AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL MAP
OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES, AND CREATING AN
EMERGENCY
ZONE CASE NO. 362:
A 1.3~9 acre tract out of the JiM. Pressler Homestead Survey, Hale County,
Texas:
BEGINNING at a steel rod in the W. line of the J.M. Pressler Homestead
Survey and 2,212.3~ South of the 'NE Corner of Section 41, Block JK-2,
Hale County, Texas;
THENCE South along the West line of said Homestead Survey and the East
line-of said Section 41, 235.0' to a steel rod;
THENCE South 15.0~ to a steel rod;
THENCE South 89o59~E., 178.0' to a 5/8" steel rod in the West right-of-
way line of U.S. Highway No. 87 Business Route;
THENCE along said right-of-way'ay line, northward around a curve to the
left having a radius of 2,724.7~ and a chord bearing N.12oo4~45"E.,
255.66' to a steel rod;
THENCE N~89o59~W., 261.5' to the PLACE OF BEGINNING and containing 1.349
acres;
Located 1100 Block South U.S. Highway 87 Business Route, from an R-1 Zone
to a CGB Zone for Commercial Use.

R-1 to a CGB ZONING
WHEREAS, the proposed change in Z6ning Districts as hereinafter made has been
duly presented to the Planning & Zoning Commission for its recommendation which
was received by the City Council, and after due consideration the City Council
of the City of Plainv~ew finds that for the orderly growth of the City making
the proposed changed .s hereinafter set out will be in the public interest
which creates an emer~iency; and,
WHEREAS, all conditio s precedent required by law for a valid amendment to the
Zoning Ordinance and ~lap, have been fully complied with, as well as giving
notices in compliance with SectiOn 18 of Ordinance 77-2090 as well as notices
provided by Article 1~11F Ve~non's Annotated Civil Statutes-Amended, 1953, and
notice was duly published in the Plainview Herald more than fifteen (15) days
prior to the date of %he PuBlic Hearing before the City Council of such pro-
posed amendment, and ~he Public Hearing according to said notice was duly held
in the City Council Room of the City Hall, Plainview, Texas, at which time
persons appeared in s~pport of the proposal; and after said hearing, it was by
the City Council determined that it would be in the public interest due~to~ ~ f
Changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:

Located 1100 Block South U.S. Highway 87 Business Route, from an
R-1 Zone to a CGB Zone for Commercial Use.
City of Plainview, Hale County, Texas, from an R-1 to a CGB Zoning
District. From the date of this Ordinance said Lot, tract, and parcel of
land described shall be and hereby be changed to the Zoning District indicated
and the Official Map is amended in accordance herewith.
WHEREAS, an emergency exists as shown in the preamble to this Ordinance, the
enactment of th~s Ordinance is declared to be an emergency measure creating a
public necessity that the rule requiring proposed Ordinance to be presented at
two (2) separate Council meetings be dispensed with; and this Ordinance shall
be effective from the date of its passage.
Unanimously passed by the City Council this 22nd day of November , 19 77 .
