STONEHAM MAYOR KELTZ GARRISON MEDLIN CARPENTER JEANE L. BROWNING TOM ALMON NEAL WILLIAMS ) ) ) ALDERMAN ) ) and with the following absent: ~/~t~/~'. a quorum; and among other proceedingsr' had were~the fbllo~ing: , constituting The Mayor introduced a proposed ordinance. The ordinance was read in full. Alderman_~-~_:~! made a motion that any rule requiring ordinances to be read more than one time or at mor~ than one meeting be suspended. The motion was seconded by Alderman 4.1~ ~ m ~ and carried by the following vote: YEAS: Aldermen Garrison, Carpenter, ]Browning, and Williams. NAYS: None. Alderman ~c>Ou,\~:~ then made a motion that the ordinance be passed finally. The motion was seconded by Alderman ~.~ ,_~_%~4%and carried by the following vote: YEAS: .Aldermen Garrison, Carpenter, ]Browning, Almon and Williams. NAYS: None. The Mayor announced that the ordinance has been finally passed. The ORDINANCE is as follows: ORDINANCE NO. 76-1913 AN ORDINANCE ESTABLISHING ELECTION PRECINCTS FOR MUNICIPAL ELECTIONS; ENACTING PROVISIONS INCIDENT ~D RELATING THERETO; REPEALING ORDINANCE NO. 75-1759, PROVIDING THE POLLING PLACE FOR EACH PRECINCT AND DECLARING AN EMERGENCY. WHEREAS, under the provisions of Article 202b of the Texas Election Code, the governing body of an incorporated city is to establish election precincts and designate the polling places for elections held by such city, in acnordance with the provisions of Article 2.05 of said Code; and WHEREAS,, said Article 2.05 provides that the governing body of a City may combine two or more County Election Precincts into one Municipal Precinct but shall not include parts of one County Precinct in more than one Municipal Precinct; and WHEREAS, this governing body hereby finds and determines that the election precincts for municipal elections held within the City of Plainview, Texas should be defined; and the location of the polling place for each precinct should be designated, now therefore, BE IT OPDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1: That all territory located within the corporate limits of the City of Plainview, Texas, shall be and is hereby divided into two election precincts. One precinct (Precinct No. 1) shall consist of all of the following territory, to wit: All of that part of Hale County (Texas) election Precincts Numbers Seven (7) and Eight (8), lying within the City Limits of the City of Plainview. Said Hale Cc "Precinct corporate limits Street and West Street and Quinc~ Thence Nortt Railway; Thence Nortt ~unty (Texas) Precincts 7 and 8 being as follows: ;even (7) shall include all the territory in the of the City of Plainview liming North of West Tenth ,f a line beginning at the intersection of West Tenth Street. to the right-of-way to the Forth Worth and Denver westerly along said right-of-way to the North Corporate limi{8 of the City of Plainview. Precinct Eight (8) shall include all the territory in the corporate limits of the City of Plainview lying North of a line beginning at the intersection of West Tenth Street and Quincy Street; Thence East along West Tenth Street to Austin Street; Thence South along Austin Street to West Ninth Street: Thence East along West Ninth Street to Broadway Street; And East of the East line of Election Precinct Seven (7) as described above and West of the West line of Election Precinct One (1) as described above." The other precinct (Precinct No. 2) shall consist of all of the following territory, to-wit: Ail of that part of Hale County (Texas) election Precincts Numbers One (1), Six (6), and Ten (10), lying within the City Limits of the City of Plainview, Said Hale County (Texas) Precincts 1, 6 and 10 being as follows: "Precinct One (1) shall include all the territory in the corporate limits of the City of Plainview lying East of a line beginning at the intersection of Broadway Street and the South line of the corporate limits of the City of Plainview; Thence North along Broadway Street to the right-of-way of the Panhandle & Santa Fe Railway; Thence in a Northwesterly direction along said right-of-way and following said right-of-way to the North line of the corporate limits of the City of Plainview. Precinct Six (6) shallinclude all the territory in the corporate limits of the City of Plainview lying South of West Tenth Street and West of Quincy Street. Precinct Ten (10) shall include all the territory in the corporate limits of the City of Plainview lying East of Quincy Street; South of the South line of Election Precinct Eight (8) as described above and West of Broadway Street." SECTION 2: That the City Hall of the City of Plainview, 901 Broad- way Street, Plainview, Texas, is hereby designated as the polling place within Precinct No. 1. That the City of Plainview, Texas, Chamber of Commerce and Board of City Development Building, 710 West 5th Street, Plainview, Texas, is hereby designated as t]he polling place within Precinct No. 2. SECTION 3: Ail qualified electors shall vote in the election precinct in which they reside. SECTION 4: Ordinance No. 75~1759 and all resolutions, orders or ordinances in conflict are hereby repealed. SECTION 5: That the public importance of this measure and the fact that it is to the,best interest of the City t~ establish election precincts for all municipal elections held or to be held in the City at the earliest possible date constitute and create an emergency and an urgent public necessity, requiring that any rule providing for ordinances to be read more than one time or at more than one meeting of the City Council be suspended, and requiring that this ordinance be passed and take effect as an emergency measure, and any such rules or provisions are accordingly suspended and this ordinance is passed as an emergency measure, and shall take effect and be in full force from and after its passage. 1976 PASSED and APPROVED This the ~?/ day of ~~j~ ~.~.~, ? / ~y~o , C{t~ of Plainview, Texas ATTEST: City Clerk City of Plainview, Texas
