HomeMy WebLinkAbout77-2108 ordOrdinance No. 77-2108 PERTAINING TO THE FILING OF APPLICATIONS FOR ZONING CHANGES, REZONING AND RELATED PROCEDURE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: Section 1: If the property involved is de'scribed by lot and block number, each person, corporation or association filing an application for a zone change on such property shall deposit with the building official the sum of $125.00. If the application for zone change is withdrawn or refused by the zoning commission, and no appeal from the action of the zoning commission is taken, the sum of $95~00 shall be refunded to said applicant. If the application of an applicant for a zoning change is approved by the zoning commission or if the same is refused by the zoning commission and thereafter appealed to the City Council, and the City Council denies the application for a zoning change, then there shall be refunded to the applicant the sum of $65.00. If the application for zoning change is approved by the City Council, no refund of any part of the $125.00 will be made. Section 2: If the property involved in an application for a zoning change is described by metes and bounds, then the applicant will pay to and deposit with the building official, the cost of advertising as estimated by the building official plus the sum of $35.00. After the outcome of the application has been determined, if the total cost of the advertising and publishing in connection with the said application is less than the amount &stimated by the building official, then the applicant shall be refunded the difference ~between the estimated amount and the total cost of advertising. In the event the amount estimated by the building official for advertising costs is insufficient to pay the total cost of the advertising, then the applicant shall pay to the City and deposit with the building official the difference between the estimated cost of the advertising and the actual cost of advertising.
