ORDINANCE NO. 77-2170 ·
AN ORDINANCE OF THE CITY OF PLAINVIEW REGULATING AND CONTROLLING THE MAIN-
TENANCE OF BUILDINGS AND PREMISES; TO SAFEGUARD LIFE, HEALTH, PROPERTY AND PUB-
LIC WELFARE BY REGULATING THE STORAGE~ USE AND HANDLING OF DANGEROUS AND HAZAR-
DOUS MATERIALS, SUBSTANCES AND PROCESSES, AND BY REGULATING THE MAINTENANCES OF
ADEQUATE EGRESS FACILITIES, PROVIDING FOR THE REPEALING OF ORDINANCE NO. 75-1833
OF THE CITY OF ?LAINVIEW, PROVIDING FOR ADOPTION OF THE UNIFORM FIRE CODE, 1976
EDITION, AS COPYRIGHTED IN 1976; THE INTERNATIONAL CONFERENCE OF BUILDING OFFI-
CIALS OF WHITTIER, CALIFORNIA, PROVIDING FOR CERTAIN AMENDMENTS THERETO; PROVI-
DING PENALTIES FOR THE VIOLATION THEREOF; PROVIDING A SEVERABILITY CLAUSE; DI-
RECTING PUBLICATION OF THE DESCRIPTIVE CAPTION OF THIS ORDINANCE, TOGETHER WITH
THE PENALTY PROVISIONS, AND PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council of the City of Plainview finds that the present
Fire Code of the City of Plainview is inadequate to properly protect the public
health, safety, and welfare of the citizens of the City of Plainview and their
property, from loss due to fire, and
WHEREAS, the City Council appointed the Fire Code Board of Appeals to pre-
pare recommendations for the City Council in regard to a new Fire Code; and
WHEREAS, the Fire Code Board of Appeals recommends the Uniform Fire Code,
1976 Edition, with certain amendments thereo, be adopted as the Fire Code of the
City of Plainview; NOW TH~'REFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS:
SECTION 1.
That the 1973 Edition of the Uniform Fire Code, as copyri, ghted in
1973 by the International Conference of Building Officials of Whit-
tier, California (being Ordinance No. 75-1833 of the City of Plain-
view) be and the same is hereby repealed.
SECTION 2.
That the 1976 Edition of the Uniform Fire Code, as copyrighted in
1976 by the International Conference of Building Officials of Whit-
tier, California, as hereinafter amended is specifically adopted as
the Fire Code of the City of Plainview, Texas, and a copy is attached
hereto and incorporated herein by reference as though set out com-

pletely in detail. A copy of said Uniform Fire Code shall be filed
with the City Secretary and a copy maintained in the office of the
Fire Marshal of the City of Plainview, Texas. All such copies to
be ooen to public inspection during business hours of the office
where they are maintained, with the following amendments thereto:
That Article l, Division ll, Section 1.216 of the Uniform Fire Code,
1976 Edition, shall be and the same is hereby amended by adding to
the list of recognized Standards as part of the list, the 1973 Edi-
tion of the "Life Safety Code," N.. F. P. A. 101 as copyrighted in
1973 by National Fire Prevention Association.
That Article l, Division lll, Section 1.301 of the Uniform Fire Code,
1976 Edition, shall be and the same is hereby amended by deleting re-
quirements for permits. No permit shall be required when referred to
in the Code.
That Article l, Division IV, Section 1.403 of the Uniform Fire Code,
1976 Edition, shall be and the same is hereby amended to read as fol-
lows: When reference to the Uniform Plumbing Code is made, it shall
mean the City of Plainview Plumbing Code, as adopted by Ordinance No.
73-1366. When reference is made ~o the Uniform Mechanical Code, it
shall be deleted.
That Article l, Division ll, of the Uniform Fire Code, 1976 Edition,
is hereby amended by adding thereto a section to be known as Section
1.218 which said section shall read as follows:
That the entire incorporated area of the City of Plainview is
hereby d~clared to be and is hereby established as a fire dis-
trict, and said fire district shall be known and designated as
Fire Zone 1, 2, and 3, and each such zone shall include such
i~erritory and portions of the City of Plainview as follows:
ZONE I shall include the territory as set out and described
by metes and bounds as Zone 1 under Chapter 9, Artic-le 1, Sec-
tion 9.1(a) of the Municipal 'Code of theCity of Plainview, as
adopted 1978.
ZONE 2 shall include the territory as set out and described by
metes and bounds as Zone 2 under Chapter 9, Arti¢-le l, Section
9.1(b) of the Municipal-Code,Ci-ty of Plainview~ adopted 1978¥ tt
shall also include all commercial property a.~d buildings now
existing, and all property that may be zoned for commercial use.
ZONE 3 shall include all the area not set out in Zone 1 and Zone
2.
That Article 15, Division ll, Seci--ion 15.201, of the Uniform Fire
Code, 1976 Edition, shall be and the same is hereby amended to read
as follows: The limits in which storage of flammable liquids in out-

side above ground tanks is prohibited, are hereby established as
follows:

In any Residential District, as zoned by Ordinance No. 77-2090,
same being the Zoning Ordinance of the City of Plainview, as
amended.
The limits in which new bulk plants for flammable or combusti-
ble liquids are prohibited are those zones in the City of Plain-
view where such bulk plants are not permitted by Ordinance No.
77-2090, same being the Zoning Ordinance of the City of Plain-
view, as amended.
SECTION 8. PENALTIES:
Any person', firm, or corporation violating any of the provisions of
· this Code shall be deemed guilty of a misdemeanor, and each such per-
son shall be deemed guilty of a separate offense for each and every
day or portion thereof, during which any. violation of any of the pro-
visions of this Code is committed:, combined, or permitted, and upon
the conviction of any such violation such person shall be punishable
by a fine of not more than Two Hundred Dollars ($200).
SECTION 9. SEVERABILITY CLAUSE:
If any provisions of this Ordinance or of the Code hereby adopted or
the application thereof to any person or circumstance is held invalid,
the remainder of the Code and the application of such provisions to
other persons .or circumstances, shall not be affected hereby.
SECTION 10. The City Secretary is hereby authorized and directed to cause the pub-
lication of the descriptive Caption of this Ordinance together with
the penalty provisions as provided herein. This Ordinance shall be-
come effective after its passage and publication as required by law.
