 p.m. in the City Council Chambers
of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in
City Hall at 4:30 p.m. on May 5, 2017. Mayor Wendell Dunlap presided. Councilmembers
present were: Charles Starnes -District 1, Larry Williams -District 2, Teressa King -District
4, Susan Blackerby-District 5, John Gatica-District 6 and Oliver Aldape-District 7.
Councilmember Norma Juarez -District 3 was absent.
Staff members present were: Jeffrey Snyder, City Manager, Leslie Schmidt -City Attorney,
Tim Crosswhite-Director of Public Works, Ken Coughlin -Police Chief, Rusty Powers -Fire
Chief, Isauro Gutierrez -Information Technology Manager, Paul Kite -Assistant Director of
Utilities and Belinda Hinojosa-City Secretary.

Mayor Wendell Dunlap delivered the invocation and led in the pledge of allegiance.
Mayor Dunlap presented a proclamation to Ron Trusler and Sherri Bohr declaring May
12th as Plainview Children's Mental Health Awareness Day.
Councilmember Larry Williams moved to approve the consent calendar. The motion was
duly seconded by Councilmember King and carried by unanimous vote. Items approved
on the consent calendar included the granting of an excused absence to Councilmember
Norma Juarez; approval of the minutes of April 20, 2017 and April 25, 2017; and authorize
City Manager to sign Alley Paving Agreement between the City of Plainview and John
David Dickerson.
Rodney Watson, Chair of the Walk of Fame Committee presented the request of the
committee to include Lavern Roach into the Walk of Fame. The Committee has
unanimously agreed that he be added.
Evelyn Trice, widow and Richard Roach, son of Lavern Roach were present to speak in
favor of the plaque.
Councilmember King moved to appoint Lavern Roach into the Walk of Fame. The motion
was duly seconded by Councilmember Williams and carried by unanimous vote.
Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3655, an
Ordinance of the City Council for the City of Plainview, Texas Amending the City Code of
Ordinances by Adding the Name "Jimmy Dean Boulevard" to a Portion of 8th Street From
the West Side of Quincy Street to Smyth Street; Providing a Repealer; Severability
Clause; Cumulative Clause; Conflicts Clause; and Effective Date. Since this was the
second of two readings, the Council chose to forego staff briefing and asked for public
comment. There was no public comment.
Mayor Pro Tem Starnes moved to adopt Ordinance No. 17-3655 on second reading. The
motion was duly seconded by Councilmember Gatica and carried by unanimous vote.

Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3656, an
Ordinance of the City Council for the City of Plainview, Texas, Amending Chapter 3,
Article 3.06, International Mechanical Code, Article 3.07, Medical Gas and Vacuum
Systems, Article 3.08 Fuel Gas, and Article 3.09, Minimum Housing/Dangerous Building
Code, of the City of Plainview Code of Ordinances by Adopting the International
Mechanical Code (2015 Edition), the National Fire Protection Association's Health Care
Facilities Code and the Medical Gas and Vacuum Systems Installation Handbook (2015
Editions), the International Fuel Gas Code (2015 Edition) and the International Property
Maintenance Code (2015 Edition); Repealer; Cumulativeness Clause; Severability
Clause; Conflicts Clause, and Effective Date. Since this was the second of two readings,
the Council chose to forego staff briefing and asked for public comment. There was no
public comment.
Councilmember Williams moved to adopt Ordinance No. 17-3656 on second reading.
The motion was duly seconded by Councilmember King and carried by unanimous vote.
Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3657, an
Ordinance of the City Council of the City of Plainview, Texas, Temporarily Altering the
Prima Facie Speed Limit Established for Vehicles on a Portion of Interstate Highway 27
Within the Boundaries of the Corporate Limits of the City of Plainview, Texas, in
Accordance With the Texas Transportation Code Ann., §545.356 (Vernon's 2011);
Providing for an Official Designation of a Reduced Speed as a Result of a Traffic
Engineering Study by Signage and Other Required Notice; Providing A Penalty;
Severability Clause; Cumulativeness Clause; Conflicts Clause; Meeting Held in
Compliance with the Texas Open Meetings Act; and Effective Date. Since this was the
second of two readings, the Council chose to forego staff briefing and asked for public
comment. There was no public comment.
Mayor Pro Tem Starnes moved to adopt Ordinance No. 17-3657 on second reading. The
motion was duly seconded by Councilmember Blackerby and carried by unanimous vote.
Jeffrey Snyder, City Manager presented for consideration Resolution R17-387, a
Resolution by the City Council of the City of Plainview, Texas ("City") Denying the
Surcharge Related to Docket No. 45524 Submitted by Southwestern Public Service
Company on about April 6, 2017; Authorizing Participation in a Coalition of Similarly
Situated Cities; Authorizing Participation in Related Rate Proceedings; Requiring the
Reimbursement Of Municipal Rate Case Expenses; Authorizing the Retention of Special
Counsel; Finding That the Meeting Complies With the Open Meetings Act; Making Other
Findings and Provisions Related to the Subject; and Declaring an Effective Date. This
Resolution would deny the surcharge submitted by Southwestern Public Service
Company. On April 6, 2017, Southwestern Public Service Company ("SPS") filed an
application with the City and the Public Utility Commission of Texas ("Commission" or
"PUC") for approval to implement a surcharge arising from its most recent base rate case,
Docket No. 45524. The purpose of the surcharge is to allow SPS to recover revenue that
it has a statutory right to recover for the period from July 20, 2016 through December 9,
2016.
It is recommended that the City deny SPS's application to implement the proposed
surcharge related to Docket No. 45524. While an intervention deadline has not yet been
established and the proposed effective date of the tariff authorizing the surcharge is not

effective until July 1, 2017, it is recommended that the City take action as soon as possible
to allow for full participation in proceedings before the PUC.
It is also recommended that the City retain the law firm of Herrera & Boyle, PLLC to
represent the City's interest in matters related to SPS's surcharge application and to
advise the City with regard to SPS's application, and that the City intervene in the
proceeding before the PUC, and represent the City in appeals, if any, regarding SPS's
application.
Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro Tem
Starnes moved to adopt Resolution R17-387. The motion was duly seconded by
Councilmember Aldape and carried by unanimous vote.
Mr. Snyder presented to consider Interlocal Agreement between the City of Plainview and
Hale County for Street Seal Coat Project. On April 25, the City Council approved the
contract with G & G Operation, Ltd. for the 2017 Seal Coat Project in the amount of
$471,030. This includes seal coating 211,500 square yards of street with pre -coated
aggregate at $2.22 per square yard plus an additional $1,500 for the installation of
pavement markings. Staff did include an Altemate Bid to assist the County in seal coating
the portion of Westridge Road and Southwest 3rd that is outside of the City Limits since
we were including the part of Westridge Road inside the City Limits in our project scope.
This includes seal coating 7,500 sq. yards at a cost of $16,650. In addition, the City and
County are planning to provide in house seal coating services for Andy Taylor Road. The
Interlocal Agreement is a not to exceed amount of $30,500. Staff recommends approval.
Mayor Dunlap asked for public comment. There was no public comment.
Councilmember King moved to approve Interlocal Agreement between the City of
Plainview and Hale County for Street Seal Coat Project. The motion was duly seconded
by Councilmember Blackerby and carried by unanimous vote.
Jeffrey Snyder, City Manager presented information on Resolution R17-388, a Resolution
of the City Council of the City of Plainview, Texas, in Support of the Running Water Draw
Hike and Bike Trail Phase II Transportation Alternatives Set -Aside Program Project. This
Resolution would authorize the submittal of a grant application to extend the Hike and
Bike Trail to Regional Park.
In January 2017, the Texas Department of Transportation announced a call for projects
under the Transportation Alternatives Set -Aside Grant Program for population areas of
200,000 or less. Proposed projects may be located on state -maintained roadway right of
way (on -system) or on property owned by the project sponsor (off -system). The amount
of TXDOT funding available is approximately $52 million between 2017-2020 assuming
sustained FAST Act authorization levels. There is a required local match of 20%. The
application deadline is May 22, 2017.
Staff is proposing to submit a grant application to extend the Hike and Bike Trail from
Quincy Street to Regional Park. The total project cost is estimated at $1.8 million
including lighting improvements. The required match for the City will be $366,695.
Staff is working on finalizing plans and will bring back to the Council. No action will be
taken tonight.

Councilmember King moved to go into closed meeting to deliberate the purchase, 129
exchange, lease or value of real property, the public discussion of which would not be in
the best interest of the City's bargaining position with third parties, in accordance with
Tex. Gov't Code, Section 551.072. and to consult with attorney on a matter in which the
attorney's duty to the government body under the Texas Disciplinary Rules of
Professional Conduct conflicts with the open meeting statutes: Board Appointments; and
deliberate the appointment, employment, evaluation, reassignment, duties, discipline or
dismissal of a public officer or employee, or to hear a complaint or charge against an
officer or employee. [Tex. Gov't. Code, Section 551.074]. Appointments to the following
boards and commissions: Plainview Housing Authority Board. The motion was duly
seconded by Councilmember Gatica and carried by unanimous vote.
The meeting was recessed at 7:35 p.m.
Mayor Dunlap called the meeting back in open session at 8:43 p.m.
Jeffrey Snyder presented for consideration and to take necessary action regarding the
proposed acquisition of real property for municipal projects. As part of Travis Trussell
Duck Pond project we were evaluating the purchase of some acres that are owned by
Garland Street Church of Christ that is approximately 1 acre in the amount of $21,000
plus closing costs. This would be for some off street parking.
Staff recommends to authorize Mayor to sign the necessary documents to purchase the
approximate 1 acre from Garland Street Church of Christ in the amount of $21,000 plus
closing costs.
Mayor Pro Tem Starnes moved to authorize Mayor to sign the necessary documents to
purchase the approximate 1 acre from Garland Street Church of Christ in the amount of
$21,000 plus closing costs for the Travis Trussell Duck Pond Project. The motion was
duly seconded by Councilmember Blackerby and carried by unanimous vote.
Mayor Pro Tem Starnes moved to appoint Robert Rivera to the Plainview Housing
Authority Board with said term to expire on January 1, 2019. The motion was duly
seconded by Councilmember Williams and carried by unanimous vote.
There being no further business, Mayor Dunlap adjourned the meeting at 8:46 p.m.
