R92-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, CALLING ON THE TEXAS MUNICIPAL LEAGUE TO SUPPORT LEGISLATION THAT WILL PROHIBIT FURTHER IMPOSITION OF MANDATED COURT FEES FOR MUNICIPAL COURTS BY THE STATE OF TEXAS. Whereas, the State of Texas has imposed and raised mandatory fees for the Municipal Courts consistently at each legislative session, without regard as to the impact of these fees on the operation of the courts or the impact on paying those fees; and Whereas, the Municipal Courts are acting as a collection point for the State of Texas on all misdemeanor offenses and the fees collected are transferred to the State without regard as to the financial impact on the cities; and Whereas, the Municipal Courts are utilized by the state government as a conduit for gaining additional revenue for state supported programs. Now, therefore, be it resolved by the City Council of the City of Plainview, Texas, to request the Texas Municipal League to introduce legislation that will halt further state mandated fees upon the municipalities and courts, and to allow those cities and courts to control and set fees as they deem just and appropriate.
