AN ORDINANCE AMENDING ZONING ORDINANCE NO o 794 AND THE OFFICIAL ~AP OF THE
CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CE~GES, AND CREATING AN EMERGENCY
ZONE CASE NO. 342
Lots 7, 8, 20, and 21, Block 87, College Hill Addition, same being
413 Dallas and 412 Ennis
CITY OF PLAINVIEW, HALE COUNTY, TEXAS FROM
DI STRICT.
R- 1 to a C- 1 ZONING
WHEREAS, the proposed change in Zoning Distrmcts as hereinafter made has been
duly presented to the Planning & Zoning Commission for its recommendation which
was received by the City Council, and after due consideration the City Council
of the City of Plainview finds that for the orderly growth of the City making
the proposed change as hereinafter set out will be mn the public interest
which creates an emergency; and,
WHEREAS, all conditions precedent requzred by law for a valid amendment to the
Zoning Ordinance and Map, have been fully complied with, as well as giving
notices in compliance with Section 18 of Ordinance 794 as well as notices pro-
vided by Article 10ilF Vernon's Annotated Czvzl Statutes-Amended, 1953, and
notice was duly published in the Plainvzew Herald more than fifteen (15) days
prior to the date of the Public Hearing before the City Council of such pro-
posed amendment, and the Public Hearing according to said notice was duly held
in the City Council Room of the City Hall, Plainview, Texas, at which time
persons appeared in support of the proposal; and after said hearing, it was by
the City Council, d~termined that it would be zn the public interest due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body- of this Ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION i. That Ordinance Noo 794 and the Officzal Zoning Map be and the same
are hereby amended as follows, to-wit:

Change
Lots 7, 8, 20, and 21, Block 87, College Hill Addition, same being
413 Dallas a~d 412 Ennis
City of Plainview, Hale County, Texas, from an R-1 to a C-1 Zoning
District. From the date of this Ordinance said Lot, t{act, and parcel of land
described shall be and hereby be changed to the Zoning District indicated and
the Official Map is amended in accordance herewith~
WHEREAS, an emergency exists as shown in the preamble ~o this Ordinance, the
enactment of this Ordinance is declared to be an emergency measure creating a
FPublic necessity that the rule requiring proposed. Ordinance to ~ presented at
two (2) separate Council meetings be dispensed with; and this Ordinance shal~
be effective from the date of its passage ......

tions which shall be and are hereby made a covenant running
with the land.

B. Deed Restrictions as follows:
Administrative,. executive and editorial offices
for business, profeSsional or industrial
organizations.
Financial offices such as banks, savings and
loan associations, mortgage bankers and
insurance offices.
/3. Governmental buildings and uses.
~4. Prescription pharmacy.
Medical and dental clinics.
Medical and dental laboratories, but not includ-
ing the manufacture of pharmaceutical or other
products for general sale or distribution.

Professional offices fo/r the conduct of the follow-

uses, provided activities conducted observe the
requirements of all city ordinances.
Accessory buildings and uses customarily incident
to any of the above ~uses,provided that such be not
objectionable because of odor, smoke, dust, noise,
vibration, or similar nuisance.
Said restrictions and conditions as to the use of said
property shall be binding upon and be'observed by us, our heirs,
and our assigns executors and administrators and shall run in
favor of and be enforceable by any person now owning or who shall
hereafter own property'located within 200 feet of any part or
boundary line of the above described property.
