HomeMy WebLinkAbout77-2057 ordOrdinance No. 77-2057 AN ORDINANCE CANVASSING THE RETURNS AND DECLARI'NG THE RESULTS OF.AN ELECTION HELD IN THE CITY OF PLAINVIEW, TEXAS, ON APRIL 2, 1977, PURSUANT TO AN ORDINANCE (NO. 77-2035), ORDERING AN ELECTION IN THE CITY OF PLAINVIEW, TEXAS, FOR THE' PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS O'F THE CITY OF PLAINVIEW FOR ADOPTION OR REJECTION THE PROPOSTION OF "FOR OR AGAINST THE ADOPTION OF THE FIREMEN'S AND POLICEMEN'S CIVIL SERVICE ACT". WHEREAS, by virtue of Ordinance No. 77- 2035 of the City of Plainview, Texas, duly passed by the City Council of the City Of P.lainview on the 25th day of January, 1977, a special election was-duly called to permit the electors to vote for or against the proposition of the adoption of the Firemen's and Poiicemen's Civil Service Act; and, WHEREAS, at said election there was submitted to the qualified voters of the City of Plainview, the question: "FOR the adoption of the Firemen's and Poticemen's Civil Service Act" "AGAINST the adoption of the Firemen's and Policemen's Civil Service Act" and, WHEREAS, the returns of said election should be opened and canvassed and the results thereof declared; and, WHEREAS, upon consideration of the returns of said election, it appears that said election was in all respcts legally held, after due notice had been given, that said returns were duly and legally made and properly reflect the results of said election on the proposition submitted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1: That there was submitted to the qualified voters of the City of Plainview, Texas, on April 2, 1977, in an election duly called in accordance with t~he law, for the purpose of voting on the following question: "FOR the adoption of the Firemen's and Policemen's Civil Service Act" "AGAINST the adoption of the Firemen's and Policemen's Civil ServiceAct" SECTION~2: That the qualified voters voted on said question at the polls and cast their ballots and answered the foregoing questions as follows: --On the question: "'FOR the Adoption of the Fir~men's and Policemen's Civil Service Act", 585 votes answered yes. On the question: "AGAINST the adoption of the Firemen's and Policemen's Civil Service Act", 794 votes answered no. There ~ere cast .at said election 1380 votes, and a majority thereof was cas~ in the negative answer to the question submitted. One vote was declared illegally' cast by the ele~ction officials and not counted. SECTION 3:' That th~ aforesaid election was duly and legally called and notice thereof given in accordance with the laws of the State of Texas and the Ordinance calling said election; that said election was held in strict conformity wit~ the constitution and laws of the State of~Texas,' and the returns thereof have been properly made to the officials of the City entitled to receive same; and further, that said election properly represents the desires of those qualified to vote therein, and the City Council has duly canvassed the election returns and find that a majority of the qualified voters voted against the proposition of adopting the Firemen's and Policemen's Civil Service Act. Robert Wayland Mayor Tom Almon Commi,,isioner/Alder man Bill SoRelle Commissioner/Alderman M. ]L. A copy of the return of said posting Shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. The above order being read, it was moved and seconded that same do pass.
