HomeMy WebLinkAbout76-1984 ordORDINANCE NO. 76-1984 AN ORDINANCE PRESCRIBING FEES TO BE CHARGED FOR PICKING UP AND KEEPING OF LIVESTOCK, ANIMALS AND FOWLS; REPEALING ORDINANCES IN CONFLICT HEREWITH; AND RATIFYING AND CONFIRMING THE PROVISIONS OF ALL ORDINANCES PERTAINING TO THE SUBJECT MATTER OF THIS ORDINANCE THAT ~E NOT IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: Section 1: (a) The Director of Public Safety of the City of Plainview shall cause to be taken into custody any rabbit, fowl, fox, or other animals found to be off the premises of the owner and not under the control of the owner or any other person and within the limits of the City of Plainview, and to charge a pick up fee of $5.00 and a daily sustenance fee of $2.00 per day, which shall be paid by the owner or other custodian of-said animal prior no the release of same by said Director of Public Safety (b) The DireCtor of Public Safety of the City of Plainview shall cause to be taken into custody any cow, horse, mule, sheep, goat, hog or other livestock found to be off the premises of the owner and not under the control of the owner or any other person, and within the limits of the City of Plainview, and to charge a pick up fee of $20.00 and a daily sustenance fee of~$5.00 per day which shall be paid by the owner or other custodian of said animal prior to the release of same by said Director of Public Safety The words "other animals" as used in this ordinance shall not include dogs or cats for the reason that provisions for the control of dogs and cats are made in Ordinance No. 65-~B65 of the City of Plainview, and said Ordinance No. 65-865 shall control as to dogs and cats. This ordinance is not intended to repeal Ordinance ]No. 65-865 or any part thereof nor to be in conflict thereof. Section 2: If the Director of Public Safety_ _ or employees of said department determine that any such animal, fowl or livestock needs veterinary attention and a veterinarian is used to treat such animal, fowl or livestock, there shall also be charged the owner or such person picking up the animal the fee of such veterinarian for attending such animal, f~wl or-livestock. Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed and all ordinances or parts of ordinances pertaining to the subject or subjects covered by this ordinance that are not in conflict herewith are hereby ratified and confirmed as heretofore passed and approved.
