NOTICE OF RUN-OFF ELECTION FOR THE PURPOSE OF ELECTING A MAYOR AND AN
A]'.DERMAN FOR PLACE FIVE ON THE CITY COUNCIL OF THE CITY OF PLAINVIEW
Notice is hereby given of a Run-off Election to be held in and
for the City of Plainview on the 2nd Tuesday in May, 1976, the same
being the llth of May, 1976, for the election of.a Mayor and ~for the
election of an Alderman for Place Five on the City Council of the
City of Plainview.
The Ordinance providing for the election and setting out the
officers to be elected and other pertinenn information in regard thereto
is as follows:

You are directed to post notice of t]~e run-off election to be
held in and for the City of Plainview for the purpose and at the time
as provided in the Ordinance attached hereto, which said Ordinance
provides for a run-off election for a Mayor and for an Alderman to
fill place Five on the City Council of the City of Plainview.
You will post notices of said election at three (3) public places
in each voting precinct, one of which must be posted at the polling
place for each precinct~at least 30 full days prior to the day of the
election.
You will also cause said notice to be published in a newspaper
of general circulation in the City Of PlaJ~view as provided in the
said Ordinance, the publication to be not more than twenty-five (25)
days nor less than ten (10) days prior to the election.
You will also deliver to each of the persons appointed to hold
the election, a copy of said Ordinance, which constitutes a Writ of
election.

compliance with the Ordinance, I did on the day of April,

and in compliance with the Ordinance, I caused the notice attached hereto
to be published in the Plainview Daily Herald on the day of
April, 1976, which is a day not more than twenty-five (25) days nor
less than ten (10) days prior to said election. I also served a copy

On this the ~%~-~ day of April, ].976, the City Council of the
City of Plainview, Texas, convened in special session at the regular
meeting place thereof in the CityiHall, the meeting being open to the
public and notice of said meeting having been given as prescribed by
Article 6252-17, Section 3A, V.A.T.C.S., there being present and in
attendance the following members, to-wit:

The Mayor introduced a proposed ordinance. The ordinance was read
in full.

quiring ordinances to be read more than one time or at more than one

the Statutes provided and the Charter
election shall be held in and for the
City of Plainview on the second Tuesday in May, 1976, the same being
the llth day of said month, for the purpose of conducting a run-off
election between: (i) J. Robert (Bob) Wayland and
Kel~z Garrison , the two candidates receiving the
highest number of votes for the office of Mayor of the City of Plainview
at the regular election of said City held on April 3, 1976, neither of
them having received a majority of the votes cast for said office; and,
(2) A. W~ (Bill) SoRelle, Jr. and M.P. (pat) Kimbrew ,
the two candidates receiving the highest number of votes for Alderman
for Place Fi~e on the City Council of the City of Plainview at the
regular election of said City, neither of them having received a
majority of the votes cast for said office.
SECTION 2: The City Council of the City of Plainview finds that said
q~L_~~ .... J. ~9bert (Bob)~Wayland and that said candidate
Keltz Garrison received thm highest number of votes of all
of the candidates for the office of Mayor at said election, but that
neither of them received a majority of the votes; and that said
candidate A.W. (Bill) SoRelle, Jr. ~and that said candidate
M. P. (Pat) Kimbrew received the highest number of votes of all
of the candidates for the office of Alderman for Place Five on the City
Council, but that neither of them received a majority of the votes;
and therefore, it is necessary to call a run-off election to comply with
the Charter of the City of Plainview and 'the Statutes of the State of
Texas.
SECTION 3: That said election shall be held in each of the
election precincts within the City of Plainview and at the designated
polling places within each precinct as provided in Ordinance No. 76-1913
of the City of Plainview.
SECTION 4: That the City Hall of the City of Plainview, 901 Broadway
Street, Plainview, Texas, is hereby designated as the polling place
within Precinct. No. 1 of the City of Plainview.
That the City of Plainview, Texas, Chamber of Commerce and Board of
Ci-ty Development Building located at 710 West 5th Street, Plainview,
Texas, is hereby designated as the polling place for Precinct 2.
SECTION 5: Ail qualified electors shall vote in the election
precinct in which they reside.

Mrs. Woody Allen is hereby appointed first alternate
judge to act as Presiding Judge of Precinct 2 in the event that

Presiding Judge; and Betty .Royal is hereby
appointed second alternate judge to act as Presiding Judge of Precinct 2
in the event that both Martha Barnes and
~irs. Woody Allen are for any reason unable to serve
as such Presiding Judge.
The Presiding Judge of said precinct may appoint such additional
clerks as he may deem necessary to hold the election.
SECTION 7: This election is called pursuant to the Charter of the
City of Plainview and the Statutes of the State of Texas as a run-off
election between candidates: (1) J. Robert ~Bob) Wayland and
Keltz Garrison , who are the candidates for the
office of Mayor of the City of Plainview, they receiving the most votes
for said office at the regular city election held in and for the City
of Plainview on the 1st Saturday in April, and neither of said candidates
having received a majority of the votes cast for said office at said
election; and ~2) A.W. (Bill) SoRelle~ Jr. and
__M. P. (pm~) Kimbrew , who are the candidates for Alderman
Place Five on the City Council of the City of Plainview, they
receiving the most votes for said office at Said'regular election,
and neither of said candidates having received a majority of the votes
cast for said office at said election.
SECTION 8: Said election shall be held under and in accordance
with the provisions of the Statutes of the State of Texas and the Charter

of the City of Plainview and all persons qualified to vote in said
City under the Election Laws of the State of Texas shall be allowed
to vote therein. Said election shall be held and the polls shall be
open from 7:00 A.M. to 7:00 P.M., and ali. electors shall vote in the
voting precinct in which said voter resides and at the place provided
for voting in said voting precinct, as provided in Ordinance No. 76-1913
of the City of Plainviewo
SECTION 9: Notice of said election shall be given by posting and
by publication of a copy of this Ordinance, and at the top of which shall
appear the words "NOTICE OF RUN-OFF ELECTION FOR THE PURPOSE OF ELECTING
A MAYOR AND AN ALDERMAN FOR PLACE FIVE ON'THE CITY COUNCIL OF THE CITY
OF PLAINVIEW".
Thirty days' previous, notice of said. election shall be given by
posting a copy of.this Ordinance in three (3) public places in said City
of Plainview in each of the voting precincts provided for in Ordinance
No. 76-1913 of the City of Plainview, Texas, one of which notices shall
be posted at the polling place designated for City Election, ~reCinct .1
and one of which shall be posted at the polling place designated for
City Election, Precinct 2.
Notice by publication shall also be made by publishing notice of
said election in the Plainview Daily Herald (a newspaper of general
circulation in Plainview, Texas), said publication to be not more than
twenty-five (25) days nor less than ten (10) days prior to the election.
SECTION 10: A copy of this Ordinance shall also be served upon
each of the three election officials who have been designated to hold
the election.
SECTION lit The fact that the Run-off Election above mentioned must
be called immediately in order that proper notice and posting may be
given prior to election date, constitukes and creates an emergency and
an urgent public necessity, requiring that any rule providing for
ordinances to be read and voted upon at more than one meeting of the

City Council be suspended, and requiring that this ordinance be
passed and take effect as an emergency measure, and such rules and
provisions are accordingly suspended, and this Ordinance is passed
as an emergency measure and shall take effect and be in full force
from and after its passage.

Aviso queda hecho para la elecci6n recorrida que tomar~
lugar en la ciudad de Plainview, el segundo martes de mayo de
1976, el mismo siendo el ll de mayo de 1976, para la elecci6n
de alcalde y la elecci6n de regidor para la quinta posici6n
del ayuntamiento de la ciudad de Plainview.
La ordenanza provee para la elecciSn y el establecimiento
de los oficiales para ser elegidos y otra informaci6n perti-
nente respeto a lo que sigue:

alcalde y para un regidor que ocupara el g_uinto puesto en el
concilio de la ciudad de Plainview.
Postara usted noticias de dicha elecciSn en (3) tres
lugares pdblicos en cada distrito de votaci6n, uno la cual
sera postada en el lugar de votar de, cada distrito por lo
menos 30 dias completas, antes del dfa de la elecciSn.
Tambi~n causara usted que dicha noticia sea publicada en un

Keltz Garriso_n, quienes son los candidates para la posici6n de
alcalde de la ciudad de Plainview, ellos recibiendo los m~s
votes para dicha posici8n en la primera elecciSn regular que
tom6 lugar en y para la ciudad de Plainview el s~bado, primers
de abril, y ninguno de los dos candidates habiendo recibido la
mayor~a de los votes depgsitados para dicha posici6n de dicha
el~ccx$n: y (2) A, W: (Bzll) SoRelle, ~r: y M. P. !Pat) Kimbrew,
qu~enes son los ~a~dx'datos par~'l~ posiciSn ~e"regidor, lugar
cinco del concilio de la ciudad de Plainview, ellos recibiendo
los m~s votes para dicha posici6n en la elecci6n regular, y
ninguno de los candidates habiendo recibido la mayorfa de los
votes para dicha posici6n de dicha elecci6n.
SECCION 8: Dicha elecciSn tomar~ lugar bajo yen
conformidad con las provisiones de los estatutos del
estado de Texas y con la c~dula de la ciudad de Plainview
y todas las personas ~;~alificadas para votar en dicha ciudad

baje las~leyes de elecciSn del estado de Texas ser~u permi-
tides a vetar. Dicha elecciSn tomar~ lugar y los lugares de
rotation estar~n abiertos desde las 7:00 a.m. hasta las
7100 p.m., y todos los votantes votar~ en el distrito de
la cual dlcho vetante vive yen el lugar provefdo para la
votaciSn en dichO distrito, como provefdo en la ordenanza
n~mere 76-1913 de la cfudad de PlaLuview.
SECCION ~9~: Nota de dicha elecciSn ser~ dado per postando y
po~ publ'~C'ac"i~n de una copia de esta ordenanza, y que enc~ma
a~ecer~ estas palabras, "NOTA DE LA ELECCION RECORRIDA PARA
EL PROPOSIT0 DE EI~JIR UN ALCALDE Y DE UN REJIDOR, LUGAR CINC0
EN EL CONCILI0 DE LA CIUDAD DE PLAINVIEW".
Aviso anterior de dicha elecciSn ser~ dada 30 dias pre-
viamente de la elecci6n postando una copia de esta ordenanza
en tres (3) lugares p6blicos en dicha ciudad de Plainview, en
cada distrito de votar proveldos por la ordenanza ndmero
76-1913 de la ciudad de Plainview, Texas, uno de los avisos
siendo postado en el lugar de votaciSn designada para las
elecciones de la ciudad, distrito l, y un aviso siendo postado
en el lugar de votaci6n designada pars~ las elecciones de la
ciudad, distrito 2.
Aviso por publicaciSn ser~ tambi~in hecho, pub!icando el
aviso de dicha elecciSn en el periSdico de circulaci6n de
Plain~iew, el Plainvi?w pauly Herald,,dicha publicaci~n siendo
sometmda no m~s de vemntmcmnco (25) dias o menos de dmez (10)
dias antes de la elecciSn.
SECCION 10, Una copia de ~sta ordenanza ser~ dada a cada
uno de los tres oficiales de elecciSn quienes han sido designa-
dos a llevar a cabo la elecci6n.
SECCION ll, E1 hecho de que la elecci6n recorrida ya
mencionada tiene que tomar lugar inme~!iatamente p~ra,~q~e~ ~i~,~
~i¢oia propia ser~ dada antes de la ~echa de la elecc~6n,
preduciendo ~ma emergencia y una necesidad urgente p~blica,
requiriendo que cualquiera regla que provee por las ordenanzas
para ser lei~as y votadas en m~s que u~a reunion del concilio
de la ciudad sean suspendidas, y requiriendo que esta ordenanza
sea pasada y quo tome efecto como una medida de emergencia y
tales reglas y previsienes est~n en efecte suspendidas, y
esta orden~nza est~ aprovada como una medida de emergencia
y tomar~ efecto despu~s de ques~a pasada.
