HomeMy WebLinkAbout06.05.2017 ZBA MINUTES BOARD OF ADJUSTMENT MINUTES 6/05/2017 BOARD MEMBERS PRESENT: Mark Hardin, Joe Frank Rodriguez, Danny Murphree and Nicole Ramirez. STAFF MEMBERS PRESENT: Nick Mogg, Code Enforcement, Judy Rasher, Community Service Secretary. Mark Hardin called the meeting to order at 6:01 P. M. FIRST ITEM ON THE AGENDA: Approval of April 17, 2017 minutes. Joe Frank Rodriguez made a motion to approve minutes as presented. Nicole Ramirez seconded the motion. Motion carried unanimously. SECOND ITEM ON THE AGENDA: Oath of Office — Danny Murphree. THIRD ITEM ON THE AGENDA: ZBA -17 -02 Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Lot 21, Block 2 of the Hillcrest Addition, Plainview, Texas, Hale County, also known as 226 SE 10 Street. Homeowner is requesting a variance or special exception in order to construct a flat roof 21 x 20 ft metal frame carport in the front yard setback. The proposed carport would encroach approximately 20 ft into the required minimum front yard setback of 25 feet. This would result in it being 16.5 feet from the back of the curb if approved. Homeowner has stated that recent hail storms have damaged their vehicles and in an effort to protect their vehicles from the elements, the mentioned carport is being proposed. Staff observed several carports within a two block radius. Staff recommends approval as presented. Nicole Ramirez made a motion to approve the variance based on the request. Danny Murphree seconded and the motion was carried unanimously. FOURTH ITEM ON THE AGENDA: ZBA -17 -03 Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Lot 7 N/2 -8, Block 16 of the West Hillcrest Addition, Plainview, Texas, Hale County, also known as 304 SW Alpine Street. Board of Adjustment June 5, 2017 Minutes Homeowner is requesting a flat roof 14 x 24 ft metal frame carport in the front yard setback. In surveying the surrounding area, staff observed several (five) similar constructed carports within the front yard of homes within a two block radius. As per code Section 37.2.2(h), there is no other practical location on the property for him to install the carport. 13 Letters were sent out to the neighbors. Did not receive any responses from the neighbors. Homeowner has complied with the set back from the front and side of his property lines. Danny Murphree made a motion to approve the variance based on the request. Joe Frank Hernandez seconded and the motion was carried unanimously. FIFTH ITEM ON THE AGENDA: ZBA -17 -04 Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 22 E90' -3 N40'W50' -3 of the NSLS Addition, Plainview, Texas, Hale County, also known as 1603 Galveston Street. Homeowner is requesting a flat roof 20 x 18 ft metal frame carport in the front yard setback. Due to the home being built within 19 feet from the property line, which is 6 feet into the minimum setback required, the proposed carport would encroach approximately 24 feet into the required minimum front yard setback of 25 feet. This would also result in it being 20 feet from the back of the curb if approved. Homeowner has stated that the recent hail storms did severe damage to their vehicles and in an effort to shield the vehicles from further damage, are requesting a carport. Staff observed five similar carports within a two block radius. Staff recommends approval as presented. Nicole Ramirez made a motion to approve the variance based on the request. Danny Murphree seconded and the motion was carried unanimously. SIXTH ITEM ON THE AGENDA: ZBA -17 -05 Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 S47.5' -5 N22.5'- 6 of the Schoolview Addition, Plainview, Texas, Hale County, also known as 1411 Travis Street. Homeowner is requesting a flat roof 12 x 24 feet metal frame carport in the front yard setback. Due to a 12 foot offset of the home's front wall, the carport would encroach approximately 12 ft into the required minimum front yard setback of 30 feet. This would result in being 40 feet from the back of the curb if approved. In an effort to shield the homeowner's vehicles from the weather, the mentioned carport is now being proposed. Staff observed four constructed carports within the two block radius. Staff recommends approval as presented. Danny Murphree made a motion to approve the variance based on the request. Nicole Ramirez seconded and the motion was carried unanimously. Board of Adjustment June 5, 2017 Minutes SEVENTH ITEM ON THE AGENDA: ZBA -17 -06 Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 2 Lots 3 -4 of the Rowe -Goode Addition, Plainview, Texas, Hale County, also known as 1107 Quincy Street. Homeowner is requesting a variance to construct a 24 x 24 metal frame carport in the front yard setback. The proposed carport would encroach approximately 15 feet into the required minimum front yard setback of 30 feet. This would result in being 20 feet from the back of the curb if approved. Homeowners stated that recent hail storms did damage to their vehicles. Staff observed two similar carports within the front yard of homes within the two blocks radius. Quincy Street is a highly visible and highly travelled road. Staff is of the opinion that this request would not disrupt the existing streetscape of Quincy, staff believes it is worth noting that future requests along Quincy Street as well as other thoroughfares in Plainview, should be considered. Staff recommends approval as requested. Nicole Ramirez made a motion to approve the variance based on the request. Joe Frank Rodriguez seconded and the motion was carried unanimously.
