MINUTES
7/20/2017
The Zoning Board of Adjustment held a special public hearing on Thursday, July 20, 2017 at
6:00 p.m. The meeting took place in the Council Chambers of City Hall, 901 Broadway,
Plainview, Texas, with the following members present:

Mark Hardin opened the meeting at 6:01 pm, established a quorum and conducted the
consideration of the following items in the order presented. Nick Mogg read the staff reports,
and gave the recommendations for each item.
FIRST ITEM ON THE AGENDA: Approval of June 5, 2017 minutes.
Joe Frank Rodriguez made a motion to approve minutes of June 5, 2017 as presented. Nicole
Ramirez seconded the motion. Motion carried unanimously.
SECOND ITEM ON THE AGENDA:
ZBA -17 -07 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 10 W46' -7 E26' -8 of the
Edgemere Addition, Plainview, Texas, Hale County, also known as 3002 W 20th Street.
Applicant is requesting a variance to construct a 24 x 21 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 20 feet into the required
minimum front yard setback of 30 feet. If approved, the front edge of the carport will be 28 feet
from the back of the curb. Staff observed several carports within a two block radius. Three of
the five carports are located on W 20 street, east of the applicant's home. Applicant has a two
car garage in the rear of the yard. Applicant stated that one of his two vehicles is too high to fit
in the garage and vehicles are wide and would make it difficult getting in and out of the rear
yard. Staff recommends approval as presented. Danny Murphree made a motion to approve
the variance based on the request. Kevin Carter seconded and the motion was carried
unanimously.

THIRD ITEM ON THE AGENDA:
ZBA -17 -08 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 80 out of the Center of NE /4
Plus 100 x 190 of the College Hill Addition, Plainview, Texas, Hale County, also known as 2607
W 7th Street.
Applicant is requesting a variance to construct a 24 x 24 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 12 feet into the required front
yard setback of 25 feet. If approved, this would result in the front edge of the carport being 35
feet from the back of the curb. Staff observed several carports within a two block radius.
Majority of the carports can be found to the north on Zephyr Street. This particular
neighborhood is one where there is a mix of double and single car garages. The applicant's
home has a single car garage. Applicant owns two vehicles. Notices have been sent to
property owners within 200 feet or applicant. Staff received one comment in favor of the
carport. Staff recommends approval as presented. Nicole Ramirez made a motion to approve
the variance based on the request. Danny Murphree seconded and the motion was carried
unanimously.
FOURTH ITEM ON THE AGENDA:
ZBA -17 -09 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 1 Lot 4 of the Roberson
Addition, Plainview, Texas, Hale County, also known as 1315 Utica Street.
Applicant is requesting a variance to construct a 24 x 24 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 24 feet into the required front
yard setback of 30 feet. If approved, this would result in the front edge of the carport being 28
feet from the back of the curb. Staff observed several carports within a two block radius. This
particular neighborhood is one where many of the homes were not built with attached garages.
Notices have been sent to property owners within 200 feet or applicant. Staff have not received
any comments. Staff recommends approval as presented. Kevin Carter made a motion to

was carried unanimously.
FIFTH ITEM ON THE AGENDA:
ZBA -17 -10 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 2 S/2 -3 All 4 of the Babitzke
Addition, Plainview, Texas, Hale County, also known as 1403 Travis Street.
Applicant is requesting a variance to construct a 24 x 24 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 24 feet into the required front
yard setback of 30 feet. Because of the off set in the house design, the proposed carport would
encroach approximately 7 feet into the required yard setback of 30 feet. If approved, this would
result in the front edge of the carport being 49 feet from the back of the curb. The applicant did
have a one car garage with two vehicles. Staff observed several carports within a two block

radius. This particular neighborhood is one where many of the homes were not built with
garages. Notices have been sent to property owners within 200 feet or applicant. Staff have
not received any comments. Staff recommends approval as presented. Danny Murphree made

motion was carried unanimously.
SIXTH ITEM ON THE AGENDA:
ZBA -17 -11 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 24 W75' -7 & 8 of the College
Hill Addition, Plainview, Texas, Hale County, also known as 1610 W 9th Street.
Applicant is requesting a variance to construct a 12 x 18 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 18 feet into the required front
yard setback of 25 feet. If approved, this would result in the front edge of the carport being 29
feet from the back of the curb. The applicant did have a one car garage. Applicant stated that
the existing garage is too narrow to utilize. Staff asked if the carport could be located adjacent
to the north of the home in the side yard. The applicant stated that although space is available,
her medical condition would make the extended walk to the front door a difficult one. Staff
observed several carports within a two block radius. This particular neighborhood is one
where many of the homes were not built with attached garages. Notices have been sent to
property owners within 200 feet or applicant. Staff have not received any comments. Staff
recommends denial as presented. Kevin Carter made a motion to approve the variance based
on the request. Joe Frank Rodriguez seconded and the motion was carried unanimously.
SEVENTH ITEM ON THE AGENDA:
ZBA -17 -12 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 9 W45' -1 W40' of N24' -2 of the
OT Addition, Plainview, Texas, Hale County, also known as 310 E 4th Street.
Applicant is requesting a variance to construct a 8 x 16 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 16 feet into the required front
yard setback of 25 feet. If approved, this would result in the front edge of the carport being 31
feet from the back of the curb. Staff observed several carports within a two block radius. This
particular neighborhood is one where many of the homes were not built with garages. Notices
have been sent to property owners within 200 feet or applicant. Staff have not received any
comments. Staff recommends approval as presented. Danny Murphree made a motion to
approve the variance based on the request. Kevin Carter seconded and the motion was carried
unanimously
EIGHTH ITEM ON THE AGENDA:
ZBA -17 -13 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 9 Lot 6 of the OT Addition,
Plainview, Texas, Hale County, also known as 305 Cedar Street.

Applicant is requesting a variance to construct a 22 x 18 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 7 feet into the required front yard
setback of 25 feet. If approved, this would result in the front edge of the carport being 22 feet
from the back of the curb. Staff observed several carports within a two block radius. Of these
existing carports, many appear to have been built one or two feet from the front property line.
This may be a result of the homes were built at a time when the required setback was less that
is required today. This particular neighborhood is one where many of the homes were not built
with garages. The applicant stated that although there is space on this side of the property, it is
not practical considering the width of the side yard for two vehicles. The neighbors to the
immediate north and south have constructed carports in the side yard of the lots in which
multiple vehicles are parked. The arrangements of the cars under these carports are parked in
a single file manner rather than side by side. Notices have been sent to property owners within
200 feet or applicant. Staff have not received any comments. Staff recommends denial as
presented. Nicole Ramirez made a motion to approve the variance based on the request.
Danny Murphree seconded and the motion was carried unanimously.
