AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL MAP OF
THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES, AND CREATING AN EMER-
GENCY:
ZONE CASE NO. 361:
A 5..58 acre tract out of the NW part of Section 28 and the SW part of Section 27,
Block JK-2, Hale County, Texas:
BEGINNING at a point in the south line of Section 27 and the north line of
Section 28, Block JK-2, Hale County, Texas, said point being in the north R-O-W
line of US Hwy No. 70 and 592.8' from the SW Corner of Section 27;
THENCE 424.92' southeastward around a curve to the right having a radius
of 2,924.8 feet, a central angle of 8°19'27'' and a chord bearing S 74012'23'' E,
424.55' to a point in said R-O-W line;
THENCE S 70006' E, 13.2' to a point;
THENCE N 0°23'5l'' W, at 120.27' pass the north line of Section 28 and the
south line of Section 27, in all 318.27' to a point;
THENCE 208,87' northwestward around a curve to the left having a radius of
3,224.8', a central angle of 3°42'40'' and a chord bearing N 73o40'42'' W, 208.82'
to a point;
THENCE N 0°23'51'' W, 217.91' to a point;
THENCE S 89o36'09'' W, 372.4' to a point;
THENCE S 0°23'51'' E, 445.8' to a point;
THENCE 154.78' southeastward along a curve to the right having a central
angle of 3°01'55'', a radius of 2,924.8' and a chord bearing S 80009'48'' E, 154.76'
to the PLACE OF BEGINNING,
and containing 5.58 acres of which 5.051 acres is in Section 27 and 0.525 acre is
in Section 28, located 4500 Block Olton Road,
CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM C-2 to a CGB ZONING DISTRICT.
WHEREAS, the proposed change in Zoning Districts as hereinafter made has been
duly presented to the Planning & Zoning Commission for its recommendation which
was ~eceived by the City Council, and after due consideration the City Council
of the City of Plainview finds that for the orderly growth of the City making
the proposed change as hereinafter set out will be in the public interest which
creates an emergency; and,
WHEREAS, all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map, have been fully complied with, as well as giving no-
tices ~n compliance with Section 18 of Ordinance 77-2090, as well as notices pro-
vided by Article lOllF Vernon's Annotated Civil Statutes-Amended, 1953, and no-
tice was duly published in the Plainview Herald more than fifteen (15) days prior
to the date of the Public Hearing before the City Council of such proposed amend-
ment, and the Public Hearing according to said notice was duly held in the City
Council Room of the City Hall, Plainview, Texas, at which time persons appeared
in support of the proposal; and after said hearing, it was by the City Council
determined that it would be in the public interest due to changed conditions,
that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter
set forth in the body of this Ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION 1. That Ordinance No. 77-2090 and the Official Zoning Map be and the same
are hereby amended, as follows, to-wit:

Texas, from a C-2 to a CGB Zoning District. From the date of this Ordinance,
said Lot, tract, and parcel of land described shall be and hereby be changed to
the Zoning District indicated and the Official Map is amended in accordance
herewith.
WHEREAS, an emergency exists as shown in the preamble to this Ordinance, the
enactment of this Ordinance is declared to be an emergency measure creating a
.public necessity that the rule requiring proposed Ordinance to be presented at
two (2) separate Council meetings be dispensed with; and this Ordinance shall
be effective from the date of its passage.
Unanimously passed by the City Council this 13th day of December, 1977.
