HomeMy WebLinkAbout78-2209 ordORDINANCE NO. 78-2209 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL MAP OF THE CITY OF PLAINV!EW SO AS TO MAKE THE FOLLOWING CHANGES AND CREATING AN EMER- GENCY:ZONE CASE NO. 378: BEGINNING at NW corner of J.Kiser Homestead & SW corner Sec. 1, Blk D-4, all in Hale Co., TX; THENCE El30 for beginning corner of tract; THENCE S at 30' pass 5/8" rod set 30'S:_o~N_~li~e.of J. Kiser Homestead & 50' E of center-line of RR; in all 1007' to 5/8" rod in E ROW line of-RR & being NW corner of 10 acre tract of Western Cotton Oil Mill;THENCE E. at 466.6' pass a 5/8" rod set for NE corner of 10 acre tract, in all 600' to 5/8" rod;THENCE N 977' pass 5/8" rod, in all 1007' to N line of J. Kiser Homestead~THENCE W 600' to PLACE OF BEGINNING & containing 13.87 acres of land of Which .41 acre is included in the highway; CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM M-l, R-2 TO A LI ZONING DIS- TRICT. WHEREAS, the proposed change in Zoning Districts as hereinafter made has been du- ly presented to the Planning & Zoning Commission for its recommendation which was received by the City Council, and after due consideration the City Council of the City of Plainview finds that for the orderly growth of the City making the pro- posed change as hereinafter set out wilt be in the public interest which creates an emergency; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as well as giving notices provided by Article lOllF Vernon's Annotated Civil Statutes-Amended, 1953, and no- tice was duly published in the Plainview Herald more than fifteen (15) days prior to the date of the Public Hearing before the City Council of such proposed amend- ment, and the Public Hearing according to said notice was duty held in the City Council Room of the City Halt, Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE C:TY OF PLAINVIEW: SECTION 1. That Ordinance No. 77-2090 and the Official Zoning Map be and the same are hereby amended as follows, to-wit: ZONE CASE. 378: BEGINNING at NW corner of J. Kiser Homestead & SW corner Sec. 1, Blk D-4, all in Hale Co., TX: THENCE E 130' for beginning corner oftr2ct; THENCE S at 30' pass 5/8" rod set 30'S of N line of J.Kiser Homestead & 50' E of center-line of RR; in all 1007' to 5/8" rod in E ROW line of RR & being NW corner of 10 acre trac of Wester~'~o~ton Oil Mill;THENCE E. at 466.6' pass 5/8" rod set for NE corner of 10 acre tract, in all 600' to 5/8" rod; THENCE N 977' pass 5/8" rod, in all 1007! to N line of J.Kiser Homestead THENCE W 600' to PLACE OF BEGINNING & containing 13.87 acres of land of which .41 acre is include~ in the highway; City of Plainview, Hale County, Texas, from anM--1, R-2 to a LI Zoning District. From the date of this Ordinance said lot, tract, and parcel of land described shall be and hereby be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. WHEREAS, an emergency exists as shown in the preamble to this Ordinance, the en- actment of this Ordinance is declared to be an emergency measure creating a pub- lic necessity that the rule requiring proposed Ordinance to be presented at two (2) separate Council Meetings be dispensed with; and this Ordinance shall be effective from the date of its passage.
