AN ORDINANCE PRESCRIBING THE SPEED LIMIT ON U.S. 70, OLTON ROAD AND FIFTH
STREET, IN THE CITY OF PLAINVIEW, TEXAS, AT LOCATIONS HEREINAFTER DESIGNATED;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRESCRIBING A PENALTY FOR THE
VIOLATIONS OF THIS ORDINANCE; AND CREATING AN EMERGENCY.
WHEREAS, after an engineering and traffic investigation, the City Council
of the City of Plainview finds that circumstances are such ~hat the maximum
reasonable and safe speed for the operation of vehicles under conditions found
to exist on U.S. 70, Olton Road and Fifth Street, within the City Limits of
Plainview is prescribed by the City Ordinance hereinafter enacted;
NOW, THEREFO~RE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION 1: The speed limits on that portion of U.S. 70, Olton Road and
Fifth Street, at the locations hereinafter designated shall be as follows:
(a) The maximum legal speed limit on U.S. 70, Oiton Road and Fifth
Street, for eastbound traffic only shall be 55 MPH from the point
of intersection with the West City Limits a point 0.574 mile west
of the point of intersection with the centerline of U.S. 87, 1-27,
to a point 0o128 mile west of the point of intersection with the
centerline of U.S~ 87, 1-27, a distance of 0.446 mile; thence 45 MPH
for a diszance of 0.620 mile to the point of intersection with t~e
centerline of Ennis Street; thence 40 MPH for a distance of 2.013 miles
to the point of intersection with the centerline of Business Route
U.S. 87, Columbia Street; thence 30 MPH fbr a distance of 0.293 mile
to the point of intersection with the centerline of Ash Street; thence
35 MPH for a distance of 0.285 mile to the point of intersection with
the centerline of Elm Street; thence 45 MPH for a distance of 0.534 mile;
thence 50 MPH for a distance of 0.11S mile to the point of intersection
with the South City Limit, a point of 0.214 mile easterly to the point
of intersection with the centerline of Milwee Street.
(b) The maximum legal speed limit on U.S. 70, Fifth Street and Olton
~ad, for westbound traffic only shall be SO MPH from the point of
intersection with the East City Limit, a point 0.349 mile east of the
point of intersection with the centerline of Milwee Street, to a point
0..099 mile east of the point of intersection with the center!ine of
Milwee Street, a distance of 0.250 mile; 'thence 45 MPH for a distance
of 0~534 mile to the point of intersection with the centerline of Elm
Street; thence 35 MPH for a distance of 0.285 mile to the point of
intersection with the centerline of Ash Street; thence 80 MPH for a
dj[stance of 0.293 mile to the point of intersection with the centerline
of Business Route U.S. 87, Columbia Street; thence 40 MPH for a
distance of 2.013 miles to the po%nt of intersection with the
centerline of Ennis Street; thence 45 MPH for a distance of
0.620 mile to a point 0.128 mile west of the point of intersection
with the centerline of U.S. 87, 1-27; thence 55 MPH for a distance
of 0.446 mile to the point of intersection with the West City Limit,
a point 0.574 mile west of the point of intersection' with the center-
line of U.S. 87, 1-27.
SECTION 2: The smybol "MPH" ss used in -this ordinance is a symbol for
and means "Miles Per Houm."
SECTION 3: It shall be unlawful for any person to operate any motor
vehicle which is self-propelled, automobiie, or motorcycle on the above
designated portion of 01ton Road and Fifth Street in the City of Plainview,
at a speed greater than that which is herein~)ove designated in Section 1 (a)
and (~) of this Ordinance as the maximum speed limit.
'SECTION 4: Ordinance No. 68-1004 is hereby repealed.
SECTION 5: Any person who shall violate or fail to comply with the pro-
visions of this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be punished by a fine of not less than $10.00 and
not more than $200.00,
