HomeMy WebLinkAbout77-2150 ordORDINANCE NO. 77-2150 AN ORDINANCE AMENDING ZONING ORDINANCE NO, 77-2090 AND THE OFFICIAL MAP OF THE CITY OF PLA1NVIEW SO AS TO MAKE THE FOLLOWING CHANGES, AND CREATING AN EMERGENCY ZONE CASE NO. 360: A 1.98 acre tract out of the W/2 of Section 28, Block JK-2, Hale County, Texas: BEGINNING at the SE Corner of Westrid§e No. 2 Addition to Plainview, Hale County, Texas, said point being 510.6' South of the NE Corner of Block 1 of Kirchoff's Subdivision; THENCE N. 76°37.5'W., along the South side of alley, 256.75'to a point; THENCE S.O°12.4~W., 374,44~ to a point, the SW Corner of said Block 1; THENCE S.89°47.6~E., 250.0" to the SE Corner of said Block 1; THENCE N.OO12.4~E., 315.95' to the PLACE OF BEGINNING and containing 1.98 acres; Located 600-700 Block 1-27, from a C-1 Zone to a CGB Zone for Commercial Use. C-1 to a CGB ZONING WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly presented to the Planning & Zoning Commission for its recommendation which was received by the City Council, and after due consideration the City Council of the City of Plainview finds that for the orderly growth of the City making the proposed change as hereinafter set out will be in the public interest which creates an emergency; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as well as giving notices in compliance with Section 18 of Ordinance 77-2090 as well as notices provided by Article 1011F Vernon's Annotated Civil Statutes-Amended, 1953, and notice was duly published in the Plainveiw Herald more than fifteen (15) days prior to the date of the Public Hearing before the City Council of such pro- posed amendemnt, and the Public Hearing according to said notice was duly held in the City Council Room of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council, determined that it would be in the public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1. WHEREASv an emergency exists as shown in the preamble to this Ordinance, the enactment of this Ordinance is delcared to be an emergency measure creating a public necessity that the rule requiring proposed Ordinance to be presented at two (2) separate Council meetings be dispensed with; and this Ordinance shall be effective from the date Of its passage.
